SUBDIVISION AGREEMENT
Ponca Preserve Replat
This Subdivision Agreement,made this /3 day of , 2001 by and
between J. ALLAN MACTIER,ALLAN G. LOZIER AND PONCA HOMEOWNERS ASSOCIATION,
INC., a Nebraska Corporation(hereinafter referred to as "SUBDIVIDER") and the CITY OF OMAHA
(hereinafter referred to as "CITY").
WHEREAS, the Subdivider represents the owner of the land shown on the proposed plat attached
hereto as Exhibit"A" (hereinafter referred to as "PROPERTY"); and
WHEREAS, Ponca Homeowners Association, Inc. is comprised of the property owners of Lots 1 thru
23, inclusive, of Ponca Preserve Replat.
WHEREAS, the Subdivider proposes to use existing roads to access the property; and
WHEREAS,the Subdivider proposes to use septic systems to treat wastewater; and
WHEREAS, The Subdivider and City desire to agree on the method for the installation and allocation
of expenses for public improvements to be constructed in the property.
NOW,THEREFORE, in consideration of the above the following is agreed between the parties hereto:
1. Public Improvements. Non-standard improvements exist to service the subdivision, these
include the roadway surface and individual septic systems to treat wastewater. If the City
creates improvement districts in the future to install a standard roadway, storm sewer and/or
sanitary sewer, the Subdivider agrees that each lot owner pay a fair assessment for such
improvements.
2. Water, Gas, and Electrical Power. The subdivision is presently served with electricity from
Omaha Public Power District and gas from Metropolitan Utilities District. The subdivision
has installed and maintains its own water system.
3. Sidewalks. Sidewalks along the public street within the area will not be required until a
sidewalk district is created by the City of Omaha or Douglas County to service the
subdivision.
4 Outlots. The Subdivider agrees that Outlots 1 and 2, inclusive (shown on Exhibit"A")are
owned and shall be maintained as "green space"by J. Allan Mactier and Outlot 3 is owned
and shall be maintained as driveway ingress and egress by Allan G. Lozier.
8. Binding Effect. This Subdivision Agreement shall be binding upon the parties, their
respective successors, and assigns and runs with the land shown on Exhibit A.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS,J.Allan Mactier,Allan G.Lozier and Ponca Homeowners Association,
Inc.propose to build a Subdivision,Ponca Preserve Replat,which will be located at 42nd and Hawk
Woods Circle; and,
•
WHEREAS,the Subdivision's wastewater is treated by individual septic systems for
each lot; and,
WHEREAS, if the City creates public improvement districts for streets, sewers or
sidewalks, the Subdivider agrees to pay a fair assessment for same; and,
WHEREAS,J.Allan Mactier shall own and provide ongoing maintenance for Outlot
1 and 2 within the Subdivision; and,
WHEREAS,Allan G.Lozier shall own and provide ongoing maintenance for Outlot 3
within the Subdivision; and,
WHEREAS, a Subdivision Agreement has been prepared setting forth all the
provisions mentioned above.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:
THAT,the Subdivision Agreement among the City of Omaha,J.Allan Mactier,Allan
G. Lozier and Ponca Homeowners Association, Inc., as recommended by the Mayor, providing a
commitment to pay a fair assessment for future public improvements is hereby approved.
