ORD 36621 - Amendments to home rule charter to eleminate administrative services department 2 ORDINANCE NO. c_g 6/./ 1 AN ORDINANCE amendments to Sections 3.07, 3.18 and 6.01 of the Home Rule proposing 2 Charter of the City of Omaha, 1956, as amended, to eliminate the Administrative 3 Services Department and references thereto; to provide for the submission of the 4 proposed amendment to the qualified electors of the City of Omaha for their approval or 5 rejection at the Special City Election to be held on April 5, 2005; to repeal Sections 3.07, 6 3.18 and 6.01 of the Home Rule Charter of the City of Omaha as heretofore existing; and 7 to provide the effective date hereof. 8 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: 9 Section 1. That there be, and hereby is, submitted to the qualified electors of the City of 10 Omaha at the Special City Election to be held on April 5, 2005, for their approval or rejection, a 11 proposal to amend Sections 3.07, 3.18 and 6.01 of the Home Rule Charter, 1956, as amended, to 12 provide that such sections shall be amended to read as follows: 13 "Section 3.18. Administrative Services Department. 14 15 16 17 by—the Mayyor The n dm;nistr.,tiye Seri ces D;rector shall have h.,d Kt least five 18 years of such experience in a responsible public or private position which required 19 knowledge of, and the administration of, personnel charged with maintenance or 20 maintenance type responsibilities, vehicle fleet management, information 21 management and construction management, to qualify such Director for the duties 22 of the office. The following functions and programs shall be assigned to the 23 Administrative Services Department: information management, including but not 24 _ __r' r'• 'iii-uivuo, uu� 25 and equipment maintenance; and building services, not otherwise assigned to 26 other departments. 27 ORDINANCE NO. c344,2/ Page 2 1 Section 3.07. Organization of the Executive Branch. 2 3 The Executive Branch shall comprise the office of Mayor and the following 4 departments and department heads: 5 6 Administrative Services Department Administrative Services Director 7 Finance Department--Finance Director 8 Law Department--City Attorney 9 Parks, Recreation, and Public Property Department--Parks, Recreation, and Public 10 Property Director 11 Personnel Department--Personnel Director 12 Planning Department--Planning Director 13 Fire Department--Fire Chief 14 Police Department--Police Chief 15 Communications Department--Communications Chief 16 Public Works Department--Public Works Director 17 Human Relations Department--Human Relations Director 18 19 The primary subdivisions of departments shall be designated as divisions for 20 purposes of identification in this charter. 21 22 Section 6.01. Merit System--Definition and Scope. 23 24 All employees of the city shall be appointed with reference only to their 25 qualifications and fitness for employment in the city service. The city service 26 shall be divided into the unclassified and classified services. The unclassified 27 service shall consist of: 28 29 (1) All elective officers. 30 31 (2) The heads or directors of the Finance Department; Parks, Recreation, and 32 Public Property Department; Personnel Department; Planning Department; Public 33 Safety Department; Public Works Department; Administrative Services 34 Department and such departments as may be established in the future under this 35 charter. 36 37 (3) Employees in the immediate office of the Mayor, provided that the Mayor 38 optionally may appoint as members of the Mayor's personal staff employees with 39 permanent status in the classified service in which case such employees shall be 40 continued in the classified service. 41 F ORDINANCE NO. C.5 ,2/ Page 3 1 (4) Part-time, temporary, and seasonal employees. 2 3 (5) Members of appointive boards, commissions, and authorities. 4 5 (6) The heads or directors of the Dock Board, Housing Authority, Library 6 Board, and such administrative boards, commissions, and authorities as may be 7 established in the future under this charter. 8 9 (7) Consultants, experts, and others employed to conduct special inquiries or 10 studies. 11 The classified service shall consist of all positions not specifically included in the 12 unclassified service. All personnel actions relating to positions in the classified 13 service shall be consistent with the provisions of this article and subject to the 14 supervision and control of the Personnel Department as provided in this article." 15 16 Section 2. The ballot for said proposed amendment shall be submitted to the qualified 17 electors of the City of Omaha in substantially the following form: 18 "OFFICIAL BALLOT 19 SPECIAL CITY ELECTION 20 HELD APRIL 5, 2005 21 CHARTER AMENDMENT 22 SHALL SECTIONS 3.07, 3.18 AND 6.01 OF THE HOME RULE CHARTER OF THE CITY 23 OF OMAHA BE AMENDED TO ELIMINATE THE ADMINISTRATIVE SERVICES 24 DEPARTMENT AND ALL REFERENCES THERETO, ALL AS PROVIDED IN THE 25 NOTICE OF ELECTION? 26 YES 27 NO" 28 1 ORDINANCE NO. G4,2, Page 4 1 Section 3. Under said question and proposition on the ballot shall be printed the word 2 "Yes" and the word "No". All ballots of qualified electors cast at the aforesaid election with an 3 "X" or other clear or intelligible mark placed before the word "Yes" shall be understood to be, 4 and shall be counted, in favor of the proposition set forth in said question, and all ballots of 5 qualified electors cast at the aforesaid election with an "X" or other clear or intelligible mark 6 placed before the word "No" shall be understood to be, and shall be counted, against the 7 proposition set forth in said question. 8 Section 4. That said ballots shall be white in color and printed in black ink or other color 9 designated in conformance with Section 32-806 of the Revised Statutes of Nebraska, 1943, as 10 amended. 11 Section 5. The officer having charge of General and Special Elections of the City of 12 Omaha shall conduct the election in all respects the same as other City elections and in the 13 manner provided by law. 14 Section 6. The City Clerk is hereby directed to transmit a certified copy of this 15 Ordinance to the Election Commissioner of Douglas County, Nebraska, and to give public notice 16 to the electors, as provided by law. 17 Section 7. If said proposition is approved by the electors, then Sections 3.07, 3.18 and 18 6.01 of the Home Rule Charter of the City of Omaha, as heretofore existing, shall be repealed. 19 Section 8. This Ordinance is declared to be administrative and not legislative in 20 character and, therefore, under the provisions of Section 2.12 of the Home Rule Charter of the 21 • ' 1 ORDINANCE NO.
