The attached Resolution approves the contract with B&L Construction for RNC 6061, being
Webster Street, 14th Street to 16th Street Storm and Sanitary Sewer Separation.
The following bids were received on May 7, 2003. A detailed bid tabulation is attached.

The Human Relations Department determined that the apparent low bid was void due to its
' failure to comply with the provision of Section 10-196 of the Omaha Municipal Code dealing
with PBE/DBE's. That left the remaining bids above the Engineer's Estimate of$1,957.930.00.
Therefore, the bidders were informed that any person could submit a bid within the Engineer's
Estimate within 15 days of the bid opening as provided in the State Law and Bid Specifications
for this type of work.
On May 8, 2003, at 11:00 a.m. a bid was opened by the Bid Committee from B&L Construction
in the amount of$1,762,653.50. The necessary PBE/DBE paperwork was included with the bid.
No other bids were submitted.
The contractor has on file a current Annual Contract Compliance Report Form (CC-1). As is
City policy, the Human Relations Director will review the contractor to ensure compliance with
the Contract Compliance Ordinance.
The Finance Department is authorized to pay the cost of RNC 6061 from the Sanitary Sewer
Improvement Organization 116912, Sewer Revenue Improvements Fund 21124, year 2003
funding.

I am writing this memo to make you all aware of an ongoing problem with the bid
opening/bid award process as it pertains to the DBE/PBE bid requirements.
I want to make it clear that we have no problem with the DBE/PBE program. We
understand the objectives of the program and the bid requirements and we have been in
compliance since the new bidding requirements were implemented.
Our issues pertain to the bid opening and bid award process when a contractor is not in
compliance.
Since the implementation of the new requirements (DBE/PBE paperwork and inclusion
of DBE/PBE estimates with the bid), some contractors have failed to include the required
documents with their bid. Some of these contractors have also happened to be the low
bidder and their bids were considered invalid. Normally, the job would then go to the
next lowest and valid bidder, provided that bidder is within the engineer's estimate.
If there is not another valid bidder within the engineer's estimate, no award is made upon
any bids received until after 15 days after the time for receiving bids under such
advertisement has expired. Within such time anyone desiring to do so may file a bid with
the public works director, providing such be within his estimate and be accompanied by a
deposit or other guaranty of performance similar to that required of bidders upon the
work under the advertisement calling for bids (Section 26-52 OMC).
In the case of RNC 6061, which was bid on 4/23/03, the low bidder was $544,587.50
under the engineer's estimate. Our company was the next lowest bidder, however we
were 2% above the engineer's estimate and therefore the bid was not awarded to us.
When the project was re-bid on 5/8/03, the same contractor was the low bidder. Our
company was the next lowest bidder. What was upsetting to us is the fact that the low
bidder was allowed to adjust his price upward in the amount of$349,132.50.
We realize that we had the chance to lower our price within the 15 days (Sect. 26-52
OMC) to bring it within the engineer's estimate. However, we were firm in our price and
we believe that our small difference to the engineer's estimate proves that our bid was a
valid bid. Also, we took into consideration that since the low bidder was so far under the

estimate, there was no point in lowering it since we could not lower it enough to beat that
contractor's price.
Our question is this—"How does a DBE/PBE paperwork error translate into additional
job costs of$349,132.50? If all that is wrong with the original bid is paperwork, then the
bid should remain the same and should be accompanied with the appropriate/corrected
paperwork.
After bids are read at a bid letting, each contractors bid prices are published via fax with a
follow up copy via regular mail. This shows detailed pricing by bid item. In a
comparison of bid tabs for RNC 6061, it is clear that the low bidder raised his prices for
materials, and for construction of various items such as manholes and installation of
various sizes of pipe. It is clear that the low bidder had a chance to see our pricing and
another contractor's pricing and brought his prices up closer to ours. Obviously, he had
made mistakes in his original bid and now had the second chance to correct those
mistakes—at the expense of the City of Omaha.
This is unfair to the City of Omaha, and it is also unfair to the contractors who submit
valid bids the first time around. While we see the reason for giving a contractor who has
a paperwork error the ability to correct it, we do not see the reason for allowing a
contractor to raise prices.
Also, Section 26-52 of the OMC goes on to say, " Where no bid is received within the
estimate of the public works director the bids shall not be published within such 15 days
unless a bid as above set forth be filed with the public works director. After the
expiration of 15 days, if no bid within the estimate shall be received, an award may be
made on the lowest and best bid received, even though above the estimate.
Our prices should not have been published after the 4/23/03 bid letting. This gave the
low bidder the chance to compare his bid item pricing to ours, find out where he was too
low, and correct the mistake.
We feel this job should be re-bid. We also feel that the bid process should be thoroughly
reviewed to eliminate the loopholes that are penalizing both the City of Omaha and
contractors who submit valid bids that are priced correctly. The bidding process is sacred
to contractors—it levels the playing field and keeps things fair. We look to you to
ensure that the OMC allows for a fair bidding process and also to ensure that the process
is followed correctly.

Here is the timeline on this bidding: JUN 06 '03
1. RNC 6061 was advertised on April 9, 2003.
2. The bid opening was on April 23, 2003 at 11:00am in the LC Chambers. 77
3. All bids were publicly opened and the total amount bid was read for each bidder(as is required).
4. Since the total amount was read in public,we provided anyone who asked a copy of the
handwritten bid tab that lists only the total amount bid by each. We did NOT provide a bid tab
which breaks down each and every line item at this time.
5. The Human Relations Department determined on April 29th that the apparent low bidder(B&L
Construction, Inc.)did not fill out the PBE/DBE papers correctly. Both other bidders(L.G. Roloff
and Kiewit Western)were above the engineers estimate. For that reason, Section 26-52 of the
OMC kicked in. The relevant sections are quoted below(my understanding is that this is a State
requirement and we cannot waive it).
"All bids received, opened and read for any such work shall be referred to the public works director for
tabulation. If in any case no bid is received within such estimate, no award shall be made upon any bids
received until after 15 days after the time for receiving bids under such advertisement shall have expired.
Within such time anyone desiring to do so may file a bid with the public works director, providing such be
within his estimate and be accompanied by a deposit or other guaranty of performance similar to that
required of bidders upon the work under the advertisement calling for bids."
"If any bid within the estimate be so filed with the public works director he shall at any time thereafter
within such 15 days transmit such bids to the city council and award may be made thereon in like
manner as if said bid had been received in pursuance of the advertisement calling for bids."
"Where no bid is received within the estimate of the public works director the bids shall not be published

6. This requirement is also included in the Standard Bid Book on the top of page NB-2. In addition, a
letter was sent to each and every bidder telling them of this(see attached letters).
7. The 15 days were up on Thursday May 8 at 11:00am. The Bid Opening Committee met in Buster
Brown's office to open up the only bid received after the first bid opening. This bid was from
B&L Construction and was found to be complete.
8. At this time,the bid tabulation(including the breakdowns for every line item)was mailed to each
bidder and supplied to anyone who asked for it.
9. The recommendation to award the Contract to B&L Construction was typed up and sent to the City
Council and was on the June 3,2003 agenda.
I believe that we fully and completely complied with all legal requirements on this bid.

Rolhoff, any of the other bidders, and even entirely new bidders are allowed by the
statute and ordinance to submit a bid within the 15 days of determination that no valid
bid is within the official estimate. All of the procedures under the current state or the
ordinances have been followed as well as circumstances would allow. The best action in my
judgment is an award to B&L on its second bid. Obviously some amendments of the
ordinances, consistent with state law, may be considered if the Council wishes.

process was followed " to a tee" and the integrity of the bidding process is at stake if
that process is not followed. Although Rolhoff makes some excellent points, non-selection
