The Stockyards East Redevelopment Plan that authorizes this work was approved by the City Council on April 14, 1998 by Resolution No. 906. Under the Redevelopment Plan, the City acquired the former Stockyards property at 30th and "L" Streets for a business park. The site is being cleared and graded and new streets, sewers and utilities are being installed. Under the attached Agreement, Metropolitan Utilities District will install the gas mains at its expense to serve the new Stockyards Business Park. The Stockyards Redevelopment Project is included in the City of Omaha's Consolidated Submission for Community Planning and Development Programs previously approved by the City Council. The gas mains will be installed at no cost to the City. In the event that costs are incurred under this Agreement, the costs will be paid from the Community Development Block Grant, Fund 193, Organization 8330. JOB GRM 12129 THIS AGREEMENT, entered into on , 20 _ between METROPOLITAN UTILITIES DISTRICT OF OMAHA, NEBRASKA, ("District"), and City of Omaha, ("Developer"). In consideration of the mutual promises stated herein, the District and Developer agree as follows: A. District agrees to install gas mains at its own expense as soon as is reasonably possible in Stockyards Business Park at 30th and "L"Street to serve lots 1-13 as shown on the plat, if any, marked Exhibit "A" attached hereto together with such appurtenances as the District may deem necessary. B. Developer shall encourage the use of natural gas for water and space heating fuel within the subdivision or property to be served herein; and agrees that no covenants or restrictions shall be imposed which restrict or adversely affect the use of natural gas supplied by the District. C. Developer agrees that the location of the street(s) over which it has control, as shown on the attached plat, and grade thereof will not be varied and that the street(s) shall be graded to conform thereto prior to the installation of the main. If the District deems it necessary, within five (5) years from date the mains are constructed, to relocate, lower, or raise the grade of all or any part of the main and its appurtenances, resulting from either a failure to have brought the street(s) to grade before the installation of the main, or a change in the grade or location of the street(s) caused by Developer, then the cost of any such raising, lowering, or relocating of the main shall be paid by Developer. D. This agreement and any gas supplied in connection with it is subject to all applicable statutes, rules and regulations pertaining to the use of gas and all applicable curtailment orders. E. The main and appurtenances shall be the property of and under the exclusive control of the District. F. Installation of the mains and appurtenances is subject to the approval of the District's Board of Directors. If the installation is not approved, this agreement shall be void. If the Developer rescinds this agreement or otherwise fails to perform its obligation hereunder, the Developer shall pay to the District all costs and expenses incurred including design costs. • This agreement is subject to the following special conditions: 1. Receiving both signed Gas Main Extension Agreements. 2. Receiving all necessary permits for the installation of the gas main. 3. Receiving all necessary easements for the installation of the gas main. 4. Receiving Board Approval. 5. Developer shall not landscape or allow others to landscape in the right-of-way or in easements dedicated for main installation prior to the installation of the water or gas mains. If Developer does so, the District may remove any such landscaping necessary for installation of the water or gas mains. In addition, Developer shall be charged the additional cost of installing the mains caused by such landscaping. Landscaping shall be defined as the placing of any decorative materials, including but not limited to, the planting of trees or shrubbery and the placing of rocks or other large decorative objects. 6. Should the project be delayed, due to severe cold weather or when there is more than eight (8) inches of frost in the ground, the District shall not be required to work on the project without reviewing available Revenue Credit of Developer or additional compensation. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT, the attached Agreement between the City of Omaha and Metropolitan Utilities District, 1723 Harney Street, Omaha, NE 68102-1960 for the installation of gas main for the Stockyards Redevelopment Project is hereby approved. Funds shall be payable from Community Development Block Grant Fund No. 193, Organization No. 8330.
