The proposed project is the construction of a trail along 144th Street around the west shore of Standing Bear Lake. The trail would be 10' concrete and would provide an important segment in the planned Standing Bear Lake loop trail. Total project costs are estimated to be $313,250 and the local share would be $163,250. The Recreational Trails program grant would be in the amount of$150,000. For this trail, the City of Omaha will provide planning, design, construction and management services consistent with previous other trail developments. The City's share of this project would come from the Park Bond Fund and is included in the 6 Year Capital Improvement Program, Fund 13352, Org. 131621, Project 0333. State the purpose of the trail and tell if it is new, a renovation, or an extension of an existing trail or combination. - This new trail will be a non-motorized recreational trail. This segment will roughly-`- follow the west shore of the Lake and the east side of 144th Street, crossing two tributaries feeding the Lake. The trail will provide two significant trail opportunities: 1)A northern extension of the city's 144th Street Trail, and 2) a vital segment of a larger loop trail that will surround the Standing Bear Lake and Recreation Area. b. If the trail will link other trail give the trail name. The trail will extend the existing 144th Street Trail north. The 144th Street Trail is a nine-mile-long trail which extends south through the city. It will also provide a critical link for the two trail segments which will run along the north and south shores of Standing Bear Lake, thus providing a continuous loop around the Lake. c. Type of trail surface, its proposed length and width. The trail with be a 10-foot wide, 6" thick concrete trail. It will be 2/3 mile long. The trail will include two stream crossings, one to be crossed by extending an existing culvert, the other to be forded with a pedestrian bridge. d. Identify the public users the trail primarily serve(bicycles, pedestrian, equestrian, motorized,q o ized, etc. or combination). The non-motorized trail will serve bicyclists, walkers,joggers, strollers, roller-bladers and dog-walkers. e. The anticipated start and completion dates. Anticipated start date for design and engineering is August 1, 2005. Completion date for construction is targeted for August 1, 2007. f How will the project be undertaken, i.e. by contract, force account, or combination. The project will be published for bid, and contracted out to a construction company. g. The project's relationship to any other current or pending state or federally funded trail project. This West Shore trail segment will be designed and constructed in conjunction with the south trail segment, which will be funded by a Transportation Enhancement Program grant recently received by the City of Omaha from NDOR. h. Identify other federal funding and the federal funding source. There is no other federal funding source for the trail segment for which this application pertains. i. Special or unique characteristics'or features that are included in the project. The project is special in that it will provide access to an area not previously accessible in the Standing Bear Lake and Recreation Area. The trail follows a scenic route along the western shore of Standing Bear Lake. One of two stream crossings will be achieved by way of an attractive pedestrian bridge. j. Describe and explain any urgency for the project. The City wishes to design and construct the West Shore project in conjunction with the design and construction of the rest of the Standing Bear Lake trail. This will allow the most efficient and cost effective way to implement the entire trail. Funding has already been received from NDOR for the south segment so the project must proceed in a timely manner. k. Describe any partnerships with others. The other funding partner, as stated, is a TEP grant received from NDOR for the south segment of the loop. There are no other funding partners for the West Shore segment. However, there is resounding support from the public for this project. Surrounding residents, lake users and interested citizens participated in a series of public meetings to discuss the rehabilitation of the Standing Bear Lake and Recreation Area. They mandated that the first priority for the Lake and Recreation Area should be construction of a loop trail circumventing the Lake. 1. Describe any known controversy or objections. There are no known objections to this trail. m. Describe signage that is included in cost estimate and what the purpose of the signage is. Only regulatory signs will be reimbursed; explain the need for regulatory signage when more than two are included in the cost estimates. There are no known objections to this trail. m. It is anticipated there will be approximately six signs included along trail. Signage will be regulatory in nature, cautioning trail users about creek crossings and curves. Signs will be designed according to City of Omaha park and trail signage standards,with wood, stained posts and painted metal sign panels. • n. Describe the Maintenance Plan, including cost estimates, schedule of maintenance, source of labor and how the sponsor plans to pay for the maintenance of the project for 25 years if the project is non-motorized or 10 years if the project is motorized. The City of Omaha's Park Maintenance staff currently maintains several recreational trails throughout the City as part of their regular park maintenance duties. The Standing Bear Lake and Recreation Area has a caretaker who is assigned solely to this park. This caretaker will conduct all routine maintenance related to the new trail, including regular mowing along the trail (at 10-day intervals), snow removal, control of vegetation to maintain visibility, sign replacement and fence repair as necessary. If pavement, drainage or bridge repairs are required, the work will be contracted out to the appropriate contractor. Costs for routine maintenance are funded through the City's general fund, as are contracted repairs. Anticipated costs for maintenance of the West Shore section of the Standing Bear Trail will be approximately $1,500 annually, with an average 4% escalator per year for inflation. In addition, the Lake has a citizen's Watershed Council,who frequently conducts clean-up days along the Lake. The Council will be encouraged to adopt this trail as part of the City's Adopt-a-Park program, to assist with trash pick-up. The Parties mutually agree that this Agreement is to be binding upon and inure to the benefit of their respective successors and assigns. 20. NGPC does not waive its sovereign immunity by entering into this Agreement and fully retains all immunities and defenses provided by state law. 21. The RECIPIENT certifies and warrants that no gratuities, kickbacks, or contingence fees were paid in connection with this Agreement,nor were any fees,commissions,gifts or other considerations made contingent upon the award of this Agreement. 22. The RECIPIENT agrees to credit Federal Funding of the Recreational Trail Program administered by the NGPC with a sign adjacent to the PROJECT. 23. The RECIPIENT agrees to defend and hold harmless NGPC and the State of Nebraska from any and all claims,lawsuits, losses and liability arising out of the Recipient's failure to perform any of the recipient's duties or obligations hereunder or in connection with the negligent performance of the recipient's duties or obligations. 24. This agreement cannot be amended or modified except by written instrument executed by all of the parties hereto. • 3 SPECIAL PROVISIONS The following special project terms and conditions were added to this agreement before it was signed by the parties hereto: Costs incurred must be consistent with grant application cost estimates. Wetland mitigation will need to take place and the Plan for mitigation must be approved by-the State (NGPC) and the Federal Highway Administration. The project will not move forward until the wetlands issue is taken care of. A Section 404 Permit from the Army Corps of Engineers will need to be obtained prior to moving the project forward.
