The attached proposed Ordinance of Necessity authorizes the acquisition of a deteriorated house
within the Kellom Heights Amendment II Redevelopment Plan area. The property owner,
Rosemary Stubblefield, has requested that the City purchase her house at 963 North 25th Street.
The owner applied for assistance for the rehabilitation of the house under the CDBG Target Area
Rehabilitation Program after the house had been placarded for housing code violations. The cost
of rehabilitation is in excess of $50,000 and the property is within an area where the City has
been acquiring property for redevelopment. Acquisition of the property at this time will save
Community Development Block Grant funds.
The costs incurred for this acquisition will be paid from the FY2001 Community Development
Block Grant,Fund 193, Organization 8306.

AN ORDINANCE declaring the necessity of appropriating, for the use of the City of Omaha,
certain hereinafter described vacant and improved properties located in the Kellom
Heights Amendment II Redevelopment Plan Area, in an area generally defined by 24th
Street, Hamilton Street, 25th Street and Cuming Street, for acquisition, relocation as
appropriate, and subsequent use as sites for implementing the Kellom Heights
Amendment II Redevelopment Plan; provided that as to each specified parcel which
cannot be obtained by negotiation, proceedings in eminent domain be undertaken and
completed; and, providing for the effective date hereof. Funding shall be payable from
FY2001 Community Development Block Grant, Fund 193, Agency 200, Organization
8306.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
Section 1. That it is proper and necessary, pursuant to the Nebraska Community
Development Law, to appropriate vacant and improved properties generally located in an area
bounded by 24th Street, Hamilton Street, 25th Street and Cuming Street as outlined on the
attached map, and that these vacant and improved properties necessary for such purpose are in
Douglas County, Nebraska and are more particularly described as follows:
963 North 25th Street
That part of Lot 25, Block 1, Armstrong's First Addition to the City of Omaha, as
surveyed, platted and recorded, described as follows: Beginning at the Northwest corner
of said Lot, thence South along the West line of said Lot, 34 feet, thence due East 105
feet, thence South 11 feet, thence due East 22 feet, thence North along the East line of
said Lot, 45 feet to the Northeast corner of said Lot, thence West along the North line of
said Lot to the place of beginning, in Douglas County, Nebraska.
Section 2. That the City of Omaha is authorized, empowered and directed to negotiate,
through either employees of the City of Omaha or through persons employed therefor or through
any combination thereof, with the owners of the above described property for the acquisition of

said property by the City of Omaha for the aforesaid purposes. Upon failure to agree to
negotiation with the owner of any of the above described property for the acquisition thereof by

the City of Omaha, the City is authorized, empowered, and directed, through the Law
Department, to proceed forthwith to acquire such property not obtained by negotiation, by
proceedings in accordance with the laws of the State of Nebraska, under the power of eminent
domain. Any notice or notices in the name of the City of Omaha required to be given the owners
or other persons having any interest in and to any of the above described property may be given
by the Law Department of the City of Omaha. Funding shall be payable from FY2000
Community Development Block Grant, Fund 193, Agency 200, Organization 8325.
Section 3. That this Ordinance, being not legislative in character, shall take effect upon
the date of its passage in accord with section 2.12 of the Omaha Municipal Code.
