GENERAL INFORMATION: Purpose: To subdivide 35.12 acres into four lots and two outlots and to rezone to allow for mixed uses. Existing Use(s): Undeveloped Existing Zoning: DR, AG-ACI-4(PL), MU-ACI-4(PL) Adjacent Land Use(s): Adjacent Zoning: North: Vacant (office commercial anticipated) North: AG-ACI-4(PL) South: Open space (park) South: DR, R6-PUD East: Single family and multifamily residential East: R4, R6 West: Vacant (office commercial anticipated) West: AG, AG-ACI-4(PL) Future Land Use Designation(s): Low Density Residential, within a Community (80 Acre) Mixed Use Area Applicable Regulations: If approved, development of the site will be subject to the approved Mixed Use Development Agreement (as amended), as well as all other applicable regulations. No building permits will be issued based on a site plan that does not comply with the provisions of the Zoning Ordinance. II. SPECIAL INFORMATION: Site Characteristics: The site is comprised of 35.12 undeveloped acres in one lot and two outlots located in west Omaha, which is included as a part of the Avenue One Mixed Use Development. Development Proposal: Submitted plans show a total of four lots and two outlots proposed, along with an amendment to the Mixed Use Development Plan for Avenue One. The proposed subdivision will relocate Harney Street further north on this site from its initially approved location. The accompanying Major Amendment to the Mixed Use Development Plan for Avenue One accounts for the relocated Harney Street, and includes existing AG and DR-zoned properties. Lots 1, 3, and 4 will be developed with multifamily residential. Case Number: C10-16-287, C12-21-337 AVENUE ONE REPLAT 2 Page 2 RML Lot 2 is shown developed with a civic use (religious assembly). The proposed outlots will serve as stormwater retention and open space, including a proposed trail connection to the single family residential neighborhood to the east. Public Improvements: Receive preliminary approval of the Post Construction Stormwater Management Plan (PCSMP) from Public Works prior to forwarding the subdivision agreement to City Council. Upload the drainage study and preliminary plans to Permix. Grading and Drainage: The development must comply with all stormwater management ordinances and policies, including no net increase in stormwater runoff and treatment of the first half inch of stormwater for water quality. Utilities: OPPD has high voltage transmission lines that run along the east and south edges of the development. Coordinate any grading, construction, or vegetation management plans proposed near these lines with OPPD. Water, gas, and electricity will be provided as required by Chapter 53, Subdivisions, of the Omaha Municipal Code. Parks and Open Space: Provide a trail connection from the development to the existing Grove Park. Environmental: Provide for the use, ownership, and maintenance of the outlots in the subdivision agreement. Land Use and Planning: Mixed Use Plans: The church building on Lot 2 meets the build-to/setback provisions outlined in Section 55-925. The townhomes proposed on Lots 3 and 4 generally meet building placement and orientation requirements. However, a detailed review of the townhomes will occur during review of building permits. Provide an entrance or other pedestrian-oriented feature facing the right-of- way on the west end of the northern building on Lot 4. The proposed two access points on Lot 4 do not comply with Section 55- 930(b)(8) and is not appropriate given the size of the lot. Remove one of the approaches to Lot 4. If necessary, alter/remove the southern parking lot from plans and pursue options for on-street parking to provide additional parking options for the development. Coordinate with Planning and Public Works to revise the Mixed Use Development plan to provide an acceptable access location for Lot 3. Street trees required by Section 55-924 on both sides of Harney Street must be planted as a part of any building permit for Lots 2 and 3. The proposed reduction in bufferyard is appropriate contingent upon the provision of one tree planting per every 500 square feet of the Code required bufferyard depth. Case Number: C10-16-287, C12-21-337 AVENUE ONE REPLAT 2 Page 3 RML Revise language in the associated Mixed Use Development Plan as follows: • Jasper Stone 192nd and Dodge, LLC currently owns the existing lot, so Gracehill Church does not need to be included on the amendment. If they are included, they should be identified as “Developer” in the first paragraph. • Revise the second paragraph to reference the previous amendment to the original development agreement. • Revise language referencing lots effected by this amendment to include Outlots A and B, as the associated plat alters the lot lines for these Outlots. • Revise the Agreement to provide one set of signatures for the Mayor, Assistant City Attorney, and City Clerk. III. ANALYSIS: Conditionally, the proposed subdivision and rezoning meets the intent of the Omaha Master Plan and the requirements of Chapters 53, Subdivisions and 55, Zoning of the Omaha Municipal Code. Continue to coordinate with the Planning Department on submittal of acceptable final Mixed Use Development Plans prior to forwarding the Final Plat and Major Amendment to City Council. IV. RECOMMENDATIONS: Approval of the rezoning from AG, DR, and MU to DR and MU. Approval of the Major Amendment to the Mixed Use Development Agreement for Avenue One, subject to providing acceptable final Mixed Use development plans prior to forwarding this request to City Council. Approval of the Preliminary Plat, subject to meeting the following conditions: 1. Receive preliminary approval of the Post Construction Stormwater Management Plan (PCSMP) from Public Works prior to forwarding the subdivision agreement to City Council. Upload the drainage study and preliminary plans to Permix. 2. Comply with all stormwater management ordinances and policies, including no net increase in stormwater runoff and treatment of the first half inch of stormwater for water quality. 3. Coordinate any grading, construction, or vegetation management plans proposed near the existing high voltage transmission lines with OPPD. 4. Provide a trail connection from the development to the existing Grove Park. 5. Provide for the use, ownership, and maintenance of the outlots in the subdivision agreement. Approval of the Final Plat, subject to the conditions of Preliminary Plat approval and submittal of an acceptable final subdivision agreement prior to forwarding to City Council. V.
