Transmitted herewith is a Resolution accepting the attached Negotiator's Report submitted by
Tim Phelan, made in accordance with Necessity Ordinance No. 35623, passed June 19, 2001,
declaring the necessity of appropriating and acquiring certain private property for the purpose of
constructing an interceptor sewer along the Big Papillion Creek from 126th and Military Road to
Bennington Wastewater Treatment Plant identified as S.O.S. 5868.
The Negotiator, Tim Phelan, was successful in acquiring one parcel of land or interest in
property required for the project, which address is located at 10747 North 156th Street, for the
total negotiated amount of$79,100.00.
The cost of one parcel of land or interest in property negotiated shall.be paid from the Interceptor
Sewer Construction Organization 1507, Agency 140, Bennington Interceptor Sewer, Fund 546.
The Public Works Department requests your consideration and recommends your approval of
this Resolution.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, Tim Phelan, Negotiator, has submitted to the City Council a
Negotiator's Report, attached, in accordance with Necessity Ordinance No. 35623, passed
June 19, 2001, declaring the necessity of appropriating and acquiring certain private property for
the purpose of constructing an interceptor sewer along the Big Papillion Creek from 126th and
Military Road to Bennington Wastewater Treatment Plant, identified as S.O.S. 586g;'and,
WHEREAS, the report shows that the Negotiator, Tim Phelan was successful in
negotiating and acquiring one parcel of land or interest in property required for the project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, the Negotiator's Report of Tim Phelan made in accordance with Necessity
Ordinance No. 35623 be and hereby is approved.
THAT, the Finance Department is authorized to pay the cost of the negotiated
parcel of land or interest in property acquired in the amount of $79,100.00 from the Interceptor
Sewer Construction Organization 1507, Agency 140, Bennington Interceptor Sewer, Fund 546.
