The attached Resolution approves the amendment to the Subdivision Agreement between
Sanitary and Improvement District (S.&I.D.) 206 of Douglas County, Nebraska and the City of
Omaha. The Subdivision Agreement covered the public improvement for Farmington Woods
was approved by City Council on July 27, 1993, via Resolution No. 1803.
The amendment revises a portion of the storm sewer system shown in the Subdivision
Agreement. The revision removes a low flow storm sewer pipe and replaces it with a storm
sewer pipe large enough to handle a 10 year storm. The residents within Farmington Woods
have requested this change which reduces the amount of surface storm water flow in their back
yard. The cost of this project is estimated to be $495,000.00 which will be a general obligation
of the District. If S.&I.D. 206 is annexed by the City, any outstanding general obligation debt
would be assumed by the City.
The Public Works Department requests your consideration and approval of the attached
Resolution and amendment to the Subdivision Agreement.

AMENDMENT TO
SUBDIVISION AGREEMENT
THIS AMENDMENT to Subdivision Agreement is made and entered into this /a--day
of 2001 by and between Sanitary and Improvement District No. 206 of Douglas
County, ebraska(hereinafter referred to as"District") and the City of Omaha, a Municipal
Corporation in the State of Nebraska(hereinafter referred to as"City").
WITNESSETH:
WHEREAS, District and City, together with Charles G. Smith, Trustee, were parties to
that Subdivision Agreement (the"Agreement") adopted by the Omaha City Council on July 27,
1993 pursuant to Council Resolution No. 1803 relating to the Farmington Woods Subdivision;
and
WHEREAS, the parties to said Subdivision Agreement have heretofore performed their
respective obligations in accordance therewith; and
WHEREAS, subsequent to the development of the Farmington Woods Subdivision,
District has determined that the storm sewer system currently serving the Subdivision contains the
potential for unreasonable danger to persons as a result of the volume and velocity of surface-
borne storm water traveling in the existing storm sewer and drainage easement across portions of
lots 92, 97, 98, 105 through 113, 118 through 127, and 129; and
WHEREAS, in order to address and rectify the present situation, the District proposes to
reconstruct the storm sewer system across the above-referenced lots by replacement of the
existing 36-inch diameter underground storm sewer pipe with a 72-inch underground storm sewer
pipe; and
WHEREAS, District and City wish to agree upon the manner and the extent to which
public funds may be expended in connection with the aforesaid storm sewer improvements to he
constructed within the Farmington Woods Subdivision and the extent to which the contemplated
public improvements specially benefit property in the Subdivision and to what extent the costs of
same shall be specially assessed and to amend the Agreement in accordance herewith.
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
For purposes of this Amendment to Subdivision Agreement, the words and phrases
defined in the Agreement shall have the meanings set forth therein.

SECTION I
District covenants that it shall present to the City Clerk for the benefit of the City a
binding contract in full force and effect calling for the timely and orderly installation of the
following public improvements, according to the terms of the contract:
FarmingtonWoods Storm Sewer Section III consistingof storms sewers, inlets,

manholes and related improvements constructed in easements, per plans and
specifications for said improvements, to be approved by City prior to starting
construction, said improvements to be located as shown on storm sewer plan
prepared by Lamp, Rynearson& Associates, a copy of which is attached hereto as
Exhibit"A".
The District shall also provide and deliver to the City written confirmation of a binding agreement
between the District and its fiscal agent calling for the placement of the warrants or bonds of the
District for the installation of said public improvements.
SECTION II
The parties agree that the entire cost of the public improvements paid for the District and
set out in Section I herein shall be a general obligation of the District.
SECTION III
Credit or funds of the District may be used to pay for the public improvements described
in this Amendment to Subdivision Agreement.
SECTION IV
All provisions of the Agreement not specifically amended by the terms of this Amendment
to Subdivision Agreement are hereby ratified and confirmed in all respects.
This Amendment to Subdivision Agreement shall be binding upon the parties, their
respective successors and assigns.
IN WITNESS WHEREOF, we, by our respective duly authorized agents, hereby enter
into this Amendment to Subdivision Agreement, effective on the day and year first above written.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, S.&I.D. 206 proposes to modify a portion of its storm sewer system
within Farmington Woods; and,
WHEREAS, Sanitary and Improvement District (S.&I.D. 206) will build the
public storm sewer in the Subdivision; and,
•
WHEREAS, the parties wish to agree on the manner and extent to which public
funds may be expended in connection with the public improvements to be constructed within the
area to be developed and the extent to which contemplated public improvements specifically
benefit property in the area to be developed and to what extent the cost of same should be
specially assessed; and,
WHEREAS, the parties entered into a Subdivision Agreement approved by City
Council on July 27, 1993, via Resolution No. 1803, that provided a low flow storm sewer pipe to
handle the storm water in the Subdivision; and,
WHEREAS, the residents of Faiuungton Woods believe the occasional storm
water surface flow to be a danger to their children and have requested that the low flow pipe be
upsized to handle a 10 year storm; and,
WHEREAS, S.&I.D. 206 believes this to be a safety matter and proposes this pipe
enlargement as a general obligation of the District; and,
WHEREAS, an amendment to the Subdivision Agreement has been prepared
setting forth all the provisions mentioned above.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, the amendment to the Subdivision Agreement between the City of Omaha
and Sanitary and Improvement District 206, as recommended by the Mayor, providing for
upsizing a low flow storm sewer pipe within Farmington Woods is hereby approved.
