Transmitted herewith is a Resolution accepting the attached Negotiator's Report submitted by Jim
Cable,made in accordance with Necessity Ordinance No. 36211,passed April 1,2003,declaring the
necessity of appropriating and acquiring certain private property for the purpose of widening
Harrison Street, from 135th Street to 147th Street,known as Special Project No. 89-15,Federal Aid
Project STPC-5022(7).
The Negotiator, Jim Cable, was unsuccessful in negotiating and acquiring one parcel of land or
interest in property required for the project,which address is 6816 South 137th Plaza,and the Public
Works Department recommends that the Law Department of the City of Omaha take the necessary
steps and procedures to condemn the one parcel of land or interest in property non-negotiated.
The cost of the condemnation awards based on the Report of Appraisers made for the one parcel of
land or interest in property non-negotiated shall be paid from the Street and .Highway Bond
Organization 116167, 2000 Street and Highway Bond.No.1 (2004 Funding), Fund 13175.
The Public Works Department requests your consideration and recommends your approval of this
Resolution.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS,Jim Cable,Negotiator,has submitted to the City Council a Negotiator's
Report, attached, in accordance with the Necessity Ordinance No. 36211, passed April 1, 2003,
declaring the necessity of appropriating and acquiring certain private property for the purpose of
widening Harrison Street from 135th Street to 147th Street, known as Special Project No. 89-15,
Federal Aid Project STPC-5022(7); and,
WHEREAS, the report shows that the Negotiator, Jim Cable, was unsuccessful in
negotiating and acquiring one parcel of land or interest in property for the project,which address is
6816 South 137th Plaza.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:
THAT, the Negotiator's Report of Jim Cable, made in accordance with Necessity
Ordinance No. 36211 be and it hereby is approved.
THAT, the Finance Department is authorized to pay the cost of the condemnation
award based on the Report of Appraisers made for the one parcel of land or interest in property non-
negotiated, which address is 6816 South 137th Plaza, from the Street and Highway Bond
Organization 116167, 2000 Street and Highway Bond. No.1 (2004 Funding),Fund 13175.
BE IT FURTHER RESOLVED:
THAT, the Law Department of the City of Omaha be and it hereby is authorized to
take all necessary steps and procedures to condemn the required property or interest in property for
the one parcel of land non-negotiated, which address is 6816 South 137th Plaza.
