Attached is an ordinance that, if passed, would continue the City's property insurance coverage
for the period of February 1, 2001 through February 1, 2004. For years the City has carried
building and content property insurance underwritten by a national insurance firm that is bid
through a local broker. This ordinance continues the relationship between AON Risk Services,
Inc. of Nebraska and Davis Insurance Agency, Inc. on a 75%/25% ratio. The City underwrites
the first $100,000 in loss through its Contingent Liability Fund. Annual appropriations cover the
insurance premiums. In addition to the ordinance, a Service and Retainer Agreement is attached
that outlines services provided by ARS/Davis.
The premium rate. from the current underwriter and low bidder, Hartford Specialty Insurance
Company is .0425 cents per $100 of reported property value per annum. This is a very
competitive bid in a hardened-market.

AN ORDNANCE to approve and ratify the procurement of insurance upon the property of the
City of Omaha pursuant to the attached Agreement, through direct placement with
brokers Aon Risk Services, Inc. and Davis Insurance Agency, Inc., involving the
payment of money from appropriations of more than one year in accordance with Section
5.17 of the Home Rule Charter of the City of Omaha, 1956, as amended; and to provide
the effective date hereof.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
Section 1. The procurement of insurance upon the property of the City of Omaha
pursuant to the attached Agreement, through direct placement with brokers Aon Risk Services,
Inc. and Davis Insurance Agency, Inc., involving the payment of money from appropriations of
more than one year in accordance with Section 5.17 of the Home Rule Charter of the City of —
Omaha, 1956, as amended, is approved and ratified; and the premiums for the same shall be paid
from Fund 001, Agency 180, Organization 1860, Object Code 2154.
Section 2. That the Mayor of the City of Omaha is authorized to execute, and the City
Clerk to attest on behalf of the City of Omaha, the Agreement between the City of Omaha and
Aon Risk Services, Inc., and Davis Insurance Agency, Inc., approved in Section 1 hereof,
attached hereto and marked Exhibit One and by this reference made a part hereof as if set forth
herein.

Section 3. This Ordinance, being not of a legislative character, shall be in full force and
take effect immediately upon passage under and by virtue of the authority granted by Section

AON RISK SERVICES, INC. OF NEBRASKA
PROPERTY INSURANCE - SERVICE AND RETAINER AGREEMENT
This will confirm that the City of Omaha("Client") wishes to engage the services of Aon Risk
Services, Inc. and Davis Insurance Agency, Inc. ("ARS/DAVIS" also referred to as "Contractor")
as its Property Insurance broker, subject to the following terms:
1. The services will be provided by ARS/DAVIS for the three consecutive one-year terms
beginning February 1, 2001 and ending February 1, 2004.
2. ARS/DAVIS will be compensated by the insurance company out of paid premiums. Property
coverage for the period February 1, 2001 to February 1, 2002 will be provided by Hartford
Specialty Insurance Company and the first year premium will be based upon a rate of .0425
per$100 of reported property values (estimated premium is $160,000 based on current policy
property values).
3. ARS/DAVIS will provide the following services relating to the City's property insurance:
a. Risk and Insurance management evaluation services (including day to day handling,
Marketing).
b. Ongoing risk management advice and consultation.
c. Claims management and supervision of the insurance carrier.
d. Claims reviews, as required, on losses reserved over$10,000.
e. One Stewardship meeting annually.
f. Detailed coverage recap of the policy schedules.
g. Other services normal and incidental to the handling of the City of Omaha's property
insurance program.

4. During the performance of this contract, the contractor agrees as follows:
a. The contractor shall not discriminate against any employee or applicant for
employment because of race, religion, color, sex, age, disability or national origin.
The contractor shall take affirmative action to ensure that applicants are employed
and the employees are treated during employment without regard to their race,
religion, color, sex or national origin. As used herein, the word "treated" shall mean
and include, without limitation, the following: recruited, whether by advertising or by
other means; compensated; selected for training, including apprenticeship; promoted;
upgraded; demoted; downgraded; transferred; laid off; and terminated. The contractor
agrees to and shall post in conspicuous places, available to employees and applicants
for employment, notices to be provided by the contracting offices setting forth the
provisions of this nondiscrimination clause.
b. The contractor shall, in all solicitations or advertisements for employees placed by or on
behalf of the contractor, state that all qualified applicants will receive consideration for
employment without regard to race, religion, color, sex, or national origin, age, disability.
c. The contractor shall send to each labor union or representative of workers with which he has
a collective bargaining agreement or other contract or understanding, a notice advising the
labor union or workers' representative of the contractor's commitments under the equal
employment opportunity clause of the city and shall post copies of the notice in conspicuous
places available to employees and applicants for employment.
d. The contractor shall furnish to the contract compliance officer all federal forms containing
the information and reports required by the federal government for federal contracts under
federal rules and regulations, including the information required by sections 10-192 to 10-
194, inclusive, and shall permit reasonable access to his records. Records accessible to the
contract compliance officer shall be those, which are related to paragraphs (a) through (g) of
this subsection. The purpose of this provision is to provide for investigation to ascertain
compliance with the program provided for herein.
e. The contractor shall take such actions with respect to any subcontractor as the city may
direct as a means of enforcing the provisions of paragraphs (a) through (g) herein, including
penalties and sanctions for noncompliance; however, in the event the contractor becomes
involved in or is threatened with litigation as the result of such directions by the city,the city
will enter into such litigation as is necessary to protect the interests of the city and to
effectuate the provisions of this division; and in case of contracts receiving federal
assistance, the contractor or the city may request the United States to enter into such
litigation to protect the interests of the United States.

f. The contractor shall file and shall cause his subcontractors, if any, to file compliance reports
with the contractor in the same form and the same extent as required by the federal
government for federal contracts under federal rules and regulations. Such compliance
reports shall be filed with the contract compliance officer. Compliance reports filed at such
times as directed shall contain information as to the employment practices, policies,
programs and statistics of the contractor and his subcontractors.
g. The contractor shall include the provisions of paragraphs (a) through (g) of this section,
"Equal employment opportunity clause." And section 10-193 in every subcontract or
purchase order so that such provisions will be binding upon each subcontractor or vendor.
5. Additional General Conditions
a. Non-discrimination. ARS/DAVIS shall not, in the performance of this Agreement,
discriminate or permit discrimination in violation of federal or sate laws or local
ordinances because of race, color, sex, age, or disability as recognized under 42 USCS
12101 et seq. And Omaha Municipal Code 13-89, political or religious opinions,
affiliations or national origin.
b. Applicable Laws. Parties tot his Agreement shall conform with all existing and
applicable city ordinances, resolutions, state laws, federal laws, and existing and
applicable rules and regulations. Nebraska law will govern the terms and the
performance under this Agreement.
c. Interest of the City. Pursuant to Section 8.05 of the home Rule Charter, no elected
official or any officer or employee of the City shall have a financial interest, direct or
indirect, in any City Agreement. Any violation of this section with the knowledge of
the person or corporation contracting with the City shall render the Agreement
voidable by the Mayor or Council.
d. Interest of the Provider. ARS/DAVIS covenants that it presently has no interest and
shall not acquire any interest, direct or indirect, which would conflict with the
performance of services required to be performed under this Agreement; it further
covenants that in the performance of this Agreement, no person having any such
interest shall be employed.
6. It is understood that this Agreement is open to review at any time by either party and may be
canceled by either party upon 120 days prior written notice.
