This Amendment covers the public improvement of West Dodge Place Replat 2, a subdivision located SoutYreaatof180`h and Cuming Streets. This Amendment revises the Subdivision Agreement approved by City Council on February 27, 2001 via Resolution No. 556. The Amendment provides for additional public improvements. The estimated total cost of the improvements is$289,800.00 of which$3,200.00 will be paid by General Obligation. If S.&I.D.462 is annexed by the City,any outstanding General Obligation Debt would be assumed by the City. The Public Works Department requests your consideration and approval of the attached Resolution and Amendment to the Subdivision Agreement. SUBDIVISION AGREEMENT AMENDMENT WEST DODGE PLACE REPLAT 2 This Amendment to Subdivision Agreement is made and entered into this 02241 day of , 2004, by and between WEST DODGE PLACE L.L.C., a Nebraska limited liability co fin (hereinafter referred to as "Subdivider"), SANITARY AND IMPROVEMENT DISTRICT NO. 462 OF DOUGLAS COUNTY, NEBRASKA (hereinafter referred to as "District"), and the CITY OF OMAHA, a municipal corporation in the State of Nebraska(hereinafter referred to as"City"). WIINEEEEILI: • WHEREAS, Subdivider is the owner of land included within the proposed replat attached hereto as Exhibit A,which parcel of land (hereinafter referred to as the"area to be developed")is outside the corporate limits of the City and within the City's zoning and platting jurisdiction;and WHEREAS, the area to be developed is Lots 1-4, West Dodge Place, a subdivision, as surveyed, platted and recorded in Douglas County, Nebraska,attached as Exhibit B;and WHEREAS, the City, the District, and the Subdivider entered into a Subdivision Agreement (hereinafter referred to as the"Subdivision Agreement"),adopted by the City Council of the City of Omaha on February 27,2001,via Resolution No. 556,setting forth certain conditions;and WHEREAS, the public improvements are proposed to be constructed to serve the area to be developed as shown on Exhibits C and D;and WHEREAS, the Subdivider proposes to pay for the installation of public improvements in accordance with the terms of the existing Subdivision Agreement;and WHEREAS, Section IX, Paragraph A of the Subdivision Agreement needs to be revised to show a reallocation on a pro rata basis of the interceptor sewer fees required from the District as a result of the replat. NOW,THEREFORE,the following is agreed between the parties hereto: 1. The City agrees to amend the Agreement to provide for a reallocation of the interceptor sewer fee paid by the District in respect of Lots 1 through 4, inclusive, West Dodge Place, as reflected in Article IX, said reallocation to be as follows: Area to be Replatted—West nodge Place Replat 9: Lot 1,West Dodge Place Replat 2—6.09 Acres= $33,397.56 Lot 2,West Dodge Place Replat 2—2.95 Acres= $16,177.80 Lot 3,West Dodge Place Replat 2—8.50 Acres= $46,614.00 Lot 4,West Dodge Place Replat 2—11.81 Acres= $64,766.04 Lot 5,West Dodge Place Replat 2—2.00 Acres= $10,968.00 {commercial acreage) TOTAL 31.35 acres @$5,484.00/acre $171,923.40 Previous Platting-Fees Paid for Interceptor Sewer: Lot 1,West Dodge Place- 5.05 Acres= $ 27,694.20 Lot 2,West Dodge Place- 2.03 Acres= $ 11,132.52 Lot 3,West Dodge Place-10.04 Acres= $ 55,059.36 Lot 4,West Dodge Place-12.10 Acres= $ 66,356.40 (commercial acreage) TOTAL 29.22 acres @$5,484.00/acre $160,242.48 TOTAL DUE TO CITY a 11,6R�? 2. The improvements shall be installed to Public Works Standards by the Subdivider prior to recording the final plat or adequate financial guarantees will be provided to the City in the amount of the engineer's estimate to include design and project management and as builts to ensure construction of said improvements. 3. In the event of any conflict between the terms and provisions of the Subdivision Agreement and this Amendment, this Amendment shall control. In each and every other respect, the Subdivision Agreement shall remain in full force and effect in accordance with its terms and is hereby ratified and confirmed. 4. This Amendment to Subdivision Agreement shall be binding upon the parties, their respective successors and assigns and shall run with the land shown on Exhibit A. F- 0 Z U' W 1-O LL c 25A CITY OF OMAHA LEGISLATIVE CHAMBER Omaha,Nebraska RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: WHEREAS,West Dodge Place,LLC proposes to build a subdivision to be known as • West Dodge Place Replat 2 which will be located Southeast of 180th and Cuming Streets; and, WHEREAS,the Subdivider will build public improvements in this subdivision;and, WHEREAS,West Dodge Place,LLC wishes to construct a sanitary sewer system and connect said system to the Sanitary Sewer System of the City of Omaha;.and, WHEREAS,the parties wish to agree upon the manner and the extent to which public funds may be expended in connection with public improvements to be constructed within the area to be developed or serving the area to be developed and the extent to which the contemplated public improvements specifically benefit property in the area to be developed and to what extent the cost of the same shall be specially assessed; and, WHEREAS, S.&I.D. 462 agrees to pay$11,680.92 as a sewer connection fee to be used for the construction of the sewers in the Papillion Creek Watershed; and, WHEREAS,an Amendment to the Subdivision Agreement has been prepared setting forth all the provisions mentioned above. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT, the Amendment to the Subdivision Agreement among the City of Omaha, West Dodge Place,LLC and Sanitary and Improvement District 462 of Douglas County,Nebraska, as recommended by the Mayor,providing for the public improvements and sewer connection to the Omaha Sanitary Sewer System, is hereby approved.
