Transmitted herewith is a Resolution accepting the attached Negotiator's Report submitted by Tom
Lund,made in accordance with Necessity Ordinance No. 35623,passed June 19,2001,declaring the
necessity of appropriating and acquiring certain private property for the purpose of the construction
of the Bennington Outfall. Sewer, known as S.O.S. 5868.
The Negotiator, Tom Lund, was unsuccessful in negotiating and acquiring one parcel of land or
interest in property required for the project and the Public Works Department recommends that the
Law Department of the City of Omaha take the necessary steps and procedures to condemn the one
parcel of land or interest in property non-negotiated.
The cost of the condemnation awards based on the Report of Appraisers made for the parcel of land
or interest in property non-negotiated shall be paid from the interceptor Sewer Construction,
Organization 1507,Bennington Interceptor Sewer,Fund 546.
The Public Works Department requests your consideration and recommends your approval of this
Resolution.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS,Tom Lund,Negotiator,has submitted to the City Council a Negotiator's
Report, attached, in accordance with the Necessity Ordinance No. 35623, passed June 19, 2001,
declaring the necessity of appropriating and acquiring certain private property for the purpose of the
construction of the Bennington Outfall Sewer; and,
WHEREAS, the report shows that the Negotiator, Tom Lund, was unsuccessful in
negotiating and acquiring one parcel of land or interest in property for the project.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:
THAT, the Negotiator's Report of Tom Lund made in accordance with Necessity
Ordinance No. 35623 be and it hereby is approved.
THAT, the Finance Department is authorized to pay the cost of the condemnation
awards based on the Report of Appraisers made for the parcel of land or interest in property non-
negotiated from the Interceptor Sewer Construction, Organization 1507, Bennington Interceptor
Sewer, Fund 546.
BE IT FURTHER RESOLVED:
THAT, the Law Department of the City of Omaha be and it hereby is authorized to
take all necessary steps and procedures to condemn the required property or interest in property for
the parcel of land non-negotiated.
