Company located at 1218 S 119 Street, Omaha, NE 68144 (Douglas County) has requested
an addition to premise. (See Attached Diagram). The description for the new license will be
read as follows unless changed by State Patrol: One story irregular shaped building

FIRST AMENDMENT TO BOARDWALK SOUARE SHOPPING CENTER
COMMERCIAL LEASE •
This First Amendment To Commercial Lease(the "Amendment") is dated this
2005,by and between Boardwalk Square,LLC. (hereinafter referred to as"Landlord")and"Absolutely.,,r; _ ; t ;;'
Fresh Seafood Company,(hereinafter referred to as"Tenant"). •
WHEREAS, Landlord and Tenant have previously entered into a Commercial Lease dated July I,2003, r
under which Tenant leases approximately 2,358 square feet of area located at 1218 S 1 19"'Street.Omaha,
Nebraska 68114,with said term expiring June 30,2008;and
WHEREAS,Landlord and Tenant desire to modify the Lease;and =ems;•
NOW THEREFORE, in consideration of the mutual covenants contained herein and for other good and 1
valuable consideration the parties agree as follows:
I. Premises: The Premises shall be expanded to include an additional 1210 rentable square feet of
expansion space and will consist of a total of 3,568 rentable square feet, the "Expanded
Premises". Tenant agrees to take the additional 1210 square feet of expansion space on
November 1,2005.
2. Term: The term of the lease shall be extended two(2)yi ars to June 30,2010
3. Base Rent: Effective November 1,2005,Tenant's Base Rent for the"Expanded Premises"shall
be amended to the following Base Rent Schedule:
November 1,2005 to June 30,2006 $2,453.00 Per Month
July I,2006 to June 30,2007 $2,527.33 Per Month
July 1,2007 to June 30,2008 S2,601.67 Per Month
July 1,2008 to June 30,2009 $2,676.00 Per Month
July 1,2009 to June 30,2010 $2,750.33 Per Month
4. Operating Expenses: Tenant shall pay $927.09 per month starting November I, 2005 for
prorated share of Operating Expenses with such amount to be adjusted January I'of each New
Year to the prevailing rate of the Business Center's Operating Expenses adjusted to the prorated
share of Tenant's leased space.
5. Tenant's Proportionate Share:4.69%(Tenant's rentable square feet divided by Building's total
rentable square feet=3,568/76,013)
6. Condition of Premises: :Landlord to replace two(2)existing 2.5 Ton Carrier package units with
two (2) new 2.5 Ton Carrier units and run new gas pipe to kitchen location for a total sum of
$4,916.27. Landlord also agrees to relocated water heater to new expansion space for a total cost
of$6,950. Landlord also grants the use of the sewer connection located on the North wall of the
expansion space. Except for the above stated items,Tenant accepts space in-As Is'condition.
7. This First Amendment to Commercial Lease is contingent upon Punky Productions,Inc i.e.Mic's
Karaoke Bar (MICS) executing the downsizing amendment for the above 1210 square feet
currently located in their bay.
8. Upon the termination of the lease for MICS, Landlord agrees that the added on exterior delivery
door partition may be removed at Tenant's expense,as long as the wall is returned to its original
condition matching the remaining exterior of the building.
9. Neither Absolutely Fresh Seafood (AFS) nor M1CS will be charged or suffer commissions,
administrative costs or other charges except as provided in the First Amendment,concerning only
the First Amendment.
10. AFS agrees to provide access to expansion bay, i.e. 1210 square feet, including key and alarm
code, to MICS, in the event MICS should need to access the electrical panel or water shutoff
valve.
I I. AFS agrees to allow MICS to use the added on pantry that is a part of said bay i.e. 1210 square
feet. If MICS discontinues business,access to this pantry will be denied and revert to Absolutely
Fresh Seafood.

12. This First Amendment to Commercial Lease is contingent on Absolutely Fresh Seafood (AFS)
obtaining proper permits(including Class C liquor license for the sale of on and off sale liquor)
and AFS and MICS coming to terms on utilities distribution and monthly cost.

13. Article XXXIV—Other Provisions—Section 34.1 —The following will be deleted: For example,
the per square foot base rent during the first year of the Option Period would be $9.00 and the
monthly Base Rent would be$1,768.50 and will be replaced with: -For example,the per square
foot base rent during the first year of the Option Period would be$9.50 and the monthly Base
Rent would be$2,824.67.
14. Except as herein specifically provided,the terms and conditions of the Lease shall continue in full
force and effect.
15. This Amendment shall be binding upon and inure to the benefit of the parties hereto, their
successors and assigns.
16.The parties hereto hereby reaffirm and ratify all covenants,representations and warranties in the
Lease as amended by this First Amendment.
17. This First Amendment modifies and amends the Commercial Lease. To the extent there are any
inconsistencies between this First Amendment To Commercial Lease and the Commercial Lease,
the terms and provisions of this First Amendment To Commercial Lease shall control.

Dear Liquor License Applicant:
This letter is notification that a hearing before the Omaha City Council on your application for
liquor license has been set for December 13, 2005. The City Council Meeting begins at 2:00
P.M. in the Legislative Chamber, (LC-4), Omaha/Douglas Civic Center, 1819 Farnam Street,
Omaha, Nebraska. City Council Liquor Rule No. 6 states, "Each applicant for any type of
license shall be personally present in the Council Chambers, in order that the Council may make
inquiries, on the date of public hearing of the application for said license". Failure to be present
at this Council Meeting is grounds to recommend denial of your application to the Nebraska
Liquor Control Commission.
If you are making changes to the type of business or the type of activities that will be
operated on the new premises. Please complete and return the attached. (Ordinance No.
