Date: 02/12/2001 Re: Conditional Use Permit,38th and California Duchesne Academy Property, Former Nebraska College of Business Building Duchesne Academy sits on a two-block campus-running from 36w Street on the East to 38th Street on the West and from Burt Street on the North to California Street on the South, on the Southwest Corner of the campus rests a three-story building formerly occupied by the Nebraska College of Business. This building is sometimes referenced as the "Foxley Building". This building has been vacant since approximately 1998. Duchesne Academy has entered into a Purchase Agreement to sell the property with California Housing, L.L.C. This three level building has approximately 10,000 square feet on each level plus a similar sized level below grade would be converted into 55 units of "Assisted Living" for seniors. There has been much written about the baby boomers moving through the economic cycle with relationship to their purchasing power. There'is now interest being given to that same demographic with respect to their retirement needs. It has been estimated that there will be four times as many beds required to service this population when they reach retirement age. This would include acute beds at nursing home as well as assisted living beds. The majority of developers are bringing forth facilities today to accommodate the "private pay" senior. There is a dramatic shortage of beds at this time and projected into the future for those seniors who cannot afford the private pay facility. California Housing, L.L.C. plans to construct this facility and make eligible all 55 units for Medicaid Voucher seniors. Private pay seniors would also be welcome. In discussing this with Mr. Bob Seiffert at the State Department of Human Resources, it was his opinion that this location would be a top candidate location for the voucher seniors. The project overlooks the Duchesne Soccer Field, is on the bus line, two blocks north of Dodge and in walking distance to St. Cecilia's Cathedral and Creighton University. Creighton University has also stated that they would consider rotating their student nurses through the facility and Duchesne Academy would consider directing their students for community service hours into the facility. It appears to be a good re-use situation for the neighborhood and for seniors. The zoning requirement for parking is one space per two residents plus appropriate number for staff and visitors. That has been taken into consideration in the preliminary site plan. We 1 A feel that the parking is ample and that no changes in the existing parking configuration will be needed. The assisted living center will offer 3 meals per day, 7 days-per week as well as support staff on duty 24-hours each day. Assistance with medications and bathing is available to all residents. There is a social director assigned to the facility for recreation purposes, as well as a shuttle van to take residents to different activities and appointments that they have. The number of employees at any one shift varies but it is not anticipated to have over eight employees at any one-shift load. In visiting with the neighborhood associations there has been concern raised that because the facility would take Medicaid senior applicants, the facility could fill with seniors that have mental illness and/or drug dependencies. That is simply not the case. There will be a registered nurse on staff that does intake assessments for each applicant. The assessment is lengthy and it is intended to determine whether the applicant is a candidate for flight and/or has needs above and beyond the facilities licensure. No facility is required to take any applicant that does not meet the stated criteria of the facility. Since there is a huge backlog of seniors awaiting Medicaid•Voucher beds it is not anticipated that any candidate coming into this facility will have the maladies that have been expressed as concerns by the neighborhood association. The following is some information concerning 1. Planning Department Recommendation. The Planning Department,prior to the May 2,2001 Planning Board meeting, recommended approval of the project subject to certain conditions which are acceptable to the applicant. 2. Planning Board Recommendation. At the May 3, 2001 Omaha City Planning Board pubic hearing,the Planning Board recommended approval of the Special Use Permit to allow the assisted living project subject to three items which are acceptable to the applicant. 3. Neighborhood Support. The developer met with the Gifford Park Neig boo ood d Association rt cation and project, d the Joslyn Castel Neighborhood Association,and both of these associationsthe applicant held an open sed upon certain conditions which are acceptable'to the applicant. In addition, house for the neighbors at the St. Joseph assisted living project at0thand Dtorcas asre Siew of the treet, which pro is a dependent assisted living project in which one of the applicants isinvolved, On March 28, 2001 Duchesne Academy held a neighborhood hh Duchesne explored over the pasteeting at which Sheila Hag.gas, the Duchesne Principal, explained the various uses for the building ` several years since the building was vacated by the Nebraska College of Business in 1996. The meeting y 7 f was attended by more than 50 neighbors with input from both opponents and proponents. Sheila Haggas explained Duchesne's support of the project and stated that Duchesne viewed the assisted living'project as an asset which would be consistent with the mission of the school. She explained that Duchesne students can volunteer at the assisted living center and that the residents of the assisted living could enjoy activities on the campus. A neighborhood petition in support of the project was circulated by a Mr. Terry Wildering of 621 North 36th Street, Omaha, Nebraska. Mr. Wildering obtained in excess of 86 signatures from neighbors in support of the project. A copy of the petition and a list of typed names who signed the petition is attached hereto. I am also enclosing an editorial from the neighborhood paper in support of the project. 5. Prior Use. The building is an approximately 30,000 square foot classroom building with an additional 10,000 square feet in the lower level. The Nebraska College of Business occupied the building from 1978 through June, 1996. Linda Smith,registrar of the Nebraska College of Business,informed the applicant that at the time of leaving this site there were approximately 480 students at the Nebraska College of Business, half in the day school and half in the night school. Linda Smith estimates that approximately 75% of the Nebraska College of Business students drove. The building can still be used for this use. Obviously, this type of use creates a much larger parking and traffic demand than the proposed assisted living. 6. Project Opposition. From reviewing the letters submitted to the City Planning Department, there appears to be three general areas of objections by some persons within the neighborhood. Those objections are: (a) parking/traffic; (b) failure of assisted living use and conversion to an adverse use; and (c) the assisted living use is not appropriate. (a) Parking/Traffic Objections. Of all possible uses,a dependent assisted living protis one use that creates little additional traffic and parking demands. As the St. Joseph Assisted Living at 10th and Dorcas, the management company reported that out of the existing 31 residents,only 1 resident has a vehicle in the parking lot,and she is not utilizing that vehicle. The applicant also contacted the Crown Villa,Southview Heights,Immanuel Village,Maple Rose Estates and Si lvercrest vercrest assisted living centers in Omaha. Among these operations there are 273 residents,whose average age is 81 years plus. The number of cars utilized cumulatively by all the residents was 10, or 1 in 27. It is anticipated tat there there would be only one or two residents with vehicles in the parking lo t. In addition, would be parking for the staff members and for guests. (b) Conversion To An Adverse Use. Several neighbors objected that either the operation would not be as represented or if the assisted living operation failed the assisted living building would be converted to an adverse use. The applicant has agreed to the six conditions requested by the Gifford Park Neighborhood Association, has agreed to a maximum of 55 units and 55 residents,has agreed to limit the age of patients to 60 years old and older and is also agreeable to incorporate other reasonable conditions suggested by the neighborhood into the special use permit and/or covenants running to the neighborhood and Duchesne Academy to insure that this facility remains a properly operated dependent assisted living facility. The applicant has and continues to be agreeable to meeting with the neighbors to develop the appropriate protections for the neighborhood. The applicant believes that sufficient safeguards can be incorporated into a Special Use Permit and covenants running to Duchesne and to the neighborhood. (c) The Assisted Living Use Is Not Appropriate. As pointed out earlier, this is a 40,000 square foot existing vacant building. The question is what is the most appropriate use that has the least amount of impact on the neighborhood. The building was previously leased by the Nebraska College of Business from 1978 through June of 1996. After the Nebraska College of Business vacated the premises, Duchesne attempted to lease the premises for approximately two years. Duchesne believes that after exploring all possible uses, and taking into consideration its mission and the effect on the neighborhood, Duchesne came to the conclusion that they believed the dependent assisted living option is the best option for the building when all circumstances are considered. The assisted living option is a very passive use, creates little additional traffic and parking,and brings elderly people into the area who will then have contact with the students at Duchesne and the neighborhood. Duchesne looks at this as a positive from the standpoint of the elderly interacting with the Duchesne students which is consistent with Duchesne's mission. The neighbors who signed support ned the su ort petition also believe the assisted living is an appropriate use. We believe this is similar to the 10`h and Dorcas St.Joseph assisted living project which has had a positive effect on that neighborhood. 7. Conclusion. The dependent assisted living creates little additional traffic and parking demands. The project is supported by Duchesne Academy,the Gifford Park Neighborhood Association,the Joslyn Castle Neighborhood Association and by the neighbors who have executed the support petition. The Planning Department, Planning Board and Landmarks Commission have recommended approval of this project. When all factors are considered as to what use is appropriate for this vacant building,we believe that this dependent assisted living use is an appropriate use. OPERATING STATEMENT DEPENDENT ASSISTED LIVING PROJECT 3636 CALIFORNIA STREET OMAHA,NEBRASKA The project consists of a 55 unit dependent assisted living project within the vacant building located at 3636 California Street, Omaha,Nebraska, which is also known as the Foxley Building. The building was utilized by the Nebraska College of Business as a business school form 1978 through 1996. The Foxley Building is a four level building consisting of approximately 10,000 square feet on each level,with three of the levels being above grade and with the lower level presently below grade. The 55 assisted living units will be located on Floors 2 through 4. Level 1 will be graded out and exposed on the east side of the building and will contain the new entry plaza and foyer, activity/living room, administration offices, mechanical room, central kitchen, and central dining room. The main entrance to the building shall be on the east side of the building. Access to Levels 2, 3 and 4, to the assisted living units, shall be by a new elevator. The 55 units shall be one bed efficiency type units from 381 square feet 520 a square feet consisting of a living area, full bath, studio bedroom, and a limited refreshment area consisting of a single sink, microwave and small refrigerator with no oven or range. There presently exists 164 parking spaces on the site, the majority of which are utilized by Duchesne • Academy High School. As part of the project, an additional.14 parking stalls shall be constructed at the east entrance of the Foxley Building for the assisted living project. The project has an agreement with Duchesne Academy to utilize the 21 parking stalls along the south border of the parking lot on a shared basis. These parking stalls are rarely used by the students of Duchesne Academy High School for school parking and are generally available. The type of housing that will be provided shall be dependent living. The project is designed to provide personal care services to frail elderly individuals. of the residents will drive. The project will be managed by a professional management company which has knowledge and experience in managing an assisted living project for dependent living. The special use permit issued by the City of Omaha shall contain the following conditions: 1. A permanent seat on the board that governs the assisted living facility for the Gifford Park Neighborhood Association. 2. A professional management company experienced in dependent assisted living who is competent and community minded will be hired to manage the facility. 3. That the seniors from the neighborhood shall have first priority to review the facility and make application to live there. 4. That the assisted living facility shall be an active member of the Assisted Living Federation of America(ALFA) and abide by the standards and requirements of membership for such organization. 5. That the assisted living facility shall be an active member of the National Center for Assisted Living (NCAL) and abide by the standards and requirements of membership for this organization. 6. That the assisted living facility shall be an active member of the Gifford Park Neighborhood Association. 7. That the assisted living project shall be limited to persons of the age of 60 years and older. 8. That no more than 55 units and no more than 55 residents shall be admitted at one time in the assisted living facility. 9. That all persons admitted to the assisted living shall be qualified as persons for dependent assisted living and that persons who did not meet the dependent assisted living criteria shall not be admitted as residents. 10. That covenants be provided to Duchesne Academy and the neighborhood associations to ensure that the assisted living.project shall be maintained and operated as a dependent assisted living project.
