Although there are commercial.lots on the north side of "1" street,this property sits among residential lots and is situated over one city block away from a main street. The question is; " How did the towing company get away as using this property in this manner"? Finally one neighbor took the courage to recognize this issue and bring it to the attention of all the neighbors and the planning board. I believe that we all assumed that this was GI and there was nothing that we could do to change things. We are tired of the noise and the fumes that these diesel engines are putting out. We are tired of seeing the mess, which this kind of business creates. Sometimes it looks like an auto salvage yard. Besides NOT being a GI district. The owners of the properties should be fined for knowingly using this property for wrong intent. They have been in the business of towing for more years than I have been alive and they know the rules but pushed the system as long as they could before they were caught. They have been caught! I'd like to share some information with you and would hope to meet with you prior to the 21' to seek your support for our request. We are not seeking any change in the status quo with regard to the present or future use of this property. Rather, we are seeking to simply allow Mr. Neff to continue to use his property for an auto towing business storage yard,the same use for which it has been utilized since 1965,so this 84 year-old gentleman can continue to supplement his social security income with rent income from the property. I'd like to present you with four points to consider as you decide whether to concur with the Planning Board in denying our request or to permit this life-long resident of the City to continue to utilize his property. The points I'd like to discuss are these: 1. The present R-3 zoning is of fairly recent origin. 2. The present(and proposed) use of the ground has continued for the past 38 years. 3. The ground is virtually worthless as R-3 ground. 4. Neighbors can be protected by a proposed restrictive covenant. 1. Present R-3 zoning of fairly recent origin. We are seeking to rezone Mr. Neff's lot from R-3 to G-1 since that is the least permissive zoning class which would allow outdoor vehicle storage for a towing business. However,this property has only been zoned R-3 for the past 16 years. It was zoned S-2 until 1987 when it was rezoned R-3 despite the fact that all property to the north and a significant tract of property to the west was already zoned G-1 and was being utilized in ways totally inconsistent with single family zoning. • 1 President and Members of the Omaha City Council October 13, 2003 Page Two 2. The present (and proposed) use of the ground has continued for the past 38 years. If Mr.Neff was attempting to foist a new, more intense use on his ground than that in place of the past,that would be one thing. However,all he is attempting to do is continue a use which has been in effect since he acquired the property in 1965, apparently without complaint until a few months ago. Indeed, Mr. Neff was utilizing the ground as a towing business storage lot for a period of 22 years prior to the time the ground was designated R-3 as part of the citywide 1987 rezoning. It would seem that if the proposed continued use of the property was so offensive, a history of complaints would be found in the City records. That, however, is not the case. Ironically, the property of the disgruntled person whose complaint has set this matter in motion isn't even contiguous to the property to be rezoned. 3. The ground is virtually worthless as R-3 ground. If Mr.Neff is denied his rezoning request,he will be left with a tract of ground zoned only for single family homes. However,given the fact that the tract would be directly across "I"Street from an enormous 3 acre G-1 auto storage lot totally devoid of landscaping or open space and rimmed by an 8 foot-high chain link fence, it is difficult to imagine that anyone would build single family homes complying with the R-3 requirements on that ground,and if anyone was so inclined, it is doubtful that buyers or renters could be found willing to occupy those homes. Thus, Mr.Neff would be placed in the untenable position of owning a tract of ground which would be, for all intents and purposes,useless. This senior citizen, a life-long resident of our community, deserves better from his City Council. 4. Neighbors can be protected by a proposed restrictive covenant. A legitimate concern of the Council would be that if you approve the rezoning request,you would be subjecting the neighbors to the south to the same evils now faced by Henry's property from the G-I ground to the north and west. However, so long as Henry's ground could not be used for any purpose more intense or offensive than that for which it has been used for the past 38 years, we'd submit that those neighbors would not be harmed. What we are proposing to protect them is a protective covenant,a draft of which is attached to this letter, which would assure that, regardless of what the new zoning would permit, neither Henry nor his successors would be able to change the current use to anything more intense or offensive than what's gone on since 1965. This covenant would run with the land and would be enforceable by any person whose property abutted any portion of the property to be rezoned. When that use restriction is combined with the 60 foot buffer yards on the east and west and the 14 foot buffer yard on the south,we believe any negative impact on the neighbors would be virtually eliminated.
