RES 2022-0246 - Amend No. 1 to PSA with Thiele Geotech for OPW 53517 - Improvements to Digesters #1 and #2 City Clerk Office Use Only: �������/ t j n Publication Date (if applicable): RESOLUTION NO. -'V 3 5 Zb2l Agenda Date: f Department: 1// bet_ S Submitter: 6'l P(C CITY OF OMAHA LEGISLATIVE CHAMBER Omaha, Nebraska RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: WHEREAS, a Professional Services Agreement with Thiele Geotech, Inc. to provide professional services for OPW 53517, being the Improvements to Digesters #1 and #2 Project, was entered into on September 08, 2020 on September 08, 2020; and, WHEREAS, inspection services not included in the original agreement are required for the completion of this project; and, • WHEREAS, Thiele Geotech, Inc. has agreed to perform the additional services needed as detailed in the attached Amendment No. 1 to the Agreement, which by this reference is made a part hereof, for an additional fee not to exceed $9,750.00, which will be paid from the Sewer Revenue Improvements Fund 21124, Capital Asset Replacement Program Organization 116913. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT, as recommended by the Mayor, Amendment No. 1 to the Professional Services Agreement with Thiele Geotech, Inc. for additional design phase services on OPW 53517, being the Improvements to Digesters #1 and #2 Project, is hereby approved. Mayor AMENDMENT#1 TO THE PROFESSIONAL SERVICES AGREEMENT CITY OF OMAHA OPW 53517 THIS AMENDMENT,made and entered into this jetday of NA cxG�.��� by and between the firm of Thiele Geotech, Inc.,with offices at 13478 Chandler Road,Omaha,NE 68138, and hereinafter referred to as the"Consultant", and the City of Omaha,Nebraska, acting by and through its Mayor, hereinafter, referred to as the"City". WHEREAS, the City desires to engage the Consultant to amend the Engineering Agreement for OPW 53517, Improvements to Digesters#1 and#2 which was entered into on September 08, 2020, hereinafter called existing Agreement. NOW THEREFORE, it is hereby agreed that the existing Agreement be amended as follows: 1. The existing agreement shall be amended to include additional engineering work as outlined in the attached"Exhibit B", Schedule of Services. 2. The fee will consist of a compilation of estimated direct salary costs, direct non-salary costs, indirect salary costs, indirect non-salary costs and direct salary payroll additives, as provided in Exhibit"B" attached. 3. This modification will increase the existing agreement by$9,750.00. This AMENDMENT shall be deemed a part of, and be subject to all terms and conditions of the existing Agreement. Except as modified above, the existing Agreement shall remain in full force and effect. The increased costs are a result of inadequate initial welding and paint thickness tests requiring re- inspections. The re-inspections have led to additional manhours and trips made to the project site. It is estimated that 6 additional days will be required to complete the remaining welding inspections at a cost of approximately$1,625 per day,depending on the amount of hours worked per day,and will require an additional$9,750 beyond the original PSA amount of$19,120.
