This letter of appeal is in response to the disqualification of the Smith Manufacturing bid due to
noncompliance with bid specifications.
Please find attached Addendum A to the Smith Manufacturing bid. The addendum states our
response to the items stated as critical issues in Leanne Ziettlow's memo of December 19, 2003.
We contend that none of the competitive machines meet the specification for drum width and the
machine should be rebid based on a specification of 10"drum width.

Note: The Smith drum has 50% more cutting capacity than the specified drum,
which gives the City of Omaha increased value with longer cutter and drum life

(10) inches and can be increased two (2) inches with the optional edger attachment.
Further, the Smith drum has cutter shaft bushings, which are economical to replace
and greatly extend the effective life of the drum.

Dear Mr. Jackman:
Thank you for your letter dated January 5, 2004,regarding the Smith Manufacturing bid for
above. This letter will serve as formal notice that we are protesting the disqualification of our
bid. Also, the deadline for our response is January 23, 2004, based on our receipt of Ms. Sue
Preiner's letter dated January 13, 2004. Her letter included the required correct documentation
which explained the reasons for the disqualification of our bid.
A letter of appeal will be submitted by January 23, 2004, explaining why the Smith machine
meets the bid specifications and/or is the best value for the city.
Thank you for your anticipated cooperation and we look forward to answering any questions
regarding our letter of appeal.

Gentlemen:
Section 10-110 of the Omaha Municipal Code allows a department director to reject any
or all bids received for any City purchase or contract because the bids received were non-
compliant to specifications. This letter is to serve as written notice that your bid is being
rejected because the bid does not meet the required specifications as detailed in the
attached inter-office communication.
A resolution is being forwarded to the City Council to recommend award to another
bidder. Within ten days after a bid is rejected, any rejected bidder may appeal to the City
Council by filing with the City Clerk a written objection stating all reasons for the
objection.

SUBJECT: Rejection of Bidders for "Surface Grinder/ Tier"
Bids were opened on December 4, 2003 for one "surface preparation grinder/ scarifier
per specifiea.tions", see bid tabulation attached. This piece of equipment is for preparing
street intersections for the installation of pavement marking tape. Traffic Engineering
currently has one pavement grinder that was purchased in the early 1980s. We have
ordered this new grinder to supplement the existing grinder due to the increase in our
pavement marking tape installations. •
The specification included twenty-one separate specification items for this grinder,
including the below noted four:
• ENGINE: Honda 13.H.P. air cooled.
• GRINDING: Variable working width to a max of 12 inches.
• GRNDNG: Must be able to grind 1/8" depth of concrete in a single pass.
• GRINDING: Shall have one (1) four shaft drum with tungsten carbide tipped
cutter.
The above four items are crucial to the efficient and effective use of this grinder by the
City of Omaha. These grinding specification items define the width and depth of the
groove produced by the grinder. The engine was specified in order to provide good
power to the grinding drum and cutters. -
As shown on the bid tabulation, the City of Omaha received six bids offering a total of
five different pieces of equipment. In reviewing this information, four of these grinders
take exception to the grinding width (do not offer 12 inches of grinding width). One of
these also takes exception to the grinding depth.
In an example for the use of the grinder, an intersection could have 36 crosswalk bars (2'
X 8') and 24 LF of 24" stop bar per leg (for a total of 384 LF of material). Estimating
that with a 12 inch grinder an employee can grind 8 LF of surface every 5 minutes (24
inches wide), the employee would spend a total of 240 minutes grinding the intersection
for pavement marking tape installation.
