RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, the Nebraska Liquor Control Act provides for certain conditions and restrictions on
retail liquor licenses and sets forth provisions for the renewal and continued maintenance of retail licenses;
and,
WHEREAS, the Liquor Control Act provides that a liquor licensee may renew and continue to
operate under its liquor license only if the licensee remains qualified to receive a license, the premises remains
the same, and the premises remains suitable for the purpose for which the license is issued; and,
WHEREAS, the Liquor Control Act, NEB. REv. STAT. § 53-135, directs that the Nebraska Liquor
Control Commission shall require a licensee to submit a formal renewal application and establish its continuing
qualifications if requested in writing by the appropriate local governing body; and,
WHEREAS, Throwback Empire, LLC, holds a Class 'C' liquor license issued for the 2022 - 2023
licensing year and is doing business as "Throwback Arcade Lounge" at 1402 Howard Street in Omaha,
Nebraska; and,
WHEREAS, this City Council wishes to consider whether Throwback Empire, LLC, remains
qualified to receive a liquor license and whether the licensed premises remains suitable for the purposes for
which the license was issued.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
THAT, the Nebraska Liquor Control Commission is hereby requested to require Throwback
Empire, LLC, dba "Throwback Arcade Lounge" at 1402 Howard Street in Omaha, Nebraska, to submit a formal
application pursuant to the provisions of NEB. REV. STAT. § 53-135.
