The attached Resolution authorizes Sanitary and Improvement District No. 407, Southwestern
Plaza, Southeast of 144th and F Street to make public trail improvements in the total amount of
$646,168.72 including soft costs. This project consists of building the public trail along the West
Papio Creek behind the Southwest Business Plaza from Old L Street to near 144th Street. The
Sanitary and Improvement District has agreed to implement the project is two phases. The first
phase will be limited to $150,000.00 and will be completed this spring. It includes
approximately 1,000 foot of trail and a 75' prefabricated pedestrian bridge. The balance of the
project will be constructed when the District's fiscal agent and the City's Finance Department
Director agree that the District has sufficient valuation to take on the additional debt.
Bids were received on October 9, 2001 for this work and the low bid is in the amount of
$478,643.50. With soft costs, the total project cost will be $646,168.72. These improvements
are consistent with the Subdivision Agreement and with the Suburban Parks Master Plan. The
Department of Parks, Recreation and Public Property recommends your approval.

Dear Dale:
Based on verbal agreements reached between representatives of the Parks
Dept., Finance Dept. and SID 407 the following summarizes the request for
approval of this project by the City Council:
Approve the construction contract between SID 407 and Swain Construction, Inc.
for the project entitled Concrete Trail Improvement 2001 in the amount of
$478,643.50.
Approve the construction of the project in two phases. The first phase being
construction of the concrete trail from "L" Street northerly approximately 1,000
feet, including a 75' prefabricated pedestrian bridge. Expenditure by SID 407 for
phase one is to be limited to approximately $150,000.
The balance of the project may be constructed upon approval of additional
expenditures by the SID 407 fiscal agent and the City of Omaha Finance
Department.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, the City Council of the City of Omaha approved a subdivision
agreement dated June 4, 1996 between the City of Omaha and Sanitary and Improvement
District (S.I.D.) No. 407, Southwestern Plaza, Southeast of 144th and F Street, Douglas County,
Nebraska; and,
WHEREAS, said agreement provides for the construction and maintenance of'
various public improvements, including streets, sidewalks, sewer systems and the provision of
utilities; and,
WHEREAS, in addition, the agreement also provides that; the Sanitary and
Improvement District shall construct a public trail along the West Papio Creek; and,
WHEREAS, bids have been received for said trail construction and the low bid
for this work is in the amount of $478,643.50 and with soft costs the total project costs are
estimated to be $646,168.72; and,
WHEREAS, the SID has agreed to complete this work in two phases, with the
first phase to be limited to $150,000; and,
WHEREAS, the balance of the project may be constructed upon approval of
additional expenditures by the SD)407 fiscal agent and the City Finance Director; and,
WHEREAS, the trail construction costs will be a general obligation of said
District.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:

144th and F Street, is authorized to accept the bid for public trail construction, in the amount of
$478,643.50 and proceed with phase one construction which will be limited to $150,000.00. All
