and Members of the City Council,
Transmitted herewith is a resolution granting permission to Sanitary
and Improvement District No. 188 to construct PRIVATE PAVING
NO. 580 located in Fieldcrest Drive from Harney Parkway south
to 1100 feet south and east in Fieldcrest Drive.
This paving is OUTSIDE the City Limits of the City of Omaha and
within the limits of said Sanitary and Improvement District.
Maintenance of the paving is the responsibility of the Permittee
until the area is annexed by the City. The paving is to be constructed
at the entire cost and expense of the Permittee and in accordance
with the plans approved by the Public Works Department.
The one per cent (1%) administrative fee of $700 .00 , based on
the engineer' s estimated construction cost, has been paid by
the Permittee on June 5 , 1972 .
The City of Omaha will be liable for any indebtedness of the District
if the City annexes the District in its entirety. The resolution pro-
vides that the special assessment schedule for financing this paving
construction shall be in accordance with the City of Omaha' s policy on
paving construction special assessment. All assessment schedules shall
be approved by the Public Works Department before levy.
The Public Works Department recommends your consideration and approval
of this resolution.

STATEMENT OF CONDITIONS FOR PRIVATE PAVING
1 . Construction of the paving shall be started within one year from the date
of resolution.
2. All work and material shall conform to the Standard Specifications for
Street and Sewer Construction, 1969 Series of the City of Omaha, and any
additions thereto or modification thereof.
3. Construction inspection shall be performed by a City Inspector or a
competent inspector granted permission to perform said duties, from the
Public Works Department. If the construction inspection is to be performed
by an inspector other than a City Inspector, upon completion a Certificate
of Compliance shall be submitted by a 'Regisitered Professional Engineer. of
the State of Nebraska. If the Permittee requests the City to perform said
inspection, the Permittee shall be required to pay the inspection cost at
the rate of 2.5 times actual payroll cost plus mileage and other miscellaneous
expenses. The City Construction Engineer shall be notified 48 hours before
the time an inspection will be required.
4. The Permittee shall conform with the rules and regulations specified in
the Application.

The Permittee shall conform with all plans, specifications, grade and
alignment approved by the Public Works Department; shall pay the entire
cost thereof and the costs of engineering, testing and inspection; and
shall furnish a Performance, Payment and Maintenance Bond of said Permittee
or of Contractor, who is to do the construction work, on the form supplied
by the Public Works Department, said Bond, in part, to be in the same
amount as the total cost of construction and to include, in part, a main-
tenance provision in conformance with Specifications.
6. A duly executed Contract between Permittee and Contractor for the construct-
ion of the paving, together with executed Bond pertaining to said Contract
if Bond is furnished to Permittee with said Contract, shall be filed with
the Public Works Department and said Contract shall , in part, show the unit
cost and the total cost.
7. Permittee is owner of 100% of the abutting property or has obtained duly
executed Waivers of Damages from other owners of the abutting property, which
waivers shall be filed with said Application.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, Sanitary and Improvement District No. 188, herein-
after called Permittee, has requested authority to construct PRIVATE
PAVING NO. 580 located outside the City Limits in Fieldcrest Drive
from Harney Parkway south to 1100 feet south and east in Fieldcrest
Drive; and,
WHEREAS, the Permittee has paid the one per cent (1%)
administrative fee of $700.00, based on the Engineer's Estimate;
and
WHEREAS, plans have been approved by the Public Works
Department; and,
WHEREAS, the lands to be included in the Private Paving
District consist of Lots 155-82 and 155-83, all in Regency townhomes ,
Second Addition, as surveyed, platted and recorded in Douglas
County.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF OMAHA:
THAT, the aforedescribed lands be, and they hereby are,
created as a Private Paving District for the purpose of assessing
costs ; and,
THAT, the Permittee be granted permission to construct
said Private Paving No. 580 in accordance with the approved plans
at the entire cost and expense of the Permittee; and,
THAT, the Permittee shall be responsible for the care
and maintenance of the paving until the area is annexed to the
City of Omaha; and,
THAT, for the purpose of covering the cost of the improve-
ment and the costs incident thereto including the costs of inspection,
supervision, administration, acquisition of land, grading, filling,
street repairs incidental to such improvement, the Permittee shall
properly levy special assessments to cover the cost of the improve-
ment herein on all lots, parts of lots , land and real estate specially
benefited by such improvement or within the District created for
the purpose of making such improvement to the extent of the benefits

to such lots, parts of lots , lands and real estate by reason of
such improvements. Such assessments shall be levied in conformance
with the current policies and procedures of the City of Omaha.
All assessments shall be approved by the Public Works Department
before levy; and,
THAT, upon compliance with all applicable requirements
and laws by Permittee, the Public Works Department shall issue
a letter authorizing commencement of the construction by Permittee' s
Contractor; and,
THAT, the City Clerk be and hereby is directed, if requested,
to mail a copy of this resolution to Robert L. Mierendorf, Clerk,
10050 Regency Circle, Omaha, Nebraska 68124; and,
PROVIDED THAT, the provisions of the "Statement of Conditions
for Private Paving" , copy of which is attached hereto and made
a part hereof, are complied with, otherwise this resolution to
be void and of no effect.
