Fanslau Planning Director Date: August 25, 2021 Subject: SUMMER HILL FARM (Lots 161-171, Outlots L-N) Southeast of 168th and State Streets Case #C10-16-261, C12-16-262 The Preliminary Plat of Summer Hill Farm, a subdivision outside the city limits, with rezoning from AG-Agricultural District to R4-Single-Family Residential District (High Density) was recommended for approval with conditions by the Planning Board at their regular meeting October 5, 2016, and subsequently approved with the same conditions by the City Council on December 6, 2016. The plat has been divided into two phases. The Final Plat of Phase 1, Summer Hill Farm (Lots 1-160, Outlots A-K), was approved by the City Council on September 18, 2018. This request for the second phase, SUMMER HILL FARM (Lots 161-171, Outlots L-N), includes 11 single-family residential lots, three outlots for open space/drainage purposes, and associated right-of-way within 4.68 acres. All of the lots will be rezoned from AG to R4. It should be noted that the lot numbers for this phase have been changed from the preliminary plat (originally Lots 10-20 and Outlot A). The conditions of approval of the preliminary plat are listed (with subsequent responses for this review included): 1. Coordinating with Douglas County to grade the subdivision to the ultimate profile of 168th and State Streets. (The applicant must coordinate with Douglas County on the ultimate profile of 168th Street and State Street, and grade the subdivision to match the profile. It should be noted that the consultant will be required to submit cross section information, for review purposes, that shows the relationship of the proposed site grading to the existing and future 168th Street and State Street improvements. Certification of the grade coordination will be required prior to the City of Omaha’s approval of the final plat.) 2. Enter into an inter-local agreement with Douglas County to provide for the improvement of 168th and State Streets to the three-lane section. (Phase 2 will include additional improvements on all four legs of the intersection of 168th and State Streets due to the major grade change proposed at the intersection. The second City Engineer signatures on the final plat shall not take place until concurrence from Douglas County that the 168th and State Street intersection improvement project is proceeding to construction. The aforementioned provisions will be included in the final subdivision agreement.) 3. No direct access to 168th Street or State Street will be permitted from the adjacent platted lots as well as no direct access to Leeman Street from Lots 1 or 163 will be permitted. (Place a note on the plat that lots and outlots will have no direct vehicular access to 168th Street or State Street. The Leeman Street condition is not applicable to this phase.) Reconfiguring the lot lines of Outlot A and Lots 15 and 16, to provide frontage for Outlot A to the Mormon Street/167th Avenue right-of-way. (Lots 15 and 16 have been changed to Lots 165 and 166 in this phase. The lot lines of Outlot A and Lots 165 and 166 have been reconfigured to provide frontage for Outlot A.) 5. Providing a final wetland analysis and mitigation plan, if necessary. (No wetland analysis or mitigation plan is required for this phase.) 6. Place a noise attenuation easement 115’ from the centerline of 168th and State Streets and provide the standard noise attenuation easement language on the plat. (The noise attenuation easement has been noted on the final plat.) 7. Provide for traffic calming on any street in excess of 1,000 feet. (Provisions for traffic calming will be included in the final subdivision agreement.) 8. Pave all street stubs to the property line and provide temporary turnarounds. (Proposed streets make connections to existing streets and as such no temporary turnarounds will be necessary.) 9. Provide sidewalks along 168th and State Street frontages and sidewalks as required by the Subdivision Ordinance. (Sidewalks will be provided as required. Provisions for sidewalks will be included in the final subdivision agreement.) 10. Include provisions for use, ownership and maintenance of the outlots in the subdivision agreement. (Provisions for use, ownership and maintenance of the outlots will be included in the final subdivision agreement.) 11. Neighborhood park contribution should be designated for Park 30 of the Suburban Park Master Plan. (Provisions for the neighborhood park contribution will be included in the final subdivision agreement.) 12. Provide a letter from the Douglas County Emergency Management confirming that acceptable emergency warning is being provided for the area. (This letter has been provided.) 13. Provide a letter of approval from Douglas County regarding noxious weed control. (This letter has been provided.) 14. Include provisions in the subdivision agreement for compliance with all applicable stormwater management ordinances and policies. (This will be provided for in the final subdivision agreement.) 15. Providing an acceptable debt ratio of 4% or less. (The projected total general obligation debt is estimated at $0. The projected valuation debt ratio is estimated at 0%. Improvements were provided for in Phase 1). Additional Comments: • OPPD has distribution equipment on/near the property. The applicant must coordinate with OPPD for removal/relocation of the equipment if necessary. ANALYSIS: Conditionally, the submitted final plat is consistent with the approved preliminary plat and ordinances of Chapter 53 Subdivisions of the Omaha Municipal Code. RECOMMENDATION: Approval of the rezoning from AG to R4. Approval of the final plat of SUMMER HILL FARM (Lots 161-171, Outlots L-N), subject to addressing the following prior to forwarding this request to the City Council for final action: 1. Place a note on the final plat mylars that the lots and outlots will have no direct vehicular access to 168th Street or State Street; 2. Submit a final acceptable subdivision agreement; and, 3. Coordinate with OPPD for removal/relocation of distribution equipment, if necessary. C10-16-261 C12-16-262 KMS-168, LLC REQUEST: Final Plat approval of SUMMER HILL FARM (Lots 161-171, Outlots L-N), a subdivision outside city limits, with rezoning from AG to R4 LOCATION: Southeast of 168th and State Streets At the Planning Board meeting held September 1, 2021, this case was on the Administrative portion of the agenda. Mr. Eric Englund, Assistant Director, appeared before the Board on behalf of the Planning Department. Mr. Englund advised that this request represented the second phase of the project and included 11 lots, representing the remainder of the Summer Hill Farm development. . He stated that most of the project was final platted in September, 2018. Mr. Englund explained that this second phase was back before the Board as a result of the construction plans by Douglas County for the 168th and State Street intersection. Due to the infrastructure work and grading, it is important that this final phase coincide with that project. Mr. Englund stated that the department recommended approval of the rezoning and approval of the final plat subject to the conditions in the recommendation report. Mr. Rosacker motioned for approval of the rezoning from AG to R4; and approval of the final plat of SUMMER HILL FARM (Lots 161-171, Outlots L-N), subject to addressing the following prior to forwarding this request to the City Council for final action: 1. Place a note on the final plat mylars that the lots and outlots will have no direct vehicular access to 168th Street or State Street; 2. Submit a final acceptable subdivision agreement; and, 3. Coordinate with OPPD for removal/relocation of distribution equipment, if necessary. Ms. Franklin seconded the motion which carried 7-0.
