The attached proposed Resolution approves an Amendment to the Kings Heritage Estates I LLC
Redevelopment Plan, previously approved on by the City Council on November 19, 2002. This
Amendment changes the legal description to expand the Redevelopment Area, increases the Tax
Increment Financing amount and authorizes the use of additional private financing and bond
funds to cover the costs of additional Public Improvements to Bauman Avenue and 51st Street,
including the completion of Bauman Avenue, construction of 51st Street, curbs, gutters,
sidewalks and measures to eliminate storm drainage problems.
The Amendment to the Kings Heritage Estates Redevelopment Plan, approved by the Planning
Board on October 6, 2004, meets the requirements of Community Development Law and will
remediate unimproved streets and storm drainage problems in this Redevelopment Area.

The approval of an Amendment to the Kings Heritage Estates I, LLC Redevelopment Plan will
facilitate the completion of public improvements at the site of the construction of rent-to-own
single-family homes under the umbrella of a CROWN Project. The developer has requested
additional Tax Increment Financing (TIF) to be used to cover additional cost of public
improvements at the project site. The improvements will be built in compliance with standards
of the City of Omaha as established by the Public Works Department, which is a participant in
seeking approval of this request. The project site complies with community Development Law.
This Amendment will expand the Redevelopment area that is located in census tract 63.01,
which was previously designated. The location in census tract 63.01 is between 51st Street on the
east, 54th Street on the west, Newport Avenue on the north, and Redick Avenue on the south.
The approval of this request is a means to finish major improvements to Bauman Avenue and
51st Street, including intersections, in an effort to improve the street system and complete the
residential development. The expanded project provides for the completion of Bauman Avenue,
construction of 51st Street, curbs, gutters, sidewalks and measures to eliminate storm drainage
problems.
Unimproved streets and storm drainage problems will be remediated and improved by the use of
Tax Increment Financing, bank debt and street and sewer bond funds. The condition of the
traffic and storm sewer infrastructure serving the site is inadequate for effective development and
the cost of public improvements necessary to complete this residential development at this
location are estimated to be approximately One Hundred Thirty-one Thousand Dollars
($131,000.00).
The expanded project site is located in Census Tract 63.01, an area that continues to qualify to be
designated as substandard and blighted. This redevelopment will eliminate substandard and
blight conditions and provide increased residential homeownership opportunities in this area.
The Amended Redevelopment Plan will authorize the use of TIF to assist with additional
required public improvement cost to complete this development. The developer has requested
participation in financing the project cost due to damage caused by drainage problems not
specifically caused by this development. The funding provided is a partnership between the
developer and the City. The amendment authorized the sharing of project cost. The developer
portion of the cost will finish the construction of Bauman Avenue, the intersection of Bauman
Avenue and 51st Street and the construction of 51st Street at a cost of Fifty-six Thousand Dollars
($56,000.00). The City participation of Seventy-Five Thousand Dollars ($75,000.00) will cover
the resolution of the storm drainage problems.
The existing approved Kings Heritage Estates, I, LLC Redevelopment Plan is amended as
follows:
1. The Redevelopment Project Plan Area is expanded to include the Bauman
Avenue and 51 St Street intersection, 51st Street to the northeast corner of Lot
• 15, Hill Top Gardens and Lots 14, 15, 18 and 19 of Hill. Top Gardens
(abutting residential lots on the west side of 515t Street) being developed as
additional Rent-to-Own program properties which are located in Census
Tract 63.01.
2. The approved Redevelopment project funding in the Redevelopment Plan is
amended as follows:
A. The TIF amount of $187,000.00 is increased by $56,000 to the
amount of$243,000.00.
B. The amount of$75,000.00 in Public Funds from Street and Sewer
Bond fund account is authorized as the City share of the total
project cost.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS,Kings Heritage Estates I,LLC Redevelopment Plan was approved by the
City Council on November 19, 2002; and,
WHEREAS,the proposed Amendment to the Kings Heritage Estates I LLC
Redevelopment Plan changes the legal description to expand the Redevelopment Area, increases
the Tax Increment Financing amount and authorizes the use of additional private financing and
bond funds to cover the costs of additional Public Improvements to Bauman Avenue and 51st
Street, including the completion of Bauman Avenue, construction of 51st Street, curbs, gutters,
sidewalks and measures to eliminate storm drainage problems.
WHEREAS,an Industrial Development Bond issue may be used in this blighted and
substandard area to assist with project financing; and,
WHEREAS, Section 18-2108 of the Nebraska Revised Statutes requires the City of
Omaha to adopt a redevelopment plan before taking an active part in a redevelopment project;
including the division of ad valorem taxes under Sections 18-2147 through 18-2150, Revised
Statutes of Nebraska; and,
WHEREAS, the Amendment to the Kings Heritage Estates Redevelopment Plan,
approved by the Planning Board on October 6, 2004,meets the requirements of Community
Development Law and will facilitate remediation of unimproved streets and storm drainage
problems in this Redevelopment Area.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:
