I do not agree and plan on objecting to the return of our bid for insufficient bid security for"Lease of 200
Computers for the Omaha Public Library".We are based in Omaha,Nebraska and do business in almost all
states and the bid process for the 200 computers has been anything but smooth from the City of Omaha's
perspective.
Our area of expertise is in the area of true fair market value leases,which means the city would pay a very
low monthly or annual payment,with the option of returning the equipment at the end of the lease. We are
set up to handle these types of leases and organizations such as(NHS)Nebraska Health Systems utilize our
services.The city library has expressed an interest in this type of lease,and we educated them on the pros
and cons of this type of lease. The shipping at end of lease alone can cost$1001pc. Have you considered tax
ramifications,etc:
We received the bid and filled out the bid,even though the request was missing many items or erroneous
information was included.We sent in a CERTIFIED CHECK FOR$I0,420.40.Mr.John Lemming
indicated they had"jumped the gun"and the bid request was inaccurate.Quote"We have never done one
of these Fair Market Value requests before". Mistakes were made.Both Mike and I"heard"Mr.Lemming
say they were going to ask for$7,000.00 flat as some of the vendors provided abid bond based on payment
amount and was"confusing".
I find it very ironic that the City makes many"mistakes"in this bid request and the 2"time around we
included the$7,000.00 we heard him say and we get no 2nd chances,when everybody else did. Why would
we include$10,420.40 the first time around and short-change it the second?
Under the fair market value solution we were$500 higher over 3 years than Compaq,but since we are
local,if we said%2 of normal shipping costs of$100,we would still save the city$10,000 alone in this area.
Also,how does one lessor have a lower interest rate,but a higher payment? I feel there arc many issues in
this bid.
I would appreciate so clarification.

Omaha Public Library Bid Request
Omaha Public Library Computer Lease and appeal for rejection of bid regarding 200 leased computers.
Goal: The ultimate goal is to ensure that the City of Omaha and the Omaha Public Library get the best solution
to their needs and the most cost effective rate to the taxpayers.
I'm here today because I don't feel the goal was met with the bid process. We have a bid title for 200
computers, yet the bid specified only 185 computers. My main question is, "What was bid on?" This question
alone should be cause for a re-bid. There has been no clear definition of what you consider a Standard Taxes
lease-to be. These are just a few of the issues that I will discuss today.
P & L Capital is an Omaha based computer lessor that provides Fair Market Value (FMV) leases to Hospitals,
Banks, Credit Unions, non-profits, and many other types of institutions in almost every state. I only mention
this because we are not a generalist and only provide lease solutions to institutions looking for one kind of a
lease. That lease is a Fair Market Value lease, or as many companies refer to as, Technology Refresh Lease.
There are many complexities to a Fair Market Value lease, which includes, taxes, end of lease options, disposal
options, renewal options, and many more complex issues.
The only reason P & L bid this opportunity is that we spent a fair amount of time with the library. Based on our
discussions and understanding the library's goals, it was determined that the library had a need for a Fair
Market Value lease. A technology refresh lease every 3 years would:
• Save money
• Keep newer technology in the library
• Solve the issues of disposal
• Continued maintenance costs of older technology
We received a request of bid and bid sheet on or around May 29th, due back on June 19, 2002. We called and
said, "How can we bid the lease financing when you have not selected the vendor or computer configurations?" .
It is very difficult to bid leasing with no figures. So they sent the bid back out on July 3rd to the vendors to select
the computers and vendor. Please see exhibit"A" and"B".
We then received a new bid request for 200 computers and copies were included of the winning bid for the
computers, but only 185 computers were listed (exhibit"C" and"D). There were 5 different computer
configurations and 5 different prices. Only after talking to the vendor could we figure out which configuration
15 more computers were added to. We completed the bid process and provided a bid bond of$10,420.40
(exhibit"E")that represents 5% of the total, which is $208,408.

The bid request was very incomplete. Many of the questions had nothing to do with a Fair Market Value lease. I
personally called Mr. John Lemming and told him the questions that were on the bid were regarding tax-exempt
municipal leases and are impossible to be part of a Fair Market Value lease\Operating lease. His comment was
"yes I know now, and we jumped the gun. This was never reviewed by legal, and even if the library wants to do
a Fair Market Value lease, I don't know if we even can?"He also said "We are sending back and asking for
both bids." I indicated we don't do tax-exempt municipal leases, but would provide a rate based on selling to
somebody that does, and our initial Fair Market Value Lease would stand. At which POINT he says, "yea,
everybody is confused and we had some lessors provide a bid bond on payment amount and some on the 185
computers. So we are sending back the bid bond and going to ask for a flat$7,000 bid bond." I actually
objected at that point and said this is black and white.
We then got another request (exhibit"F")that required another bid bond and a lease for a Standard Taxes
Lease. In my 21 years in the computer industry and leasing industry I can honestly say I have never heard of a
Standard Taxes Lease. I assumed he meant Fair Market Value, but at that point, I wasn't sure. Does anyone
really know what the requirements are? There wasn't even a new request or place to provide your answers. At
this point, there are still 185 computers and associated costs.
Recommendation: As you can see, I am not sure if the library yet has what they need to make a sound
decision. Due to the mass confusion, my recommendation is to put a new document together that specifically
spells out exactly what it is you need and open the bid process back up. It's the only right thing to do for the
Omaha Public Library.
