If approved, the property will be subject to the CC District development
regulations, the MCC-Overlay requirements, and any other applicable
regulations.
No building permits will be issued based on a site plan that does not comply with the
provisions of the Zoning Ordinance.
II. SPECIAL INFORMATION:
Site
Characteristics:
The subject site is located at the northeast corner of 42nd Street and L
Street and includes approximately 33,659 square feet of land comprising
multiple full and partial, platted lots. The site is currently zoned GC-
General Commercial District.
Development
Proposal:
Submitted plans propose a 2,020 square foot drive-thru coffee shop with
associated parking areas. This subdivision would facilitate the proposed
development by replatting the subject site into a single lot of record. The
request also includes a rezoning of the site from GC to CC, along with
approval of the MCC-Major Commercial Corridor Overlay District.
Public
Improvements:
Traffic: Coordinate with the City to separately vacate the alley, to run
concurrently with the approval of the plat.
Sewers: Submit the 30% design report for the sanitary sewer to the Public
Works Design Division per Section 2.14 of the City’s Wastewater

Sidewalks: Sidewalks must be provided as required by city code.
Utilities: OPPD has distribution equipment in the area of the proposed vacation,
and needs to retain utility rights or have the property owner work with
OPPD to relocate this equipment.
Grading and
Drainage:
The project must comply with all stormwater management policies and
ordinances, including providing for a no net increase in stormwater runoff
and treating the first ½” of stormwater for water quality.
Land Use and
Planning:
While a full zoning review was not completed as part of this request, a
review was performed as part of a previous Site Plan Review application.
Plans that are fully compliant with the zoning ordinance and all other
applicable regulations must be submitted as part of the building permit
application.
The proposed subdivision is consistent with Chapter 53, Subdivisions, of
the Omaha Municipal Code. The proposed rezoning is consistent with the
City’s Master Plan.
III. ANALYSIS:
Conditionally, the proposed subdivision and rezoning is consistent with and carries out the
goals and objectives of the City of Omaha Master Plan.
IV. RECOMMENDATIONS:
Approval of the MCC-Major Commercial Corridor Overlay District.
Approval of the rezoning from GC to CC.
Approval of the Preliminary Plat, subject to the following conditions:
1. Coordinate with the City to separately vacate the alley, to run concurrently with the
approval of the plat.
2. Submit the 30% design report for the sanitary sewer to the Public Works Design
Division per Section 2.14 of the City’s Wastewater Collection Systems Design Manual.
3. Provide sidewalks along all street frontages.
4. Comply with all stormwater management policies and ordinances
Approval of the Final Plat, subject to the conditions of Preliminary Plat approval and submittal
of an acceptable final subdivision agreement (if necessary) prior to forwarding the request to
City Council for final action.
