Subject: Final Plat approval of CAPRIANA, a subdivision inside city limits, with rezoning
from AG to R5 and R6.
West of 210th and Emmet Streets
Case # C10-22-005, C12-22-007
The Preliminary Plat of CAPRIANA, a subdivision inside city limits, with rezoning from AG to R5
and R6, was recommended for approval by the Planning Board on January 5, 2022 and
subsequently approved by the City Council on February 5, 2022. An associated PUD-Planned
Unit Development Overlay District was also recommended for approval by the Planning Board
on January 5, 2022 and will accompany this Final Plat request when forwarded to City Council
for final action.
The applicant has submitted a Final Plat for review of the entire development. The proposed
Final Plat creates twelve lots and four outlots, which is consistent with the approved Preliminary
Plat. The conditions of approval of the Preliminary Plat are listed below (with subsequent
responses for this review included):
1. Coordinate with the Planning and Public Works Departments on the Complete
Streets Design Guide Design Checklists (The checklist has been completed and
included with this final plat application).
2. Provide a drive connection from Cleveland Street to the parking lot on the southeast
part of the site (Submitted plans show the required drive connection from Cleveland
Street to this development).
3. Provide for all improvements identified in the final approved traffic study (The
submitted traffic study concluded that both Elkhorn Drive and Emmet Street are
anticipated to handle the background traffic with the additional site traffic. Therefore,
there are no improvements outside of the construction of Emmet Street and
Cleveland Street as currently proposed in the site plan. The applicant must continue
to coordinate with City staff regarding this condition of approval, which will be
addressed in the final subdivision agreement).
4. Continue coordination with Public Works on the City’s sanitary sewer project (OPW
53696) in the vicinity of Outlot A (The applicant has indicated that coordination with
City staff has been completed regarding this condition of approval).

5. Submit the 30% design report for the sanitary sewer to the Public Works Design
Division per Section 2.14 of the City’s Wastewater Collection Systems Design
Manual (A 30% design report has been provided with this submittal).
6. Receive preliminary approval of the PCSMP from Public Works prior to the
application for final plat approval; upload the drainage study and preliminary plans to
Permix (The PCSMP has been uploaded to permix and the applicant is continuing to
coordinate approval with Public Works. The applicant must receive preliminary
approval of the PCSMP from Public Works prior to forwarding the subdivision
agreement to City Council).
7. Construct sidewalks along all public street frontages, including along Elkhorn Drive
and Cleveland Street (Sidewalk connections have been added to the development
plans, including for both Elkhorn Drive and Cleveland Street).
8. Provide a sidewalk connection from Cleveland Street to the site’s internal sidewalk
network (A sidewalk connection has been added to the development plans from
Cleveland Street to the site’s internal sidewalk network).
9. Provide sidewalk connections from Emmet Street to the site’s internal sidewalk
network on the east and west sides of Building K (Sidewalk connections from Emmet
Street to the site’s internal sidewalk network on the east and west sides of Building K
are shown on the submitted development plan).
10. Comply with all stormwater management policies and ordinances (The applicant has
indicated that this condition of approval will be adhered to and has been accounted
for within the development plans).
11. Coordinate with the Parks Department on the relocation of the existing 10’ concrete
trail crossing of Elkhorn Drive (The applicant indicates that the general trail relocation
has been coordinated with the Parks Department and is shown on the development
plans. Prior to construction, the applicant must provide final plans for the proposed
trail crossing to the Parks Department for final approval).
12. Provide for the use, ownership, and maintenance of the outlots in the subdivision
agreement (Language regarding this condition of approval has been included in the
draft subdivision agreement. This will be addressed in the final subdivision
agreement).
13. Submit an acceptable letter of approval from Douglas County for a Noxious Weed
Plan (A copy of the approved letter from Douglas County has been included with this
final plat application).
14. Submit a full wetlands delineation report with the final plat application (The submitted
wetlands report indicates 0.05 acres of wetland within the right-of-way ditch and
connecting to the unnamed tributary of the West Papillion Creek. Mitigation of
wetlands in the existing right-of-way is not required due to required street
connectivity. The jurisdictional channel located on the north part of the site will be
encapsulated in Outlot A).
15. A tree mitigation planting plan and tree schedule must be submitted, as well as a
financial guarantee for five trees at $240 per tree or $1,200 (A financial guarantee for
tree mitigation has been submitted. Five mitigation trees are to be planted in Outlot
A).
16. Construct a temporary turnaround at the termination of Cleveland Street (The
applicant indicates that with the City’s comment to provide a drive connection from
Cleveland Street to the parking lot on the southeast corner of the site, the resulting
pavement geometry provides adequate opportunity for a driver to do a three-point
turn within the right-of-way to reverse direction if desired. The applicant must

continue to coordinate with City staff regarding this condition of approval, which will
be addressed in the final subdivision agreement).
17. OPPD Electrical Service Design shall be contacted to coordinate electrical
infrastructure design for this project (The applicant indicates that coordination with
OPPD for electrical service to the apartment site and the single-family lots is
ongoing).
Based on the submitted plans, the following additional comments have been provided:
• Trails and/or open space constructed within the development that are not part of the
suburban park master plan shall be privately constructed and maintained by the
developer, HOA or other approved entity.
ANALYSIS: Conditionally, the proposed subdivision and rezoning is consistent with and carries
out the goals and objectives of the City of Omaha Master Plan.
RECOMMENDATION: Approval of the rezoning from AG to R5 and R6.
Approval of the Final Plat, subject to addressing the following items, prior to forwarding the
request to the City Council for final action:
1. Submittal of an acceptable final subdivision agreement.
2. Receive preliminary approval of the PCSMP from Public Works prior to forwarding the
subdivision agreement to City Council; upload the drainage study and preliminary plans
to Permix.

At the Planning Board meeting held March 2, 2022, this case was on the Administrative portion of the
agenda.
Mike Carter, Current Planning Manager, appeared before the Board on behalf of the Planning Department.
Mr. Carter explained that the Preliminary Plat with the rezoning and a PUD was recommended for approval
by Planning Board on January 5, 2022 and the Preliminary Plat was approved by City Council on February
5, 2022. The PUD will now accompany the Final Plat when it goes to City Council. The request will create
12 lots and four outlots and is consistent with the approved Preliminary Plat. The staff recommends
approval of the rezoning from AG to R5 and R6 and approval of the Final Plat, subject to addressing the
two items listed in the recommendation report prior to forwarding the request to City Council.
Mr. Rosacker motioned for approval of the rezoning from AG to R5 and R6, approval of the Final Plat,
subject to addressing the following items, prior to forwarding the request to the City Council for final action:
1. Submittal of an acceptable final subdivision agreement.
2. Receive preliminary approval of the PCSMP from Public Works prior to forwarding the subdivision
agreement to City Council; upload the drainage study and preliminary plans to Permix.
Mr. Morris seconded the motion which carried 7-0.
