And Members of the City Council,
The attached Resolution approves Sanitary and Improvement District No. 439, West Bay Woods,
Northwest of 180th and F Street, to acquire Lot 42, as a public park.
The subdivision agreement, dated October 23, 2001, outlines the public improvements within the
West Bay Woods subdivision. The purchase of Lot 42, containing 1.875 acres was included in
that agreement. The attorney for the District has requested a separate resolution approving the
park site acquisition costs so that the hearing can be published. The value of the park site is
$60,000.00, and with soft costs estimated to be $12,000.00, the total general obligation of the
District will be $72,000.00.
All appropriate City approvals have been obtained for this acquisition.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, the City Council of the City of Omaha approved a subdivision
agreement dated October 23, 2001 between the City of Omaha and Sanitary and Improvement
District (S.I.D.) No. 439, West Bay Woods, northwest of 180th and F Streets, Douglas County,
Nebraska,; and,
WHEREAS, said agreement provides for the construction and maintenance of
various public improvements, including streets, sidewalks, sewer systems and the provision of
utilities; and,
WHEREAS, in addition, the agreement also provides that the Sanitary and
Improvement District shall purchase Lot 42 from the developer, said lot being a tract of land
consisting of approximately 1.875 acres, which land is to be purchased and used as a public park;
and,
WHEREAS, the value of the park site is $60,000.00 and with soft costs of
$12,000.00, the total cost to the District will be $72,000.00; and,
WHEREAS, the park site acquisition costs will be a general obligation of said
District.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, the acquisition of Lot 42 of the West Bay Woods Subdivision, northwest
of 180th and F Streets, by Sanitary and Improvement District 439 of Douglas County, Nebraska,
for a public park, is hereby approved and that the total cost of$72,000.00, including soft costs,
shall become a general obligation of the District.
