The attached Resolution approves the First Amendment to the Subdivision Agreement among the
City of Omaha, Pacesetter Homes, Inc., Walnut Lake Homeowners' Association, and Sanitary
and Improvement District No. 414 of Douglas County, Nebraska. This Subdivision Agreement
Amendment covers the construction of sidewalks located in S.&I.D. 414 in Douglas County,
Nebraska.
This Subdivision Agreement Amendment stipulates where sidewalks are to be built. The entire
cost of sidewalks made in this development will be paid by the Subdivider.
The Subdivision Agreement Amendment will benefit the City of Omaha and the Subdivider in
clarifying the responsibilities of the parties in building and maintaining the improvements in the
subdivision.
The Public Works Department requests your consideration and approval of the attached
Resolution and Subdivision Agreement Amendment.

FIRST AMENDMENT
TO
WALNUT LAKE SUBDIVISION AGREEMENT
(Lots 1-57,Walnut Lake;
Formerly Lots 1-46,Walnut Lake))
This First Amendment to Subdivision Agreement is made and entered into this
day of , 200 , by and between PACESETTER HOMES, INC.,
(hereinafter referrer to as "Subdivider"), WALNUT LAKE HOMEOWNERS'
ASSOCIATION (hereinafter "Association"), SANITARY AND IMPROVEMENT
DISTRICT NO. 414 of DOUGLAS COUNTY, NEBRASKA (hereinafter referred to as
"District"), and the CITY OF OMAHA, a Municipal Corporation in the State of
Nebraska (hereinafter referred to as "City").
WITNESSETH
WHEREAS, Subdivider is the owner of the land which is outside the corporate
limits of the City and within the City's zoning and platting jurisdiction; and
WHEREAS, the,City and the District entered into a Subdivision Agreement
(hereinafter referred to as the "Agreement"), adopted by the City Council of the City
of Omaha on June 29, 2000, setting forth certain conditions; and
WHEREAS, the Subdivision Agreement needs to be amended with respect to
sidewalks requirements of the Walnut Lake Subdivision.
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
1. Section I.G.of said Subdivision Agreement is hereby amended to read as follows:
G. Sidewalks. The Subdivider shall cause sidewalks within the area to be
developed to be constructed as shown on Exhibit"A", attached hereto and
incorporated herein, which Exhibit depicts the sidewalk plan/waiver as
approved by the Omaha Planning Board and City Council.
2. Except as amended, all terms, conditions and covenants of the original
Subdivision Agreement are incorporated herein and are to be and shall continue
in full force and effect.
3. This Agreement shall be binding upon the parties, their heirs, legal
representatives, successors, assigns and agents.
IN WITNESS WHEREOF, we, the executing parties, by our respective duly
authorized agents, hereby enter into this First Amendment to Subdivision Agreement
effective on the day and year first above written.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, Pacesetter Homes, Inc., Walnut Lake Homeowners'Association, and
Sanitary and Improvement District No. 414 of Douglas County, Nebraska, is building a
Subdivision, Walnut Lake, which is located Southeast of 156th Street and Rolling Ridge Road in
Douglas County,Nebraska; and,
WHEREAS, the First Amendment to the Subdivision Agreement regarding
sidewalks is in conformance with the terms of a previously granted waiver of Section 53-9(9),
Sidewalks; and,
WHEREAS, a Subdivision Agreement Amendment has been prepared setting
forth all the provisions mentioned above.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, the First Amendment to the Subdivision Agreement among the City of
Omaha and Pacesetter Homes, Inc., Walnut Lake Homeowners' Association, and Sanitary and
Improvement District No. 414 of Douglas County, Nebraska, as recommended by the Mayor,
providing for sidewalks, is hereby approved.
