The attached Resolution approves the Subdivision Agreement among the City of Omaha and Lois
Musel,Personal Representative of the Estate of Edna Mohr. This Subdivision Agreement covers the
public improvement of Mohr Valley of Douglas County,Nebraska located 12401 Dutch.Hall Road.
This Subdivision Agreement stipulates which public improvements will be built by the Subdivider in
Mohr Valley. The entire cost of improvements made in this development will be paid by the
Subdivider.
The Subdivision Agreement will benefit the City of Omaha and the Subdivider in clarifying the
responsibilities of the parties in building and maintaining the improvements in the subdivision.
The Public Works Department requests your consideration and approval of the attached Resolution
and Subdivision Agreement.

SUBDIVISION AGREEMENT
MOHR VALLEY
This Subdivision Agreement, made this day of� , 20 eiby and between Lois
Musel, Personal Representative of the Estate of Edna Mohr (he nafter referred to as
"Subdivider"), and the City of Omaha(hereinafter referred to as "City").
WHEREAS, the Subdivider is the owner of the land shown on the proposed plat attached
hereto as Exhibit"A" (hereinafter referred to as "Property"); and,
WHEREAS, there are no required public improvements to be constructed to serve the
Property; and,
WHEREAS, the Subdivider does not intend to connect the Property to the sewer system
of the City of Omaha; and,
NOW, THEREFORE, in consideration of the above, the following is agreed between the
parties hereto:
1. Public Improvements. No additional public improvements are required to be
installed to serve the Property. If the City or other Governmental agency
creates improvement districts to improve Dutch Hall Road, or install sanitary
sewers or sidewalks, the Subdivider agrees to waive its right of protest for
such improvement districts and agrees to pay a fair assessment for same.
2. Water. Water is provided by an existing individual well system.
3. Power. Electrical power exists to serve the Property.
4. Sewer. Existing Lot 1 on the Property is served by an existing individual
sewage treatment system. All subdivisions with the Papio Watershed help
pay for the Interceptor Sewer Extension that will eventually service the
Property. As such the Subdivider agrees to pay $947.00 to the City for the
construction of Interceptor Sewers. The payment shall be made prior to
recording the plat.
5. Sidewalks. Public sidewalks are not required, however, Subdivider, for itself,
its heirs, successors and assigns, hereby waives any right to protest the future
creation of a sidewalk improvement district.
6. Streets. Public streets are not required, however, Subdivider, for itself, its
heirs, successors and assigns, hereby waives any right to protest the future
creation of a street improvement district.
7 Binding Effect. This Subdivision Agreement shall be binding upon the
parties, their successors and assigns, and shall run with the land shown on
Exhibit"A".

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, Lois Musel, Personal Representative of the Estate of Edna Mohr
proposes to build a Subdivision,Mohr Valley,which will be located 12410 Dutch Hall Road; and,
WHEREAS, the Subdivision's wastewaster is currently treated by a septic system;
and,
WHEREAS,the parties wish to agree upon the manner in which public improvements
will be installed by the City or other governmental agencies via future improvement districts and the
Subdivider agreeing to paying special assessments for same; and,
WHEREAS,the Subdivider agrees to pay $947.00 as a sewer connection fee to be
used for the construction of sewers in the Papillion Creek Watershed; and,
WHEREAS, a Subdivision Agreement has been prepared setting forth all the
provisions mentioned above.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:
THAT, the Subdivision Agreement among the City of Omaha and Lois Musel,
Personal Representative of the Estate of Edna Mohr, as recommended by the Mayor,providing for
future public improvements and the payment of interceptor sewer fees, is hereby approved.
