The purpose of this agreement is to build upon the planning, infrastructure development and implementation activities of the Omaha Metropolitan Medical Response System (OMMRS) while at the same time accomplishing the priority planning areas set forth by the federal Health. Resources and Services Administration for the State of Nebraska's Hospital Bioterrorism Preparedness Program. The goal of both these programs is to improve the capacity to respond to bioterrorism, weapons of mass destruction and other public health threats. Through the continuation of the effort already underway, the City of Omaha will assist OMMRS to continue to prepare the local hospitals, medical personnel, fire, law enforcement, business, governmental and community organizations for a planned, integrated and coordinated response in the event of a natural incident, crises or disaster or from a terrorist attack. The term of this agreement shall begin upon the date of execution of this agreement and shall terminate no later than December 31, 2004. SCOPE OF AGREEMENT The purpose of this agreement is to build upon the planning, infrastructure development and implementation activities of the Omaha Metropolitan Medical Response System (OMMRS)while at the same time accomplishing the priority planning areas set forth by the federal Health Resources and Services Administration (HRSA) for the State of Nebraska's Hospital Bioterrorism Preparedness Program. SCOPE OF SERVICES The Department hereby retains the services of Contractor, and Contractor hereby agrees to: A. Advance the work of the Omaha Metropolitan Medical Response System (OMMRS)by integrating this planning effort into the County and State of Nebraska plans for responding to bioterrorism,weapons of mass destruction and other public health threats. Manual Revision/updates-Administrative Cost $720 b. Office Supplies (Envelopes/postage/paper/notebooks/etc.) $895 2. Mental Health Committee Planning Efforts a. Survey Mental Health Professionals 1) Develop Data Base 2) Maintain Data Base $25,000 b. Provide Education to Mental Health Professionals and Indigenous Workers $50,000 3. Alternate Care Facilities Preparation Efforts a. Supplies $2,802 b. Education and Training $25,000 B. In order for OMMRS to be prepared to respond correctly to a biological event and ensure the safety of staff and facilities, resources will need to be committed to enhance pharmaceutical and medical inventory in order to have the ability to treat large numbers of patients diagnosed with, or exposed to biological agents. To accomplish this objective, the Contractor agrees to purchase and stockpile the following items: 1. Equipment a. Supplied air respirators with hoses $870.00 x 48 $41,760 b. PAPR kits $1117.70 x 24 $26,825 c. Doff it Redress Kits $16.00 x 1200 $19,200 d. Suit Packs $74.00 x 144 $10,656 e. Incident Management Equipment Training $20,000 2. Pharmacy a. Mark 1 Kits (replace out-dated kits) $7,716 b. Receiving, Staging, Storage (RSS) Site for SNS 1) Office Supplies $125 2) Mobile Cases for Office Supplies $200 C. OMMRS has evaluated existing local and communications capabilities available to hospitals and collaborating entities, and the ability of the communication system to respond to overloading of standard telephone, cellular phone and radio communications during a terrorist incident. To enhance communications capacity, the Contractor agrees to purchase the following communication system: 1. Internet Access port Installation Phones/fax lines $300 D. Education and training of hospital and pre-hospital clinicians at all levels is essential to bioterrorism preparation efforts. Recognizing that appropriate response plans will differ between health care entities licensed at different levels, OMMRS has identified a specific training need that is currently lacking in their current preparation efforts. The Contractor agrees to provide the opportunity for education and training, drills and exercise for OMMRS as follows: 1. Drill/Exercise Design Team a. Drill/Exercise Printing Cost $1,500 b. Administrative Support $3,000 c. Moulage Supplies $600 d. Facility Rental $1000 e. Evaluator Funding $1000 f. Supplies (Postage/paper/envelops/manuals/pens/refreshments/etc) $4,150 g. Educators/Trainers fees $2,000 2. Recruitment and Training a. Supplies (Manuals) $1,000 b. Staff Support $1,000 c. Education/Training Seminars $1,000 E. The credentialing of medical personnel from other facilities and volunteers when responding to bioterrorism, weapons of mass destruction and other public health threats is an important aspect of having the capacity to handle a large number of potential patients. OMMRS has identified equipment needs that are required to be able to process medical personnel and volunteers that come into the community. The Contractor agrees to purchase the following equipment for OMMRS to address that need: 1. Personnel Processing Point a. Equipment: 1) Desks/chairs/telephones/filing cabinet/chalkboard/signage wall clock/storage containers/computer/copier $12,656 2) Supplies, including postage $2,497 BT 218 123104 3 3) Generator $10,000 F. The Contractor agrees to file a mid-term Progress Report, due June 30, 2004 and a final Progress Report due December 31, 2004, documenting progress towards completion of activities funded under this contract. 3. DEPARTMENT OBLIGATIONS COMPENSATION Upon acceptance and execution of this agreement, the Department agrees to pay the Contractor for services described in 2. Scope of the Agreement, and consistent with the budget amounts outlined in 2. Scope of the Agreement. Payments shall be made based upon demonstration of adequate progress towards completion of services and upon receipt of itemized billing statements from the Contractor. Total payments made under the terms of this agreement shall not exceed $512,802. 4. GENERAL PROVISIONS A. TERM The term of this agreement shall begin upon the date of execution of this agreement and shall terminate no later than December 31, 2004. B. TERMINATION This agreement may be terminated at any time upon mutual written consent of the parties, or by either party, with or without cause, upon fifteen days written notice to the other party. In the event of termination Department shall be under no further obligation to Contractor except that Department shall pay Contractor for the cost of the services provided up to the date of termination. C. PROJECT COMPLETION The project will be deemed to be complete when the Contractor provides the final report, and final billings to the Department. D. DATA OWNERSHIP All data collected as a result of this project shall be the property of the Department. E. ASSIGNMENT AND DELEGATION This Agreement is exclusive to the parties and rights may not be assigned nor duties delegated by the Contractor except on prior written consent by the Department. Any attempted assignment without such approval shall be void and shall constitute a breach of contract. F. INDEPENDENT CONTRACTOR Contractor is an independent Contractor and shall not be deemed an employee of the Department for any purpose. Contractor shall not in any manner represent itself as an employee of the Department or his actions as representing those of the Department or State of Nebraska. G. HOLD HARMLESS To the extent allowable by State law, the Contractor agrees to hold the State harmless for all loss or damage sustained by any person as a direct result of the negligent or willful acts by the Contractor, its employees or BT 218 123104 4 agents in the performance of this agreement, including all associated costs of defending any action. H. NON-DISCRIMINATION Contractor acknowledges that this Agreement must be operated in compliance and civil rights laws and any implementing regulations, and makes the following assurances: Contractor warrants and assures that it complies as applicable to it with Title VI of the Civil Rights Act of 1964, Title IX of the 1972 Education Amendments, Section 504 of the Rehabilitation Act of 1973, Age Discrimination in Employment Act, the Americans with Disabilities Act of 1990, to the effect that no person shall, on the grounds of race, color, national origin, sex age, handicap or disability, be excluded from participation in, denied benefits of, or otherwise be subjected to discrimination under any program or activity for which the Contractor receives federal financial assistance. Contractor and any of its subcontractors shall not discriminate against any employee or applicant for employment, to be employed in the performance of this contract with respect to hire, tenure, terms, conditions, or privileges of employment because of face, color, religion, sex, disability, or national origin of the employee or applicant. I. DRUG FREE POLICY Contractor assures the Department that the Contractor has established and maintains a drug free workplace policy. J. AMENDEMENTS This document represents the entire Agreement of the parties and it shall not be modified except by writing and signed by both parties. K.
