Location: Northeast of 8th and Douglas Streets I. GENERAL INFORMATION: Purpose: To subdivide 3.8 acres of land into four lots to allow for redevelopment of the site. Existing Use(s): Civic Existing Zoning: DS/CBD-ACI-1(PL) Adjacent Land Use(s): Adjacent Zoning North: Civic North: CBD-ACI-1(PL) South: Civic South: CBD/CBD-ACI-1(PL) East: Civic East: CBD-ACI-1(PL)/HI-FW West: Residential West: CBD-ACI-1(PL) Future Land Use Designation(s): Downtown Mixed Use Applicable Regulations: If approved, the platted lots would be required to comply with the CBD site development regulations and the ACI Urban Design regulations. No building permits will be issued based on a site plan that does not comply with the provisions of the Zoning Ordinance. II. SPECIAL INFORMATION: Site Characteristics: The subject site generally consists of the north portion of the Heartland of America Park. The site contains 3.8 acres of land, including portions of the 6th Street and 7th Street right-of-way between Dodge and Douglas Streets and the remainder of the east/west alley in Block 99, Original City of Omaha, both of which would be vacated by this plat. A portion of Douglas Street will also be dedicated as part of this subdivision. Development Proposal: This plat is a part of the Omaha Riverfront Revitalization project. This public open space revitalization focuses on the renewal of three civic spaces downtown - Gene Leahy Mall, Heartland of America Park and Lewis & Clark Landing. Based on input received through public workshops, each park is being renovated to resolve access issues and improve connectivity, increase usable area, introduce a variety of new programs and provide improved activation and management. HEARTLAND OF AMERICA PARK REPLAT ONE Case No.C10-22-011, C12-22-012 PJB Page: 2 This plat is specific to a portion of the Heartland of America Park east of 8th Street. The proposed subdivision vacates the remaining portions of 6th and 7th Streets between Dodge and Douglas Streets and the adjacent alley right-of-way. The plat also extends the Douglas Street right-of-way in order to provide connectivity between the various parks throughout the Riverfront Development. Utilities: OPPD has a high voltage underground transmission line on the east edge of the property. OPPD shall be contacted to coordinate any grading, construction or vegetation management plans proposed near this line. Land Use and Planning: Per Section 55-67 OMC, whenever a public street, alley or other public right-of-way is vacated, the zoning district adjoining each site of such right- of-way shall be extended to the former center lines. The regulations applicable to the abutting properties shall also apply to the area of the vacation. This includes the existing ACI-Areas of Civic Importance Overlay District, which all future improvements on this site must comply with. The proposed rezoning is consistent with the Future Land Use element of the Omaha Master Plan. III. ANALYSIS: The proposed subdivision is consistent with the City’s subdivision regulations and carries out the goals and objectives of the City of Omaha Master Plan. IV. RECOMMENDATIONS: Approval of the rezoning from DS and CBD to CBD Approval of the ACI-Area of Civic Importance Overlay District. Approval of the Preliminary Plat, subject to the following conditions: 1. Coordinate with OPPD on any grading, construction or vegetation management plans proposed near the existing transmission line. Approval of the Final Plat, subject to the conditions of the Preliminary Plat approval and submittal of an acceptable final subdivision agreement (if necessary), prior to forwarding to the City Council.
