The attached proposed Resolution authorizes the City to enter into a Water Main Extension
Agreement with the Metropolitan Utilities District in the amount of$145,000 for the Stockyards
Redevelopment Project.
The Stockyards East Redevelopment Plan that authorizes this work was approved by the City
Council on April 14, 1998 by Resolution No. 906. Under the Redevelopment Plan, the City
acquired the former Stockyards property at 30th and "L" Streets for a business park. The site is
being cleared and graded and new streets, sewers and utilities are being installed. Under the
attached Agreement, Metropolitan Utilities District will install the water mains and
appurtenances to serve the new Stockyards Business Park.
The costs incurred under this Agreement will be paid from the 2001 Stockyards Redevelopment
Fund, Fund 351, Agency 195, Organization 1191. It is the express intent of the City Council of
the City of Omaha to issue Revenue Bonds in the amount of$145,000 to reimburse the City for
the expenditures of the project prior to issuing said bonds. The bonds will be paid from the sale
of land in the Stockyards Business Park.

WATER MAIN EXTENSION AGREEMENT
District Job No. WCC 9258
THIS AGREEMENT, entered into on • 20_, between
METROPOLITAN UTILITIES DISTRICT OF OMAHA,NEBRASKA, ("District")and
City of Omaha . . ("Applicant"), witness:
In consideration of the sum of One Hundred Forty Five Thousand and 00/100 Dollars
($ 145,000.00 ) paid by Applicant to the District, receipt of which is acknowledged, District agrees to
install as soon as is reasonably possible

lots 1-13
as shown on the attached plat marked Exhibit"A", together with such appurtenances as the District
may deem necessary. This consideration includes (1)the estimated (total) cost of installing the main
and appurtenances ($ 145,000 ). The estimated total cost of installing the main and
appurtenances is $ 145,000 , of which cost the District shall assume $ None , which is
the estimated difference in cost between an 8 "main required and an 8 "main installed.
If the estimated (total)cost for the installation of the main and appurtenances or the estimated
contributions to other pioneer mains, or both, are not sufficient to cover the actual costs and/or
contributions, Applicant shall pay to the District the actual costs and/or contributions, over the
estimated costs and/or contributions. The District may refuse service from the main until payment(s)
has/have been made.'
If the actual (total) cost for the installation of the main and appurtenances or the estimated
contributions to other pioneer mains, or both, are less than the amount paid, the difference, of either
or both, whichever the case may be, shall be refunded to the Applicant.
Applicant agrees that the location and grade of the right-of-way(R.O.W.), over which
Applicant has control as shown on the attached plat shall not be varied and that the R.O.W. shall be
graded to conform to such grade prior to the installation of the main. Where streets are not to be
paved,the R.O.W. shall be graded to conform to a grade that has been legally established by the
appropriate governing body. Where the grade has not been established, the grade shall be
satisfactory to the District. Where streets are to be paved, the installation of the main shall not begin
until Applicant has completed the paving of all streets, installation of all storm sewer inlets and finish
grading of all R.O.W.. Within five (5)years from the date the mains are installed, if the District deems
it necessary to relocate, lower or change the grade of all or any part of the main and its appurtenances
resulting from either a failure to have brought the street to grade before the installation or a change in
• the grade or location of the streets caused by Applicant, then the cost of such lowering or relocation
shall be paid by Applicant.
Within five (5)years from the date the mains are installed, if the District deems it necessary to
n thereon raise or lower any fire hydrant shown on the attached plat because the ground ring or flange a eon is
found to be below grade or more than three (3) inches above grade, then the cost of raising or
lowering any fire hydrant, shall be paid by Applicant.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, the primary objectives of the City of Omaha's Master Plan and
Community Development Program are to encourage additional investment and development
within inner-city neighborhoods; and to eliminate conditions which are detrimental to public
health, safety and welfare, by developing underutilized property within these neighborhoods;
and,
WHEREAS, the Stockyards Redevelopment Plan for the area generally bounded
by "L" Street, Union Pacific Railroad Tracks, "Q" Street and 33rd Street was approved by the
City Council on May 5, 1998 by Resolution No. 0000; and,
WHEREAS, the Stockyards Redevelopment Plan proposed the installation of •
public improvements for a new business park and a new single family residential subdivision;
and,
WHEREAS, the Metropolitan Utilities District has agreed to install water mains
and appurtenances to the Stockyards Business Park; and,
WHEREAS, it is the express intent of the City Council of the City of Omaha to
issue Revenue Bonds in the amount of $145,000.00 to reimburse the City for a portion of the
expenditures of the project prior to issuing said bonds.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, the attached Agreement between the City of Omaha and Metropolitan
Utilities District, 1723 Harney Street, Omaha, NE 68102-1960 for the installation of water mains
and appurtenances for the Stockyards Redevelopment Project, in the amount of $145,000.00 is
hereby approved. Funds shall be payable from the 2001 Stockyards Redevelopment fund, Fund
351, Agency 195, Organization 1191.
