I received a letter indicating the above property has been declared a nuisance and
condemned. I acknowledge that the city and it's inspectors and planning department
f,'' co have been very patient with One Way Ministry National Community Outreach and One
o Way Ministry Apostles' Doctrine Church's project. It was and still is our goal to convert
6 this duplex into a Community Center and sanctuary for church services. It has been a
long and difficult task. The financing for the initial purchase was done personally by it's
cy
Director and Pastor, Michael T. and Camille Moten. This project is being carried out
strictly by donations from the members of One Way Ministry Apostles' Doctrine Church.
There are NO paid officials, officers, or members including the director and pastor.
Please understand that it is not our intention to operate outside of the rules and laws
that govern our great city and community. It is particularly against everything that we
m want to do for this community to deface a neighborhood. We have felt that in many
situations our hands were tied. I am appealing this decision based on the following:
z In a meeting with city inspectors at the job site we were asked to complete the
eoutside of the building within a certain amount of time. At the end of that time we were
E given an extension until June and the outside of the building is complete.
0 - During that same meeting we were informed by the inspectors that there were
some structural things that had to be done concerning the ceiling joists before further
work on the interior could be done.
The builders informed us that they called and requested an inspector to view the
structural work which had to be done on the ceiling joists and the outside of the building
prior to June 14 with a request for further instructions if needed. They assured us that ik
"Jay" had approved everything.
Your notice that the building is not suitable for occupancy is confusing to us. It is
obvious that the interior of the building is still under construction awaiting approval from

Remarks: This property was initially inspected on April 22, 1998 by inspector Scott Benson. A first
notice of violation was sent to the owner on May 15, 1998 giving the owner until August 17, 1998 to make
repairs. No repairs were made and the owner was assessed the$340.00 inspection fee.
A condemnation hearing was held on August 20, 1998 and the hearing was laid over until 10-29-98.
A second notice of violation was mailed to the owner on August 24, 1998 giving the owner until
September 28,_1998 to make repairs. No repairs were made and the owner was assessed the second
$340.00 inspection fee.
At the condemnation hearing held on October 29, 1998 the property was laid over until February 25,
1999.
The hearing on February 25, 1999 the structure was vacant, open and vandalized so the property was
condemned as a nuisance to the neighborhood. The owner appealed the condemnation to the City
Council on March 18, 1999 and at the council meeting on.March 30, 1999 the council sustained the
condemnation.
During this time the owner tried to make repairs to the structure. On January 8, 2001 Gary Bengtson
requested that a hearing be rescheduled. A hearing was set for February 15, 2001.

At the condemnation hearing on February 15, 2001 the owner appeared. He was informed to get a new
permit that he needed to have P& I inspection the new roof trusses and new siding was being applied.
The hearing was laid over until April 26, 2001.
At the hearing on April 26,2001 the owner appeared. The owner still did not take out any permit,the
eaves were being built and still had not made the changes that the Chief Building Inspector requested of
him. The owner was informed again to take a building permit and to take care of the structural issues.
The hearing was laid over until June 14,2001.
At the hearing on June 14,2001 the owner appeared. Again,there were no permits, no changes to the
structural roof rafters. The duplex was condemned.

WHEREAS, said appeal complies with the requirements as set forth in Section 43-38 Appeal Procedure
of Division 4 of Unsafe Buildings of General Ordinance of the City of Omaha, passed June 27, 1995 as
amended; and,
WHEREAS, the City Clerk of the City of Omaha as directed by Section 43-3.8 Appeal Procedure of

ceiling.

and finish.
We will spray ceiling with acoustic spray to help sound levels
We will paint walls and ceilings to colors of choice by church.
We will install doors and trim and stain and finish.
We will install commercial grade carpeting through out building and sanctuary except for rest
rooms will be VCT. Tiles. All rooms to have vynal base. Kitchen to have VCT.
The bid includes new cabinets in kitchen area and countertops. New stove,sink and refrigerator
All doors and cabinets to be oak.
The bid includes new vanities and fixtures in the rest rooms and grab bars.
The bid includes all electrical and plumbing work as needed.
The bid includes new furnace and A/C from prints.
The only item not included in this bid is the fixed seating in the sanctuary.
We propose to furnish labor and materials, complete in accordance with the above
specifications,for the sum of: 78,930.00 with payment to be made as follows: Payment
schedule will be set up to pay upon completion of job requirements of the project.
All material is guaranteed to be as specified. All work to be completed in a workmanlike manner
according to standard practices. Any alteration or deviation from the above specifications
involving extra costs,will be executed only upon written orders, and will become an extra
charge over and above this proposal. This proposal is subject to acceptance within thirty(30)

loan on the church property and the remodeling to be done by your company, based on

Our loan will fund after all work is complete and the city of Omaha has issued an
Occupancy Certificate and removed the property from its Condemnation List.
This loan commitment is conditioned upon no material adverse changes to the financial
condition of The Moten's or the One Way Ministry Church.
