Mike Fahey,Mayor Acting Public Works Director Honorable President and Members of the City Council, The attached Resolution approves the Subdivision Agreement among the City of Omaha, Courtland Place No. 1, LLC and The ROWS at SoMa Property Owner's Association. This Subdivision Agreement covers the public improvement of The ROWS at SoMa of Douglas County,Nebraska located Southwest of 11th and Leavenworth Streets. This Subdivision Agreement stipulates which public and private improvements will be built by Courtland Place No. 1, LLC in The ROWS at SoMa. The entire cost of improvements made in this development will be paid by the Subdivider. The Subdivision Agreement will benefit the City of Omaha and the Subdivider in clarifying the responsibilities of the parties in building and maintaining the improvements in the subdivision. The Public Works Department requests your consideration and approval of the attached Resolution and Subdivision Agreement. Ebdon Date Mayor's Office Date Finance Director , '' P:\PW2\15021maf.doc SUBDIVISION AGREEMENT -' THE ROWS AT SoMa This Subdivision Agreement,made this o2 fai day of Q /' ,2004 by and between COURTLAND PLACE NO. 1,LLC, a Nebraska Corporation(hereinafter referred to as"SUBDIVIDER"),The ROW's at SoMa Property Owners Association,and the CITY OF OMAHA(hereinafter referred to as"CITY"). • WHEREAS,the Subdivider is the owner of the land shown on the proposed plat attached hereto as Exhibit"A" (hereinafter referred to as"PROPERTY"); and, WHEREAS,the Subdivider proposes to build private improvements on the property;and, WHEREAS,the Subdivider wishes to connect the system of sanitary sewers to be constructed within the property to the sewer system of the City of Omaha; and, WHEREAS the Subdivider has or will create The ROWS at SoMa Property Owners Association, comprised of Lots 1 thru 25 of The ROW's of SoMa fmal plat,who will own and maintain the private improvements shown on Exhibits"B"and"C"; and WHEREAS,the Subdivider and City desire to agree on the method for the installations and who will maintain the outlots and private improvements shown on Exhibits"B"and"C",to be constructed to serve the property. NOW,THEREFORE,in consideration of the above the following s agreed between the parties hereto: 1. Public Improvements: There are no public improvements associated with this development. 2. Private Improvements: The Subdivider shall construct private improvements as shown on Exhibits"B"and "C". Such private improvements shall be owned and maintained by the ROW's at SoMa Property Owner's Association. 3. Water. gas and electrical power: The Subdivider agrees to enter into and Agreement with the Metropolitan Utilities District regarding al water and gas line extensions on the property,and into an Agreement with the Omaha Public Power District for power lines to be installed on the property. Copies of all Agreements with the Metropolitan Utilities District and the Omaha Public Power District will be provided to the City within four months from the date this Agreement. 4. Sidewalks: Sidewalks exist along the frontage of the property. Replacement of sidewalk due to construction shall be reinstalled at the expense of the Subdivider. Attached hereto as Exhibit`B"and incorporated herein by reference is the plat showing the proposed sidewalk system to be installed to serve the property. 5. Right to connect to City sewer system: The City hereby acknowledges that it has given to the Subdivider the right to connect the sanitary sewer system of the property to the City sanitary sewer system,subject to obtaining proper permits and paying the regular fees. 6. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT, the Subdivision Agreement among the City of Omaha, Courtland Place No. 1, LLC and The ROWS at SoMa Property Owner's Association, as recommended by the Mayor, providing for the public and private improvements and sewer connections to the Omaha sewer system, is hereby approved.
