Conditions: 1. II. SPECIAL INFORMATION:
Site
Characteristics:
The site is comprised of approximately 158 acres of rolling, large lot
residential/agricultural land located in northwest Omaha. A portion of the
site (approximately 40 acres) is located within the City of Bennington’s
extraterritorial zoning jurisdiction. The applicant has submitted concurrent
applications for subdivision approval with both jurisdictions, and must
include signature blocks for both jurisdictions on the final plat. A portion of
the site is located within the FF-Flood Fringe Overlay District and currently
serves as regional drainage for the area. This drainage is included as a
part of plans for a future dam site and is included as an outlot in this
subdivision request. Except where specifically identified, review and

recommendations for this request are limited to those portions of the
subdivision located within the City of Omaha’s jurisdiction.
Development
Proposal:
Submitted plans show subdivision of the area east and southeast of 168th
Street and Military Road into a total of 302 lots and five outlots. Western
portions of the site (Lots 1-80) are proposed for townhome development
and zoned R5 District. Outlot C will comprise a portion of the future Dam
Site 7 reservoir, while the balance of the site is located east of the reservoir
site and zoned R4 District (Lots 81-302) for single family residential use. An
additional 87 lots (Lots 303-389) and three outlots (Outlots F-H) are
proposed within the City of Bennington’s jurisdiction and anticipated to
develop with single family residential uses.
Public
Improvements:
City of Bennington: Coordinate with the City of Omaha and the City of
Bennington for a mutually acceptable agreement between the two
jurisdictions on the adjustment of the ETJ boundary. The adjustment of the
jurisdiction line between Omaha and Bennington must be more equitable.
Adjust the ETJ boundary to include Lots 304-315 within the City of
Bennington’s ETJ, and Lots 188-189, 303, 225, 226, 328, 329, 350-352,
387-388, and northern portions of Outlot E within the City of Omaha’s ETJ.

and Road 8. Coordinate the design of the trail with the Omaha Parks
Department.
Coordinate with the Parks Department and surrounding SIDs and make a
reimbursement to those SIDs for the original construction of Park 23c, or
allocate funds to expand/improve the existing Park. Any park
improvements shall be design by a registered professional landscaping
architect. Park improvements must be reviewed and approved by the Parks
Department.
Trails and/or open space constructed within the development that are not
part of the Suburban Parks Master Plan will be privately constructed and

Planning:
Future Land Use: The proposed rezoning and plat is consistent with the
Master Plan and implements the general vision and intent for this area as
outlined in the Omaha Master Plan.
III. ANALYSIS:
Conditionally, the proposed subdivision generally complies with the requirements of Chapters
53, Subdivisions and Chapter 55, Zoning of the Omaha Municipal Code.
IV. RECOMMENDATIONS:
Approval of the rezoning from AG to R4 and R5.

16. C10-22-015 C12-22-016 Graves Development Resources
REQUEST: Preliminary Plat approval of EVERGREEN, a subdivision outside city limits, with rezoning from AG to R4 and R5 (portions of the property are located within the FF-Flood Fringe Overlay District) LOCATION: Southeast of 168th and Military Road
At the Planning Board meeting held January 5, 2022, Larry Jobeun, 11440 West Center Road, appeared before the board on behalf of the applicant. Mr. Jobeun submitted an overall site plan and explained that the project is a single family subdivision on 158 acres, of which 40 acres are located in the Bennington jurisdiction. There will be a total of 302 single family lots, five outlots and 80 townhome lots and are part of the NRD dam site. On December 29, 2021 it was recommended for approval at the Bennington Planning Commission and will be before the Bennington City Council on January 10, 2022. There were no opponents.
Eric Englund, Assistant Director, appeared before the Board on behalf of the Planning Department. Mr. Englund stated that staff recommends approval of the rezoning from AG to R4 and R5 and approval of the Preliminary Plat subject to the 36 conditions in the recommendation report.
Mr. Morris motioned for approval of the rezoning from AG to R4 and R5 and approval of the Preliminary Plat, subject to the following conditions: 1. Adjust the ETJ boundary to include Lots 304-315 within the City of Bennington’s ETJ; and include Lots 188-189, 303, 225, 226, 328, 329, 350-352, 387-388, and northern portions of Outlot E within the City of Omaha’s ETJ. A mutually acceptable interlocal agreement must accompany the Final Plat to City Council. 2. Continue to coordinate with the NRD on the boundaries of Outlot C and provide concurrence that there is no adverse impact of this layout on Dam Site 7. 3. Revise the lot and street layout east of Road 1 and HWS Cleveland Boulevard to eliminate the double-frontage lots. 4. Revise the street design to eliminate the skew at the intersections of 1) Road 3 and Rachel Snowden Parkway, and 2) Road 1 and HWS Cleveland Boulevard. 5. Coordinate with the Planning and Public Works Departments to provide an acceptable street layout in southeast portion of the site, to eliminate one or both cul-de-sacs, and to relocate/add stub streets. 6. In the vicinity of Lots 92-96, add an outlot to connect Road 1 with Outlot C, and construct a sidewalk connection between Road 1 and the future NRD trail. 7. Confirm that all drainageways are placed in an outlot sized to accommodate either the 3:1 + 20 foot section, or the 100-year storm flow, whichever is greater. 8. Dedicate an additional 10 feet of right-of-way along both Rainwood Road and 168th Street, for the first 300 feet from the intersection. 9. Provide for the improvement of Rainwood Road along the subdivision’s frontage. Enter into an interlocal agreement with Douglas County. 10. Provide for the improvement of 168th Street to three lanes along the subdivision’s frontage, and for the improvement of Rainwood Road to three lanes between 168th Street and Road 9. 11. On the Road 1 approach to Rainwood Road, provide one 16-foot inbound lane, a 4-foot paved median, and two 12-foot outbound lanes. Dedicate additional right-of-way as needed to accommodate this requirement. 12. Coordinate with Public Works on an acceptable General Obligation (GO) Paving Plan. 13. Provide traffic calming on all streets longer than 1,000 feet. 14. Coordinate with the Planning and Public Works Departments on the Complete Streets Design Guide design checklists. 15. Coordinate with the Douglas County Engineer’s office on the review, approval, and permitting of all street, grading, sewer, storm sewer, drainage, and utility designs related to the widening/improvement for 168th Street, Rainwood Road, and Military Road.
16. Coordinate with Douglas County on the ultimate profile of Rainwood Road, and grade the subdivision to match the ultimate profile. 17. Coordinate with Public Works on the acceptable placement and dimensions of the sewer easements. 18. Submit documentation to Public Works demonstrating that the downstream sewers have the capacity to accommodate the flows from the temporary lift station. 19. All costs for the construction and maintenance of the temporary lift station, force main, and temporary sewer south of the subdivision shall be private. The cost to remove the temporary lift station shall also be private. 20. In the subdivision agreement, cover the timing of the removal of the temporary lift station and the construction of outfall sewer upon the future construction of certain sewer extensions in adjacent areas. 21. Submit the 30 percent design report for the sanitary sewer to the Public Works Design Division per Section 2.14 of the City’s Wastewater Collection Systems Design Manual. 22. Grant a noise attenuation easement 115 feet from the centerline of Rainwood Road as well as 168th Street, and place the standard noise attenuation easement language on the plat. 23. Construct sidewalks along all street frontages, including the subdivision’s 168th Street and Rainwood Road frontages. 24. Place the following notes on the plat document: a. There shall be no direct access to Military Road, Rainwood Road, or 168th Street from any lots or outlots. b. Road 9 at its intersection with Rainwood Road shall be restricted to right-in/right-out only movement upon future median improvements to Rainwood Road. 25. Revise the 35-foot build-to/setback line shown along HWS Cleveland Boulevard and Rachel Snowden Parkway to a 35-foot wide “no-build easement”. 26. Receive preliminary approval of the Post Construction Stormwater Management Plan (PCSMP) from Public Works prior to submittal of a Final Plat application. Upload the drainage study and preliminary plans to Permix. 27. The development must comply with all stormwater management ordinances and policies, including no net increase in stormwater runoff and treatment of the first half inch of stormwater for water quality. 28. Provide for the use, ownership, and maintenance of the outlots in the final subdivision agreement. 29. Provide a complete wetlands analysis as a part of Final Plat application materials. 30. Rachel Snowden Parkway and HWS Cleveland Boulevard must be designed in accordance with the Surburban Parks Master Plan, including provision of acceptable sidewalks and street trees, as well as ornamental lighting on HWS Cleveland. 31. Construct a 10-foot-wide concrete trail along each side of the drainage/creek running north-south through Outlot C. The trails must be located outside the 3:1 +50’ setback to waterways. 32. In the subdivision agreement, agree to provide future modifications to the Military Road intersections at such time is Military Road in closed to vehicular traffic. 33. Include funding and make provisions for the conversion of Military Road to a ped/bike trail upon the closure of this section of the Road. 34. Coordinate with the Parks Department and surrounding SIDs and make a reimbursement to those SIDs for the original construction of Park 23c, or allocate funds to expand/improve the existing Park. 35. Trails and/or open space constructed within the development that are not part of the Suburban Parks Master Plan will be privately constructed and maintained by the developer, HOA, or other approved entity. 36. Coordinate with the City on an acceptable debt ratio. Mr. Moore seconded the motion which carried 6-0.
