GENERAL INFORMATION: Purpose: To approve a Major Amendment to the Planned Unit Redevelopment Overlay District to modify the approved development of the site with a hotel. Existing Use(s): Vacant Existing Zoning: CC-ACI-1(PL)-PUR Adjacent Land Use(s): Adjacent Zoning: North: Multifamily residential (dormitories) North: R8-ACI-1(PL)-PUR South: Office/commercial South: CC-ACI-1(PL) East: Structured parking East: GC-ACI-1(PL) West: Office/commercial West: CC-ACI-2(PL) Future Land Use Designation(s): Office commercial within a Mixed Use boundary Applicable Regulations: If approved, development of the site will be subject to the requirements of the CC District, the approved PUR, as well as all other applicable regulations. No building permits will be issued based on a site plan that does not comply with the provisions of the Zoning Ordinance. II. SPECIAL INFORMATION: Site Characteristics: The property is comprised of 25,541 square feet previously developed with vacant single family residences, which have since been demolished. Surrounding properties are fully developed with a mix of office, commercial, and high density residential uses. Development Proposal: At the November 10, 2020 meeting, the City Council approved a PUR- Planned Unit Redevelopment Overlay District to allow the redevelopment of this site with a 96 foot tall, 7-story building. The building included two levels of structured parking as well as approximately 7,174 square feet of retail space, along with a 95 room hotel. As a part of the PUR request, the site was zoned to CC District. The applicant has now modified the footprint of the structure, which has resulted in a further increase in the request impervious surface for the site. As the requested impervious surface now exceeds 90 percent, a Major Amendment to the initial PUR must be approved to account for the additional modification to the underlying CC District zoning. No other changes to the previously approved modifications are proposed as a part of this request, but some have been identified as a part of the review of this request. Date: April 27, 2022 Case Number(s): C11-20-100 Applicant: Dan Marak Request: Approval of a Major Amendment to the PUR-Planned Unit Redevelopment Overlay District Location: Southwest of 44th and Douglas Streets Case Number: C11-20-100 44th and Douglas PUR Page 2 RML Public Improvements: For the Douglas Street access, revise the garage door setback to a minimum of 25 feet. Coordinate with Public Works and Urban Design on an acceptable on-street parking and streetscape plan. Grading and Drainage: The development must comply with all applicable stormwater management ordinances and policies, including providing for a no net increase in stormwater runoff and treatment of the first half-inch of stormwater for water quality. Utilities: OPPD has existing distribution equipment on or near the property. Coordinate with OPPD on the removal/relocation of equipment if necessary. Land Use and Planning: Waivers: Based on submitted plans, the waivers initially approved for the site remain applicable. In particular, a total of 63 off-street parking spaces are still proposed on the site. However, the changes to building footprint result in three revised waivers, as follows: • Building coverage increased from 60 percent to 82 percent (previously 63.25%). • Impervious coverage increased from 85 percent to 95 percent (previously 83.4%). • Floor Area Ratio (FAR) increased from 1.0 to 3.1 (previously 2.72). The requested modifications do not substantially alter the intent or character of the previously approved PUR. Alterations to the interior layout have resulted in a revised layout of the structured parking levels of the building, and alley-adjacent parking spaces have been relocated to the interior of the building. The resulting increase in building footprint essentially results from the relocation of these parking spaces from outside the structure to inside the structure. The requested modifications to the CC zoning regulations are acceptable. Previously approved reductions in the required number of off-street parking spaces and building height remain effective as a part of this Major Amendment, as the number of rooms within the hotel and the building height are not being revised as a part of this request. Based on the number of parking stalls proposed on-site (63), on adjacent property (14), and on-street (5), a total of 82 parking stalls are available for use for this development. Urban Design: Submitted plans conflict regarding the dumpster enclosures on the north side of the building. Civil plans indicate the dumpsters are accessed via gates which swing out into the right-of-way (which would not be permitted) while building elevations show roll-up gates. Revise plans to provide the roll-up gates for dumpster access on all plans. Provide a landscaping plan in compliance with Section 55-598(b). In particular, provide three overstory trees on both the Douglas and 44th Street frontages. Case Number: C11-20-100 44th and Douglas PUR Page 3 RML MAPA: This project fits the long range goals and objectives of Heartland 2050 and the MAPA Long Range Transportation Plan, calling for higher density and transit-oriented development along the new ORBT line, and utilizing density to create a more vibrant urban core. III. ANALYSIS: As proposed, the PUR supports the goals and objectives of the Infill and Redevelopment Design Guidelines. The guidelines ensure that the redevelopment of the site is compatible with neighborhood as well as the requirements of the ACI-Area of Civic Importance Overlay District. Continue to coordinate with Urban Design staff on submittal of acceptable PUR plans addressing the garage doors, right-of-way improvements, and landscaping plan prior to forwarding this request to City Council. IV. RECOMMENDATION: Approval of the Major Amendment to the PUR-Planned Unit Redevelopment Overlay District, subject to submittal of acceptable final plans prior to forwarding to City Council. V.
