The patio location, size, and construction materials used shall be exactly in accordance with the Exhibit A-1 site plan to this Amendment; any deviations whatsoever must be approved in advance in writing by Owner. B. Prior to construction beginning Tenant must secure all appropriate governmental building permits and approvals for construction and for serving alcoholic beverages on such patio. Evidence thereof will be provided Owner • prior to opening for business on the patio. C. Tenant will take whatever measures are necessary to assure that food and beverages will only be served and/or consumed within the patio area and that such area will at all times be kept clean and sanitary. Tenant will take whatever measures are necessary to prevent napkins and other paper products, bottles,or other items from falling or blowing onto adjoining common areas at • Eagle Run Plaza; in the event this occurs, Tenant will immediately retrieve and dispose of such items. D. Tenant will begin construction upon obtaining the required governmental approvals and permits and will proceed diligently and without interruption until completion. All construction shall be accomplished in a responsible and s z • workmanlike manner so as to cause no disruption to neighboring tenants. During the construction process,all of the construction site will be cleaned on a daily basis. E.
