RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA.
WHEREAS, the Missouri River Water Resource Recovery Facility of the Public Works
Department is in need of a replacement 75 horse power motor and motor stand; and,
WHEREAS, due to the specialized nature of this type of equipment and service, it is
recommended that the bidding procedures be waived in accordance with Section 5.16 of the Home
Rule Charter of 1956 for the purchase of unique or non-competitive items; and,
WHEREAS, the cost of this purchase, totaling $34,239.00, will be paid from the Sewer
Revenue Fund 21121, Missouri Resource Recovery Facility Mtce Organization 116613. year 2022
funding.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
THAT, as recommended by the Mayor, the Purchasing Agent be authorized to issue a
Purchase Order to Superior Industrial Equipment, LLC for the purchase of a replacement 75 horse
power motor and motor stand, to be utilized by the Missouri River Water Resource Recovery
Facility, in the amount of$34,239.00.
BE IT FURTHER RESOLVED:
THAT, the Finance Department is authorized to pay the cost of this purchase from the Sewer
Revenue Fund 21121, Missouri Resource Recovery Facility Mtce Organization 116613, year 2022
funding.

Requesting approval for a replacement of 75 horse power motor and motor stand for the Worthington
roughing filter pump. The Missouri River Plant utilizes this pump for the roughing filter treatment process.
The vendor for this motor and stand is Superior Industrial Equipment.They have supplied a quote for the
replacement for$34,239.00
The sole source purchase of these parts will retain standardization of the automation equipment and piping
in the system.
Please approve the purchase of the motor and motor stand unit. Funds for this contract should come from
the Sewer Revenue Improvement fund Missouri River Treatment Plant Operations budget that will be

General Comments and Clarifications:
1. As the O.E.M.for Worthington Pumps,Flowserve has all pattern drawings and machining prints to manufacture parts for the
Worthington pump models.
2. Any additional repairs and/or parts found to be required will require customer approval prior to proceeding with anything
(parts or labor)that would exceed the original scope of supply offered in this document. Also,it must be understood and
anticipated that any additional parts of labor required will have an impact on price and lead-time.
3. Although Flowserve may comment on suitability,final material selection/approval is the responsibility of the customer. The
effects of corrosion,erosion,and normal wear are specifically excluded from warranty.
4. Flowserve standard paint is included.
5. Quoted lead time is based on the receipt of a fully executable Purchase Order In Taneytown,to be processed and booked as
release to manufacturing,without submittal approval being required. Submittals are not included. Please refer for pricing.
6. Hydrostatic testing of pump casing is included. •

Terms and Conditions
A. Shipment:

D. Service/Start Up
No start up or service time is included in the base price of units.
E. Warranty
Superior Industrial Equipment Company warrants the pump package for one(1)
year from start-up or eighteen(18)months from shipment,which ever occurs
first. All warranties intended by major or sub—components suppliers are
included. We do not warrant for corrosion,erosion or normal wear and tear;or
fitness for a purpose or merchantability.
F. Limitation of Liability
The total liability of the Company with respect to this contract or the equipment
or services furnished hereunder,in connection with the performance or breech
thereof,or from the manufacture,sale,delivery,installation,repair or technical
direction whether based on contract,negligence,indemnity,strict liability or
otherwise shall not exceed the purchase price of the unit of equipment upon
which such liability is based.
The Company shall in no event be liable to the Purchaser,any successors in
interest or any beneficiary or assignee of this contract for any consequential,
incidental,indirect,special or punitive damages arising out of this contract or any
breach thereof,or any defect in,or failure of, or malfunction of the Equipment
hereunder,whether based upon lost goodwill,lost profits or revenue,interest,
work stoppage,impairment of other goods,loss by reason of shutdown or non-
operation,increased expenses of operation of the Equipment,loss of use of
power system,cost of purchase of replacement power or claims of Purchaser or
customers of Purchaser for service interruption whether or not such loss or
damage is based on contract,warranty,negligence,indemnity. strict liability or
otherwise.
G. Miscellaneous
No taxes,duties,boxing or freight charges are included in the base price.
Cancellation charges are at cost plus expenses and pro-rata profit.
