The attached Resolution approves the contract with Judds Bros. Construction Co. for OPW
50485, being Omaha Public Safety Training Facility- Phase I Site Improvement.
The following bids were received on June 16, 2004. A detailed bid tabulation is attached.

Kiewit Western Co. $659,087.00
The Human Relations Director determined that the apparent low bid was non-compliant due to
its failure to comply with the provisions of Section 10-196 of the Omaha Municipal Code
dealing with PBE/DBE's.
The contractor has on file a current Annual Contract Compliance Report Form (CC-1). As is
City policy, the Human Relations Director will review the contractor to ensure compliance with
the Contract Compliance Ordinance.
The Finance Department is authorized to pay the cost of OPW 50485 from the Fire Capital
Organization 114512, 1998 Training Facility Fund 13295, year 2004 expenditure.

Dear Mr. Sudbeck:
Section 10-110 of the Omaha Municipal Code allows a department director to reject any or all
bids. This letter serves, as written notice that your bid is being rejected because the information
provided in the bid did not conform to the DBE/PBE specifications according to the City's
Human Relations Department.
You may contact the Omaha Human Relations Department at 444-5055 for more details.
Section 10-110 OMC also provides: "Within ten days after a bid is rejected, any rejected bidder
may appeal to the city council by filing with the city clerk a written objection stating all the
reasons for the objection."

WHEREAS,bids were submitted on June 16, 2004 for OPW 50485,being Omaha
Public Safety Training Facility- Phase I Site Improvement; and,
WHEREAS, Judds Bros. Construction Co. submitted a bid of $569,900.00 being
the lowest and best bid received for OPW 50485.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, the bid of $569,900.00 from Judds Bros. Construction Co. for OPW
50485, being Omaha Public Safety Training Facility - Phase I Site Improvement, being the
lowest and best bid received within the bid specifications, be accepted and the contract be
awarded.
BE IT FURTHER RESOLVED:
THAT, the contract with Judds Bros. Construction Co., as recommended by the
Mayor, in the amount of$569,900.00 is hereby approved.
BE IT ALSO FURTHER RESOLVED:
THAT, the Finance Department is authorized to pay the cost of OPW 50485 from
the Fire Capital Organization 114512, 1998 Public Facility Bond, Fund 13295, year 2004
expenditure.
