Dear Mr. Brown:
You will recall I represent Otis Glebe. By an order of December 13, 2001, Chief
Housing Inspector Kevin Denker ordered the removal of the fence Mr. Glebe has recently
built within the appropriate set-backs on his property.
We disagree with the order and would like the matter considered in its entirety by the
City Council. Please consider this the Notice of Appeal. Mr. Glebe has furnished the
cash appeal bond. Because the issue here is whether the fence should be removed (as
opposed to whether a structure should be demolished pending improvements) a work.

Remarks: On June 6, 2001 inspector Joe Waszgis received a complaint regarding a non-code fence. A
first notice was mailed to the owner on June 8, 2001.
A reinspection was mde on September 14, 2001 for the hearing on September 20, 2001. There was no
appearance by the owner. The hearing was laid over until November 8, 2001.
At the hearing on November 8, 2001 the owner and the owner's attorney, Martin Cannon appeared. The
fence was laid over until 12-13-01.
At the hearing on December 13,2001 the owner and owner's attorney, Martin Cannon, appeared. The
fence was condemned.
The owner must comply with Section 55-766. Industrial Uses. See attached Section.
The owner took out a permit to build the a 8 foot solid metal fence on 4-12-01. Please note that the
owner built a 12' metal and wood fence. The owner also applied for certificate of occupancy on June 12,
2001, but was not issued.

Municipal Code including Section 16-81 through 16-120 for Automotive Salvage
Businesses, or Sections 30-81 through 30-110 for Junk Dealers.
(2) Screening:The perimeter of each facility shall be fully enclosed by opaque freestanding
fencing or screen walls. Minimum height of this enclosure shall be eight(8)feet,and
maximum height shall be ten(10)feet.Construction shall be of a material approved by the
Planning Director. Any such endosure shall be installed behind landscaped buffer yards
required by Section 55-716,`Buffer yard Provision?.
(3) Separation:No scrap or salvage use may be established within three hundred(300)feet of
the nearest property line of an agricultural,residential or office zoning district.
