REQUEST FOR: Resolution: Dissolve Municipal Dock Board

DETAILS:
Council President Jim Vokal requests that the Law Department prepare an appropriate Resolution to
dissolve the Municipal Dock Board as of March 16, 2004.
The City has ceased operation at the Dock location, and all business and Foreign Trade transfers have
been accomplished. The Dock Board passed a Resolution on October 31, 2002 (their last official
meeting) that stated when all business was completed and when the Foreign Trade Zone transfer was
completed (which was just accomplished), then the Board was to be dissolved. I
Mr. Vokal believes that this Resolution would officially cease all official status publicly and would serve as
an official public notification.
The Resolution, like the initial appointing resolution of 1937, completes all City requirements. It is noted
that the City can create a future Dock Board if the need arises since the status remains in State statute.
Finally, the Resolution recognizes the substantial contribution of all past and present Dock Board
. Commissions, with special recognition to those final seven Board Members who guided the complex
closure and transfer operations.
The Law Department is highly encouraged to select the appropriate language for the Resolution and may
use the attached suggestions as required. Council Staff has the official City Clerk records in our office
should there be a requirement to review such material.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, the City of Omaha, in accordance with Nebraska Legislative Bill 95
for the year 1937, and governing State Statutes, Section 18-701 et seq. [now Section 13-1401 et
seq.], created a Municipal Dock Board by Resolution on May 11, 1937; and,
WHEREAS, the Municipal Dock Board managed the business affairs of the
Municipal Dock continually from 1937 at 701 Abbott Drive, Omaha, Nebraska; and,
WHEREAS, as part of the City of Omaha's Redevelopment Program, operations
at the Municipal Dock ceased in June 2002 when the Riverfront Development and Gallup
University campus redevelopment projects were initiated; and,
WHEREAS, the Global American Teiiiunals and Trifinery/Carbogen respective
leases were financially settled by the Dock Board and the City of Omaha, by legislative acts;
and,
WHEREAS, the Foreign Trade Zone#19 Granteeship was officially transferred to
the Omaha Chamber of Commerce; and,
WHEREAS, the Dock Board was dissolved by the Commissioners of the Dock
Board on October 31, 2002.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, the City Council of the City of Omaha, upon the recommendation of the
Dock Board of the City of Omaha, by Resolution dated October 31, 2002, hereby dissolves the
Municipal Dock Board as of this date, March 16, 2004.
FURTHERMORE,BE IT RESOLVED:
THAT, the City Council of the City of Omaha hereby acknowledges the past
citizens of Omaha who served faithfully on the Municipal Dock Board as Dock Board
Commissioners from 1937 to the present. And in particular, the City Council acknowledges the
faithful and professional services of the last sitting Commissioners who guided the Dock Board

through its complex business to finalize all Dock operations that culminated in its closure and
revitalization projects known as Riverfront Development. The City Council recognizes those
last Commissioners as: Dock Board President David Stern; Treasurer John Bartle; and Members
Margaret Gilmore,William Lee,Michael McFarlin, John Prouty; and Michael Wiese.
AND FURTHERMORE, BE IT RESOLVED:
THAT, the right of the City Council of the City of Omaha to create a Dock Board
in the future should the need to do so arise, is reserved as provided by State Statute.
