BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. The Mayor is hereby authorized to execute, and the City Clerk to attest, the attached Amended Redevelopment Agreement with 710 South 20th Street, L.L.C. that authorizes a change in the legal description to remove a portion which is now owned by the Omaha Public Schools, that is, Lot 1 Liberty Addition. The Ordinance authorizes the replacement of Exhibit "B" of the original agreement in its entirety with a new Exhibit `B" as attached. The amendment changes the legal description of the 710 South 20th Street LLC Redevelopment Area to Lots 2 and 3, Liberty Addition. All other terms and conditions remain in full force and effect. Section 2. Said Redevelopment Agreement contains obligations undertaken pursuant to the Nebraska Community Development Law and Sections 18-2147 through 18-2150; and are not otherwise obligations of the City of Omaha. Section 3. This Ordinance shall be in full force and take effect immediately from and -,1,'. after the date of its passage. RECITALS: WHEREAS, the 710 South 20th Street Redevelopment Area has been replated to be Lots 1-3 Liberty Addition; and, WHEREAS, Lot 1 Liberty Addition is now owned by the Omaha Public Schools; and, WHEREAS, on February 25, 2003, the City Council of the City of Omaha approved the Amendment to the 710 South 20th Street L.L.C. Redevelopment Plan that authorizes a change in the legal description of the Tax Increment Financing project area to remove that portion now owned by the Omaha Public Schools; and, WHEREAS, this Amended Redevelopment Agreement is a redevelopment agreement prepared pursuant to the Nebraska Community Development Law in order to implement the above-referenced Redevelopment Plan. IN CONSIDERATION OF THESE MUTUAL COVENANTS THE PARTIES AGREE AS FOLLOWS: Exhibit `B" of the original Redevelopment Agreement shall be deleted in its entirety and the attached Exhibit `B" shall be substituted in its place and stead, so that the Legal Description of the 710 South 20th Street Redevelopment Area is changed to Lots 2 and 3, Liberty Addition. The remainder of the original Redevelopment Agreement approved by the City Council on April 9, 2002 by Ordinance No. 35924 shall remain the same and shall be in full force and effect.
