The original agreement, for preliminary design work, was adopted by City Council as Resolution No. 2614 on. September 13, 1994. Supplemental Agreement Number One, to expand the scope of the project, was adopted by Resolution No. 347 on January 28, 1997. Supplemental Agreement Number Two, to provide additional engineering services for the FDR/UNO/72nd Street intersection at Aksarben, was adopted as Resolution No. 1637 on June 16, 1998. Supplemental Agreement Number Three, to provide a final design,.was adopted by Resolution No. 2381 on August 31, 1999. Supplemental Agreement Number Four, to provide additional studies for impacted businesses, was adopted by Resolution No. 301 on January 30, 2001. This Supplemental Agreement provides for modification of the design to accommodate the replacement of the Center Street bridge over 72nd Street. The original design anticipated the bridge would remain in place. The schedule of services is listed in greater detail in Exhibits "A" through "D" to the Supplement. KMA has agreed to provide the final and additional design services listed in Exhibit "A" through "D" for a fee of $112,985.00 which will be paid from the year 1996 Street & Highway Bond Organization 1509, Agency 140, Fund 344, year 2001 funding. KMA has filed the required Annual Contract Compliance Report Form, CC-1, in the Human Relations Depailiuent. SP 86-23 THIS SUPPLEMENTAL AGREEMENT, made and entered into this 8 y of /f/�/,mi 01 by and between the City of Omaha, acting by and through its Mayor and City Council, hereinafter referred to as the "City", and Kirkham, Michael & Associates, Inc., a corporation of the State of Nebraska, hereinafter referred to as the "Consultant". WITNESSETH: WHEREAS, the City and Consultant are parties to an agreement dated the thirteenth day of September nineteen ninety-four for the design of improvements of 72nd Street from Interstate 80 to Cass Street, hereinafter referred to as the "Original Agreement" and WHEREAS, the City requires additional engineering services for the modifications of preliminary design plans, and WHEREAS, the Original Agreement provides the City the option to have the Consultant provide final design services for the improvements identified during the preliminary design (Phase 1, 2 and 3), and WHEREAS, the City desires to exercise this option for and the Consultant is willing to provide these engineering services in accordance with the terms hereinafter provided. NOW, THEREFORE, in consideration of these facts, the parties hereto agree as follows: I. GENERAL TERMS OF AGREEMENT All terms and conditions contained in the Original Agreement between the parties shall be binding to both parties with the exception of the amendments contained hereinafter. GENERAL DESCRIPTION OF SUPPLEMENTAL SCOPE AND CONTROL OF WORK The Consultant, upon receipt of Notice to Proceed shall perform all services required under this Supplemental Agreement for the project as outlined in the attached Exhibit "A" through Exhibit "C", hereby made a part of this Supplemental Agreement. III. TIME OF BEGINNING AND COMPLETION The Consultant shall begin work on the final design after the supplemental agreement is approved by the City and upon receipt of written "Notice to Proceed" from the City. The anticipated final design shall be completed based upon the schedule shown in Exhibit "D". The time for completion shall be equitably adjusted for delays not the fault of Consultant. Delays grossly affecting the completion of the work within the time specified for completion attributable to or caused by the Consultant or the City shall be considered as cause for termination of this agreement by the other. It is hereby mutually agreed that the City has continuing rights to work progress inspections and any and all additions, deletions, changes, elaborations or modifications of the services to be performed under the terms of this agreement which may from time to time be determined by the City as desirable or preferable, shall be controlling and governing. IV. FEES AND PAYMENTS The City shall pay Consultant for engineering services as follows: a. Modifications to Phase 3 Final Design Plans. Lump sum fee of One Hundred Twelve Thousand Nine Hundred Eighty Five Dollars ($112,985.00) for all services described in Exhibit "A", Scope of Services for Modification to Phase 3 Final Design Plans. The basis of the lump sum fee was established as provided in Exhibits "B" and "C". S:\961152\STENO\Sup5-Center-St-Bridge.wpd 2 b. Progress Payments. The Consultant shall submit monthly invoices which shall be based on the percentage of work completed during the calendar month. The monthly payments shall be based upon the satisfactory prosecution of the work and shall be substantiated by monthly progress reports. The City will make monthly payments until a maximum of 95 percent has been paid. The final 5 percent will be paid to the Consultant when the City and State accepts the work. The City will make every effort to pay the Consultant within 30 days of receipt of the Consultant's invoice. The acceptance by the Consultant of the final payment shall constitute and operate as a release to the City for all claims and any liability to the Consultant, his representatives and assigns for any and all things done, furnished or relating to the services rendered by the consultant under or in connection with this Supplemental Agreement or any part thereof. The Consultant shall also be responsible to determine when a change in the work scope necessitates an increase in the lump sum account. When the Consultant determines that an increase is in order, he will be required to estimate the additional costs necessary to complete the additional work, document the reasons for this increase and receive prior approval from the City in writing before expenditures beyond the lump sum amount are incurred. The City shall not be obligated to reimburse the Consultant for costs which have not been approved in excess of the lump sum amount. KM presented these findings to the City of Omaha Public Works Department and to the Nebraska Department of Roads. After evaluating the findings, both the City of Omaha and the Nebraska Department of Roads agreed that the bridge should be replaced as a part of the 72nd Street Phase 3 Project. KM's original scope of services was to use the existing bridge "in-place". This agreement provides for the additional engineering services required for the modification of the Phase 3 Final Design Plans for 72nd Street, Interstate 80 to Cass Street in the City of Omaha, Douglas County, Nebraska to include the design of the new Center Street bridge. Schedule of Services The following work tasks describe the engineering services to be provided to make the modifications to the roadway plans and to design the replacement bridge: Modifications to Phase 3 Final Design Roadway Plans. A. Horizontal Alignments. The original scope of services included using the existing bridge "in-place" with modifications to the existing concrete slope protection. To accomplish this KM had designed specific alignments for 72"d Street, Center Street, and the four interchange ramps to utilize the existing structure. With the new bridge, KM will redesign these alignments to carry typical sections on both 72nd Street and on Center Street. The ramps will also be redesigned to provide more desirable taper rates and geometrics. B. Vertical Alignments. For the same reasons stated for horizontal alignments, the vertical alignments will also be redesigned for 72nd Street, Center Street, and the four interchange ramps. C. Geometric Design. Due to the change in horizontal alignments and the revised typical sections in the area of the new bridge, the geometrics for intersecting roadways and drives will need to redesigned. The plan sheets that cover this area will need to modified to include the new design data. These sheets include the Typical Sections, Plan and Profiles, Phasing Plans, Construction and Geometrics, Joints Grades Signing & Interconnect, Drainage, Removals, Striping Plans, Drainage Structure Cross Sections, Right of Way Plans, and the Roadway Cross Sections. II. Preliminary Design - Center Street Bridge. A. Meetings. Two meetings with the City of Omaha Public Works Department and/or the Nebraska Department of Roads. B. Preliminary Bridge Design. This task involves preparing and submitting for approval the Type, Size, and Location (TS&L) plan to the City of Omaha Public Works Department and the Nebraska Department of Roads. It is anticipated that the replacement bridge will be a two-span prestressed girder bridge with MSE walls at the approach embankments. III. Final Design - Center Street Bridge. A. Meetings. Two meetings with the City of Omaha Public Works Department and/or the Nebraska Department of Roads. B. Plan Preparation. Final plans and final design will be completed in accordance with NDOR policy and procedures. Geotechnical investigation and recommendations will be completed for the substructure design, the MSE wall design and the approach embankment settlement prediction. PROJECT DESCRIPTION We understand the project will consist of replacing the existing Center Street Bridge over 72nd Street The new bridge will be slightly shorter in span and offset north of the existing Center Street centerline, with some overlap of the existing bridge location. The bridge abutments will include MSE walls to allow widening of the 72nd Street corridor. The existing piles are approximately 24 feet long at the pier locations, and approximately 34 feet long at the abutments. It is anticipated that the new bridge will be supported on driven steel or concrete piles. PURPOSES OF STUDY The purpose of this subsurface exploration is to obtain data to provide foundation design and construction recommendations. Also, site development, earthwork, and pavement recommendations will be provided. The following information will be included or addressed in our geotechnical report. • Computer generated boring logs with soil stratification based on visual soil classification (Unified Soil Classification System). • General project description. • Summarized laboratory data. • Site water levels observed during and after drilling. • Boring elevations. • Boring locations. • Subsurface exploration procedures. • Site preparation/earthwork recommendations - based on existing site soil conditions and project construction timing. • Construction considerations. • Discussion of foundation alternatives. • Recommended design parameters for deep foundation system(s). • Deep foundation installation recommendations/discussion..._including installation. inspection and testing. • Soil parameters-and other design considerations for the abutment MSE walls. • Anticipated total foundation settlement. • Anticipated differential foundation settlement. SCOPE OF SERVICES SUBSURFACE EXPLORATION We have reviewed the information supplied to us, and information from previous Terracon subsurface investigations for nearby structures. Based on this information, and our conversations with you, we propose completion of three borings to depths of about 80 feet 0501387 2 EXHIBIT "C" Page 2 of 7 Proposed Center Street Bridge Terracon Omaha, Nebraska Proposal No. 0501387 • August 30, 2001 below existing grade at the abutment and bridge pier locations indicated on the attached diagram. If the borings must be offset to higher elevations (near grade on Center Street) we may advance the borings deeper to account for the elevation difference. Sampling will be in accordance with our standard procedures wherein thin-walled samples (ASTM D 1587) are obtained in cohesive soils and split-barrel samples (ASTM D 1586) are obtained in granular soil, miscellaneous fill, and weathered rock or other hard material. Sampling will consist of four samples in the top ten feet, and one sample obtained every five feet for the remaining depth. Each of the samples obtained in the borings will be tested and classified. It normally requires at least 48 hours to have utilities located and we may need to meet with utility companies on site to show them where we plan to drill. We anticipate a need for lane closure traffic control to complete the drilling for this project. We also anticipate work would not be allowed during morning and evening rush hour. Terracon will--provide appropriate signage for the drilling operations. BORING LOCATIONS/ELEVATIONS The fee quoted in this proposal for our services is based on our providing layout and elevations of the borings, and all boring locations being readily accessible to normal truck-mounted equipment. Boring layout will be approximate. Distances from available reference features are generally measured using a mechanical wheel, and angles are estimated. Elevations are also approximate and are generally obtained using a surveyor's level. For reference of the borings to a specific bench mark, we will need the location and elevation of the bench mark prior to commencing field work. The locations and elevations of the borings should be considered accurate only to the degree implied by these methods. If precise boring locations and elevations are desired, we suggest your firm develop this information. 0501387 3 EXHIBIT "C" Page 3 of 7 Proposed Center Street Bridge Terracon Omaha, Nebraska Proposal No.0501387 August 30,2001 PERFORMANCE SCHEDULE We would anticipate starting the field exploration within approximately 5 to 7 working days after receiving notice to proceed. Although we can proceed with verbal approval, written authorization should still follow. Engineering reports would be submitted as outlined in the following section of this proposal. Field exploration, laboratory testing and geotechnical engineering analysis will be performed by staff in our Omaha office who are familiar with this site. Our completed report would be submitted approximately 15 working days after completion of the field exploration. GEOTECHNICAL ENGINEERING ANALYSES After completion of the field and laboratory testing programs, the data and conditions would be analyzed and a report will be prepared by or under the supervision of a professional engineer registered in the State of Nebraska. Unless instructed otherwise, three bound copies of the report will be issued from our Omaha, Nebraska office. FEE STRUCTURE & CONDITIONS _ Based on the proposed program, we quote a lump-sum cost of $5,690.00 for this project. This price is based on performing only the scope of services outlined. We anticipate that traffic control will be necessary for the boring in the median of 72"d Street and possibly the borings east and west of 72'd Street. We have included an estimated $500 to cover these costs. Any additional cost for providing traffic control will be added to the lump sum cost base on unit rates for personnel and a rate of cost plus 15 percent for other expenses. If actual drilling depths vary from the proposed 80-foot boring depths, the lump-sum cost will be adjusted at a rate of$15.00 _ r.. per foot. Should subsurface conditions be encountered which require major revisions in the subsurface exploration programs and/or result in significantly higher costs, we will contact you prior to initiating this work. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT, the Supplemental Agreement Number Five with Kirkham, Michael and Associates, Inc. to provide a redesign of the 72nd Street widening project to include the replacement of the Center Street bridge over 72nd Street,is hereby approved. BE IT FURTHER RESOLVED: THAT, the Finance Department is authorized to pay $112,985.00 for the final design services listed in Exhibits "A" through "D" from the year 1996 Street & Highway Bond Organization 1509, Agency 140, Fund 344,year 2001 funding.
