Mike Fahey,Mayor Acting Public Works Director Honorable President and Members of the City Council, The attached Resolution approves the Subdivision Agreement among the Thomsen Mile,LLC,the Thomsen Mile Owners Association, Sanitary and Improvement District(S.&I.D.) 423 of Douglas County, Nebraska and the City of Omaha. This Subdivision Agreement covers the public improvement of the Thomsen Mile Replat Three,a subdivision located Northwest of 168th Street and West Maple Road. The Subdivision Agreement stipulates which public improvements will be built by the Thomsen Mile, LLC in the Thomsen Mile Replat Three. The entire cost of the improvements made in this development will be paid by the Subdivider. The Public Works Department requests your consideration and approval of the attached Resolution and Subdivision Agreement. Ti m Date Mayor's Office Date Finance Director ,L'i''' P:\PW2\10473pjm.doc 97046.0 SUBDIVISION AGREEMENT "THE THOMSEN MILE REPLAT THREE" THIS AGREEMENT, made and entered into this /nlay of /7'I , 2004 by and between THE THOMSEN MILE, LLC (hereinafter referred to as "Subdivid "), and SANITARY AND IMPROVEMENT DISTRICT NO. 423 of DOUGLAS COUNTY, NEBRASKA, (hereinafter referred to as "SID"), THE THOMSEN MILE OWNER'S ASSOCIATION (hereinafter referred to as "ASSOCIATION") and the CITY OF OMAHA, a Municipal Corporation in the State of Nebraska (hereinafter referred to as "City"). WITNESSETH WHEREAS, Subdivider is the owner of the land included with the proposed plat attached hereto as Exhibit "A", which parcel of land (hereinafter referred to as the "Area to be Developed") is outside the corporate limits of the City within the City's zoning and platting jurisdiction; and, WHEREAS, the Subdivider proposes to build public improvements in the area to be developed; and, WHEREAS, the Subdivider wishes to connect the system of sanitary sewers to be constructed by the Subdivider, within the area to be developed, to the sewer system of the City; and, WHEREAS, the Subdivider has or will create The Thomsen Mile Owner's Association composed of the property owners of Lots 2 and 5 of The Thomsen Mile Replat Two as shown on attached Exhibit "A-1" ; and also Lots 1 through 3, inclusive, The Thomsen Mile Replat Three as shown on attached exhibit "A". WHEREAS, the Subdivider and the City wish to agree upon the method for the installation and allocation of expenses for public improvements to be constructed in the property. NOW, THEREFORE, in consideration of the above the following is agreed between the parties hereto: 1. Public Improvements. Attached hereto as Exhibit "B" and incorporated herein by reference are plans showing the public improvements to be installed on the property, i.e. storm sewer, sanitary sewer, and paving of public streets (hereinafter referred to as "IMPROVEMENTS"). All improvements must receive the approval of the Public Works Department of the City prior to construction. 2. Water, gas and electrical power. The Subdivider agrees to enter into an Agreement with the Metropolitan Utility District regarding all water and gas line extensions on the property, and 1 97046.0 enter into an Agreement with the Omaha Public Power District for power lines to be installed on the property. Copies of all Agreements with the Metropolitan Utility District and the Omaha Public Power District will be provided to the City within four months from the date of this Agreement. 3. Installation of Improvements. The Subdivider agrees to commence the timely and orderly installation of the improvements following execution of this Agreement, pursuant to Section 53-9 of the Omaha Municipal Code. The improvements shall be installed or adequate financial guarantees provided to the City prior to recording the final plat. 4. Payment for Improvements. The Subdivider shall pay the cost of improvements, as well as all charges by the Metropolitan Utilities District for water and gas installation and charges by the Omaha Public Power District for underground electrical service or overhead power installations. 5. Sidewalks along both sides of all public streets within the area to be developed shall be constructed by the Subdivider or District according to the following schedule: (1) Sidewalks shall be constructed immediately abutting vacant lots as soon as the lots comprising sixty-five percent (65%) of the abutting footage on such side have been built upon. (2) Sidewalks shall be constructed immediately abutting built-upon lots as soon as weather permits. (3) In any event, all sidewalks shall be constructed upon any public streets adjacent to the plat within three (3) years of the recording of the subdivision plat. 6. Right to connect to City sewer system. The City hereby acknowledges that it has given the Subdivider the right to connect the sanitary sewer system of the property to the City sanitary sewer system, subject to obtaining proper permits and paying the regular fees. 7. The area being replatted was part of the Subdivision Agreement approved by the City Council of the City on December 16, 1997 by Resolution No. 3371 and amended by the City Council of the City on June 25, 2001 by Resolution No. 2452. The only additions are the private improvements shown on Exhibit "B" to be constructed by the Subdivider and an increase in Interceptor Sewer Fees to be paid by the SID as follows: AREAS OF REPLAT: 3 MU Lots, Lots 1, 2, and 3, the Thomsen Mile Replat Three Lot 1, 21.670 Acres @ $5,484 = $118,838.28 Lot 2, 1.186 Acres @ $5,484 = $ 6,504.02 Lot 3, 1.435 Acres @ $5,484 = $ 7,869.54 TOTAL REPLAT AMOUNT = $133,211.84 2 #97046.0 PREVIOUSLY PAID: 3 MU Lots, Lots 1, 3 and 4, inclusive, The Thomsen Mile Replat Two: Lot 1, The Thomsen Mile Replat Two, 20.579 Acres @ $5,484 = $112,855.24 Lot 3, The Thomsen Mile Replat Two, 1.538 Acres @ $5,484 = $ 8,434.39 Lot 4, The Thomsen Mile Replat Two, 1.163 Acres @ $5,484 = $ 6,377.89 TOTAL PREVIOUSLY PAID= $127,667.52 ADDITIONAL FEES DUE CITY $ 5,544.32 8. Additional public improvements shall be constructed as follows: (A) relocation of Sprague Street between 168th Street and 168th Avenue approximately fifty feet north of its existing location and (B) relocation of a storm sewer pipe with existing location east of 168th Avenue and being relocated to the 168th Avenue right-of-way north to Sprague Street, and then in Sprague Street to 168th Street. (C) installation of a traffic signal at 168th and Spaulding Street prior to the issuance of a Certificate of Occupancy for any building in Lot 1 as shown on Exhibit "A". (D) Deceleration lanes on 168th Street. (E) Modification of 171st and Ruggles Street intersection. These proposed improvements are shown on Exhibit "B". It is agreed that improvements designated as (A), (B), (C), (D), and (E) will be paid for privately and no monies of the District will be used to pay for these improvements. 9. Additional private improvements as shown on Exhibit B including private street improvements to 168th Avenue, parking lot improvements, retaining walls, sidewalks and other miscellaneous necessary for a complete and functional commercial site plan. It is agreed that private improvements shown on Exhibit B will be paid for privately and no monies of the District will be used to pay for these improvements. 9. SID 423, per the 1997 Subdivision Agreement, affirms that SID will build a traffic signal be installed at the intersection of West Maple Road and 171st Street and be paid for as a general obligation expense of the District. District will install said signal and signal shall be operational prior to the issuance of a Certificate of Occupancy for any building on Lot 1 of Exhibit "A" attached hereto. 10. Oulot "A" shall be used as an access way for the lots within the subdivision. Outlot "A" ownership and maintenance responsibility including crack sealing, snow removal and street lighting shall be paid for by the Association or it's assignee. The District shall not expend any monies for the maintenance of private improvements within Outlot 'A". Pavement will be installed with the public improvements and will be designed to City street standards. WHEREAS, a Subdivision Agreement has been prepared setting forth all the provisions mentioned above. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT, the Subdivision Agreement among the City of Omaha, Sanitary and Improvement District 423 of Douglas County,Nebraska,the Thomsen Mile,LLC,and the Thomsen Mile Owners Association, as recommended by the Mayor, providing for the public and private improvements and sewer connection to the Omaha Sanitary Sewer System, is hereby approved.
