Conditions:
1. Submitting a revised plan that addresses the following:
(a) Close the existing curb cut on 38th Street that is closest to "Q" Street;
(b) Provide a ten (10 foot wide strip of landscaping along both 38th and "Q" Streets
(on private property), including the planting of three (3) street trees along "Q"
Street and two (2) along 38th Street;
(c) Provide a five (5) foot wide strip of landscaping (where possible) along both the
south and west property lines with one (1) tree each; and,
(d) Remove the strands of barbed sire from the fence.
2. Complying with the revised plan and operating statement; and,
3. Other than display vehicles, no outside storage will be allowed.

WHEREAS,Section 55-884 of the Omaha Municipal Code,provides for the granting
of a Special Use Permit; and,
WHEREAS, an application has been submitted by Paul R. Tyrell for a Special Use
Permit to allow Automotive Sales in a GC General Commercial District,located at 3801 "Q"Street,
Omaha,Nebraska; and,
WHEREAS,the City Planning Board has recommended that said permit be granted
pursuant to the application,a copy of which is attached hereto as Exhibit"A"and made a part hereof
by this reference,and the conditions set out in Exhibit"B"attached hereto and made a part hereof by
this reference.
NOW,THEREFORE,BE TT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:
THAT, the Special Use Permit application submitted by Paul R. Tyrrell for
permission to allow Automotive Sales in a GC General Commercial District, located at 3801 "Q"
Street,Omaha,Nebraska,is hereby approved and the Permits and Inspection Division is directed to
issue the necessary permit therefor, provided the conditions set out in Exhibit "A" of the above
referenced application, conditions set out in Exhibit "B", and all applicable local or state statutes,
ordinances or regulations are complied with.
BE IT FURTHER RESOLVED:
THAT,the proposed Special Use Permit has been reviewed and evaluated pursuant
to, and meets each of, the criteria set forth in Section 55-885 of the Omaha Municipal Code.
