The plan is an Amendment to the East Omaha Redevelopment Plan and it is the Harwood & Associates TIF Redevelopment Project Plan that implements the terms of the Memorandum of Understanding between the City of Omaha and the United States General Services Administration (GSA). The agreement provides for the development of a new Omaha District headquarters facility for the United States Department of Homeland Security's U.S. Immigration and Customs Enforcement and U.S. Customs and Immigration Services. The facility will be located at Avenue "H" and North 15`h Street East in the East Omaha Redevelopment Plan area. Under the East Omaha Redevelopment Plan, the City acquired property, demolished structures, and installed a storm water detention cell and other public improvements over a number of years for new civic, commercial and industrial uses. This Memorandum provides for the development of the remaining City-owned land in the redevelopment area. The Department of Homeland Security's (DHS) U.S. Immigration and Customs Enforcement and U.S. Customs and Immigration Services Omaha District Office serve the States of Nebraska and Iowa. Due to rapid growth in workload and increased responsibilities, the Omaha District office has expanded to four separate leased facilities in the city. The desire to consolidate these facilities into one efficient facility has been a goal of both the DHS and the community for many years. In May of 2003, DHS finalized and approved space requirements and obtained partial project funding for a consolidated office project. Additional project funding is programmed in the fiscal year 2004 DHS budget. The planned facility will be approximately 87,500 square feet with employment levels projected to grow from 137 to 160 staff members. In order to expedite completion of the project for occupancy in 2005, the GSA is using a build- to-suit lease process whereby a private developer designs and constructs the facility and leases it to the federal government. GSA advertised for developers, evaluated the offers and determined up to five most qualified potential offerors. GSA selected Hardwood & Associates of Fairfax Virginia to be the developer from among the finalists and the lease has been negotiated. • Honorable President And Members of the City Council Page -2- The attached Harwood & Associates Tax Increment Financing Project Redevelopment Plan implements the Memorandum of Understanding that provides for the City to sell approximately 9.3 acres of land for $400,000 to the developer selected by GSA. The sale proceeds will be returned to the Community Development Block Grant program as partial reimbursement for expenses previously incurred for land acquisition, relocation and demolition. Tax Increment Financing will be used for on-site and off-site development costs and the installation of public improvements including streets, storm sewers, sanitary sewers, public utilities and the expansion of a City storm water detention cell. Total project cost are estimated to be in excess of $11 million dollars generating TIF in excess of$1.8 million dollars. The TIF will be use to cover a portion of all TIF eligible cost. Project financing consists of owner equity, bank debt, and possible bond funds. The TIF loan will be repaid from the increase taxes generated from the increase in valuation from the completion of the project. Your favorable consideration of this Resolution is requested. One proposal was received from a developer and evaluated by the selection committee that recommended approval. The developer subsequently decided not to proceed as they identified an alternative site for their project. The City of Omaha became aware of the possibility of the site being of interest to the General Service Administration (GSA) for a proposed District Office for the United States Information and Naturalization Service (INS). On December 3, 2003, City Council Resolution No.1538 approved a Memorandum of Understanding between the City of Omaha and the General Services Administration for the sale of the site for $400,000.00 and for the site to be used for the proposed development for the INS. The General Services Administration advertised and selected a developer from the responses to their solicitation for the Design Development of a proposed 87,500 square foot facility constructed under the build to lease development concept. This redevelopment project plan is to implement the Harwood & Associates TIF Redevelopment Project Plan submitted in response to the GSA Request for Proposals. The proposed plan will accomplish two inter-related functions. First, the plan will set the framework for the development of the site by approving an amendment to the East Omaha Redevelopment Plan that recommends and authorizes the sale and transfer of property from the City of Omaha to Harwood & Associates. The site will then be used to implement the Harwood & Associates TIF Redevelopment Project Plan. The City Council previously approved a Memorandum of Understanding that outlined the proposed development concept. Secondly, the plan proposes the development of the 9.3-acre site for the District Office of the United States Information and Naturalization Service and the use of Tax Increment Financing to fund the cost of site development that includes sanitary/storm sewer relocation and improvements as may be required, storm run-off detention and control, street construction and signalization, and other on-site and off-site improvements as may be required to implement the terms of the Memorandum of Understanding as implemented by the redevelopment plan and agreement. This redevelopment plan amendment is prepared pursuant to the authority granted by the Nebraska Community Development Law. The Redevelopment Project Area is included within the area that was determined to be blighted and substandard by resolution of the City of Omaha City Council and within the East Omaha Redevelopment Plan Area. On December 3, 2003, the City of Omaha (the "City") and the United States General Service Administration (the "GSA") entered into a Memorandum of Understanding ("MOU") regarding the development of the regional offices of the United States Department of Homeland Security's Bureau of Immigration 2 and Customs Enforcement and Bureau of Customs and Immigration Services (together with the public improvements, the "Project"). The GSA has selected its developer for the Project (the "Redeveloper"). This redevelopment plan amendment will allow the development of the Project and the use of excess ad valorem taxes as described below. The City will sell to the Redeveloper, approximately 9.3 acres in the East Omaha Industrial Park in an area generally bound by Avenue "H", North 18th Street East, Avenue "G" and North 15th Street East (the "Site"). The Site consists of the following described real estate: All of Lots 1-7 and Lots 16-22, Block 8; Lots 1-22, Block 9; Lots 1-22, Block 10; and, Lots 12-22, Blockll, Goff Terrace, an addition to the City of Omaha, as platted and recorded in Douglas County, Nebraska, together with the adjacent rights-of-way of 16th Street East, 17th Street East and 17th Avenue East. A map of the above-described property showing the boundaries of the Redevelopment Project Area is provided as Exhibit "A". The Redeveloper and the City will enter into a redevelopment agreement consistent the terms of the MOU. II. EXISTING CONDITIONS A. Existing Land Use The Redevelopment Project Area is currently vacant ground. See Exhibit "B" and is owned by the City. B. Existing Zoning The Redevelopment Project Area is currently zoned HI (Heavy Industrial) and is within a Floodplain (FP) Overlay District. C. Existing Public Improvements The Redevelopment Project Area has limited access from under-improved abutting public streets. Gas, water, electrical and sanitary sewer services are available, but need to be improved and extended to the Site. D. Existing Site Conditions The Redevelopment Project Area is vacant and contains no structures. This area is generally covered with grass and weeds. Fallen trees and some areas of debris are also present. Numerous trees are also present. Storm water drainage will require the construction of a significant detention cell off of the site. Soils may require significant removal and structural fill or alternate construction means. Additional fill will be required to raise portions of the site to a level in compliance with designated floodplain regulatory levels. 3 • III. PROPOSED REDEVELOPMENT PROJECT A. Public Improvements 1. Public Access The site will have its primary access from "H" Street, which will be fully improved by the City with 9" PCC pavement. The City will vacate 16 Street East, 17th Street East and 17th Street East between Avenues "H" and "G". 2. Utilities Utilities and communication services shall be extended to the Site. The City will dewater the Site, construct an 8" sanitary sewer and 6" sanitary sewer stubs. City will install an underground power backbone. Gas and water mains will be abandoned, and a new water main in Avenue "H" will be constructed by the City. 3. Other Public Improvements The City will construct, own and operate the storm water detention cell, inlets and sub-drains designed to retain storm water drainage from the Project. B. Zoning and Platting The Redevelopment Project requires a special use permit to allow office uses in the HI District. The Project Area will be re-platted to combine the numerous residential lots into one lot for transfer to the redeveloper and one or more lots for the detention ponds to be retained by the City. The special use permit approval and re-platting of the Redevelopment Project Area is contemplated to be generally contemporaneous with the redevelopment approval process. The Redevelopment Project will be designed to comply with applicable site regulations of the FP District. C. Master Plan — City of Omaha The project is consistent with the City of Omaha's Master Plan. D. On-Site Development The City will environmentally remediate, clear and fill the site to a condition suitable for development consistent with the MOU and the attached site plan. The City will then sell the site to the redeveloper. The redeveloper will construct an approximately 87,500 SF building for office and related use, and install adequate on-site surface parking and landscaping. Exhibit "C" is a site plan of the project after the proposed construction. 4 E. Financing The City has determined that it will not be economically feasible to develop the project without the use of tax increment financing (TIF). Funds for the site improvements and building will come from borrowed money by the redeveloper. The redeveloper has obtained preliminary loan commitments from lenders. The estimated total cost of the redevelopment project is approximately eleven million dollars ($11,000,000.00). The TIF financing as a portion of the total project cost will make this project feasible. The Public Improvements and the pre-transfer work on the site will be paid by a combination of purchase price monies, TIF proceeds and other public funds as necessary. The preliminary cost for on-site and off-site infrastructure development including public improvements is estimated to be approximately $1,100,000.00. The Redevelopment Plan anticipates the allocation of excess ad valorem real property taxes for a period up to 15 years to help finance the project. The principal value of TIF secured loan is not expected to exceed $1,800,000.00 (excluding bond issuance, financing cost, interim debt, and other soft costs). The excess ad valorem taxes from this project will be computed from the real property base tax value assessed on this site for the year prior to the passage of this Redevelopment Plan Amendment. F. Cost Benefit Analysis 1. The use of Tax Increment Financing will not result in tax shifts. The current level of taxes will continue to flow to the current taxing entities and only the increased value of revenues resulting from the improvements will be applied to the cost of the improvement. 2. Public transportation service needs will be generated as a result of this project. The MOU requires that improved transportation services be provided that will increase the availability of public transportation for this project site at Avenue "H" and Abbott Drive. Metro Area Transit will provide and improve regularly schedule public transportation service connecting downtown Omaha, Riverfront Development and Eppley Airport. A new transportation schedule has been implemented and with increased ridership and demand, the level of service will be increased. The capacity of the infrastructure after development is more than adequate to serve any increased demands. 3. This expansion project will not significantly impact other industries in the area except to increase demand for construction and any manufacturing supplies that are locally procured. There will possibly be an increase in the availability of workers in the governmental employment sector as a result of the consolidation of offices as well as a need for a certain level of new employment. This project will have a very positive impact on employment in the area. r 4. The development at this site, rather than moving elsewhere, will maintain and add new jobs in the city. It will promote the development of an area of the City of Omaha that had been designated for development in 1976. 5 There have been other projects that were implemented in the general area; however, this site remained as a negative asset in its undeveloped condition. The completed project will provide a new location for governmental uses; will add future increased real-estate value to the site increasing the tax base of the local taxing entities; will add new employment opportunities and foster the continued development in this area. 5. The site and abutting public rights-of-way, where the project will be located, are in a designated blighted and substandard area and a current redevelopment project plan redevelopment area. 6. The project will further objectives of the City's Master Plan. 7. This project will develop property that is presently vacant. As a result, it will eliminate the possibility of illegal dumping and environmental contamination that may result. 8. During the TIF amortization period, the underlying real property will continue to be taxed based upon its original assessed value at the time the TIF financing is approved. The tax revenues based on the base valuation will be distributed to the various taxing jurisdictions.
