Mike Fahey,Mayor Acting Public Works Director Honorable President and Members of the City Council, Transmitted herewith is a Resolution approving the acceptance of a conditional grant from the Peter Kiewit Foundation for$200,000.00. On August 21St, 2001, Ordinance No. 35687 was adopted. It concerned an Interlocal Agreement among the City of Omaha, Douglas County, and Sarpy County to construct and operate a household hazardous waste facility at 120th & "I" Streets in Omaha. This grant is to be used for this project. The major condition is to raise $157,505.00 in new cash contributions or firm written pledges between May 10, 2002 and September 30, 2003. The City and Keep Omaha Beautiful, Inc. will try to raise this amount from other grants and business contributions. If the additional money is not raised, the grant will not be forthcoming. The Public Works Department and Keep Omaha Beautiful, Inc. request your consideration and approval of the attached Resolution. Two originals of both documents are enclosed. If you wish to accept the grant, please so indicate by signing one original of this Letter of Understanding in the place provided and return it to us at your earliest convenience together with one signed original of the Grant Agreement. The second copy of each document is for your files. 1) KIND AND AMOUNT OF GRANT A challenge grant in the total amount of$200,000. 2) USE OF GRANT FUNDS To partially fund construction of a regional household hazardous waste facility to be located near 120th and I Streets in Omaha, as more fully described in the grant application. 3) SPECIAL CONDITIONS a) Grant is conditioned upon the Grantees developing the balance of funds needed to complete the project. b) Grant is also conditioned upon completion of the funding effort no later than September 30, 2003. c) Grant is also conditioned upon receipt of written certification that City of Omaha accepts total legal liability and responsibility for all operations and maintenance of the household hazardous waste facility, in perpetuity, once constructed. d) Grant is further conditioned upon Grantee providing brief written progress reports to the Peter Kiewit Foundation on or about March 31 and September 30 through project completion. These reports shall describe progress made on the fundraising effort as well as the project itself, and are in addition to the annual report requirement set forth in the attached Grant Agreement. e) Peter Kiewit Foundation funds cannot be applied toward fundraising campaign expenses, debt service or endowment. f) Grantee shall submit simple interior and exterior photographs of the completed facility to the Peter Kiewit Foundation when requesting disbursement. 4) MATCHING FUNDS a) Funds available for the project, as disclosed in the grant application ($842,495), will be recognized as a partial qualified match. Page Two September 27, 2002 4) MATCHING FUNDS —Continued b) Grantee shall develop the balance of funds needed to complete the project (at least $157,505) in new cash contributions or firm written pledges between the dates of May 10, 2002, and September 30, 2003, to satisfy Items Three (a) and (b), above. c) Grantee shall furnish to the Peter Kiewit Foundation a written listing of all such donations and pledges, their sources, amounts and dates paid or payable, no later than October 15, 2003. d) In-kind contributions, or their assessed dollar value, will not be recognized as qualified matching funds without the prior written consent of the Peter Kiewit Foundation. 5) DISBURSEMENT OF GRANT FUNDS Following satisfaction of the terms and conditions set forth in Items Three and Four above, grant funds will be disbursed within 15 days following receipt of written certification from the project architect/engineer that the facility is 100 percent complete and available for its intended use. 6) GRANTOR'S OBLIGATION It is understood and agreed that the maximum obligation of the Peter Kiewit Foundation under the terms and conditions of this grant is $200,000. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT, the City agrees to accept a conditional grant from the Peter Kiewit Foundation in the amount of$200,000.00 to fund a household hazardous waste facility at 120th& "I" Streets in Omaha.
