Lund and Jim Cable made in accordance with Necessity Ordinance No. 36257, passed May 6, 2003, declaring the necessity of appropriating and acquiring certain private property for the purpose of widening Pacific Street from Bob Boozer Boulevard to 169th Street, known as Project No. S.P. 99-24. The Negotiator, Tom Lund, was successful in acquiring one parcel of land or interest in property required for the project, which address is 16406 Pierce Street, for the total negotiated amount of $28,853.00. The Negotiators, Tom Lund and Jim Cable, were unsuccessful in negotiating and acquiring two parcels of land or interest in property required for the project and the Public Works Department recommends that the Law Department of the City of Omaha take the necessary steps and procedures to condemn the two parcels of land or interest in property non-negotiated, which addresses are 1111 South 166th Street and 16734 Pierce Circle. The cost of the condemnation awards based on the Report of Appraisers made for the two parcels of land or interest in property non-negotiated and the cost of the one parcel of land or interest in property negotiated shall be paid from the Street and Highway Bond Organization 116167, 2000 Street and Highway Bond, 2004 Funding, Fund 13175. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT, the Negotiator's Report of Tom Lund and Jim Cable made in accordance with Necessity Ordinance No. 36257 be and hereby is approved. THAT, the Finance Department is authorized to pay the cost of the condemnation awards based on the Report of Appraisers made for the two parcels of land or interest in property non-negotiated and to pay the cost of the one negotiated parcel of land or interest in property acquired in the amount of$28,853.00 from the Street and Highway Bond Organization 116167, 2000 Street and Highway Bond, 2004 Funding, Fund 13175.
