Kent Whinnery, Attorney at Law, has submitted a claim for wages due and owing to Carol
Jensen, city employee currently holding the position of Secretary II in the Planning Department.
The basis of the claim is twofold: 1) she contends that after a job study was performed she was
incorrectly classified as Secretary II and should be placed in a position with a pay scale
commensurate with a Planning Specialist (9.2 MC); and 2) she contends that she has been under
paid for wages for more than two years.
It is the belief and contention of the City of Omaha Personnel Department, Law Department, and
Planning Department, that the claim should be denied for the reason that Claimant is not
providing the services commensurate to that of a Planning Specialist, as determined by a job
analysis, which was performed on her position. Moreover, it is the belief and contention of the
City of Omaha Personnel Department, Law Department and Planning Department that the claim
should be denied for the reason that Claimant has not been underpaid for the services she has
provided for the last two years. Therefore, it is recommended that Carol Jensen's claim should be
denied.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, Kent Whinnery, Attorney at Law, has submitted a claim for wages
due and owing to Carol Jensen, current city employee holding the position of Secretary II, in the
Omaha City Planning Department; and,
WHEREAS, the claim is submitted based upon the contention of the Claimant;
that she is performing the duties beyond that of her current classification and should be assigned
to the pay range of 9.2 MC, or equal to that of a Planning Specialist, and has been so performing
said duties for more than two years; and,
WHEREAS, the City of Omaha recommends denial of the above-referenced
. claim for the reason that a job study was recently performed for Carol Jensen and she was
properly assigned to the classification of Secretary II based upon her knowledge, skills, abilities
and the nature of the work she actually performs.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, the City Council determines that the Complainant, Carol Jensen, is
properly classified as a Secretary II and has received full and complete compensation for the
period in dispute; and therefore, her claim for underpayment of wages is hereby denied.
