The attached proposed Resolution is presented in support of a proposed bond issue of Douglas
County on behalf of Creighton University. Pursuant to Nebraska statutes, the City Council must
find that this proposed project is within an approved development plan or plans for the area and
located within a Substandard and Blighted area.
The Planning Board and the City Council have previously approved, the Substandard and
Blighted designation and the Creighton University Master Plan which documents that these
criteria have been met.
The proposed project consists of the acquisition, construction and purchase of residence halls,
parking garages, an academic student service center, technology upgrades and other similar
capital improvements to the main Creighton University campus at or in the vicinity of 25th and
California Streets, Omaha, Nebraska. This development is funded through the financing of
Creighton University and no City funding is involved.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, Creighton University (the "University"), a Nebraska nonprofit
corporation, has requested The County of Douglas, Nebraska (the "County") to issue and sell for
the University the County's tax-exempt educational facilities industrial development revenue
bonds (the "Bonds") pursuant to provisions of the Act (as hereinafter defined) for the purpose of
defraying the cost of certain projects (collectively, the "Project"), within the meaning of the Act,
consisting of the acquisition, construction and purchase of certain capital improvements by the
University, located at or in the vicinity of 25th and California Streets, Omaha, Nebraska 68178,
which capital improvements include, among other things, student residence halls, parking
facilities, an academic student service center, technology upgrades and related necessary and
appropriate facilities to be located at the main Creighton University campus; and,
WHEREAS, the County is authorized and empowered by the provisions of the
Nebraska Industrial Development Act, Chapter 13, Article 11 of the Nebraska Revised Statutes,
1997, as amended (the "Act"), to finance projects, as that term is defined in the Act, including,
among other things, any land, building or improvements located in a blighted area located within
a municipality of the metropolitan class which shall be suitable for any enterprise, including, but
not limited to, nonprofit commercial or business enterprises, and to issue its industrial revenue
bonds for the purpose of defraying the cost of acquisition, construction or purchase of any such
project; and,
WHEREAS, it is necessary under the Act prior to the issuance of the Bonds for
the City Council of the City of Omaha to conduct a public hearing in satisfaction of§ 13-1105(3)
of the Act, which requires the governing body of any city in which a proposed project to be
financed by the issuance of industrial revenue bonds is to be located to determine whether the
location of the proposed project is within a blighted area and whether the proposed project is
within the development plan or plans for the area; and,
WHEREAS, pursuant to a Notice of Public Hearing, duly published in The Daily
Record on January 20 and January 21, 2005, the City Council conducted on January 25, 2005 a
public hearing, pursuant to and in compliance with the requirements of § 13-1105(3) of the Act,
at which all interested parties were given an opportunity to express their views orally or in
writing for or against the determination by the City Council that the location of the proposed
Project is within a blighted area and within the development plan or plans of the City of Omaha.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
CITY OF OMAHA:
THAT, as required by § 13-1105(3) of the Act, the area where the proposed
Project is to be located is within the City of Omaha, generally north of I-480 and east of the
North Freeway, and has been previously designated by the City Council as a Substandard and
Blighted area, within the meaning of § 13-1101(5) of the Act, by Resolution No. 1335, adopted
on June 8, 1993, such designation is hereby ratified and confirmed, and the proposed Project is
hereby determined to be located in a Substandard and Blighted area.
THAT, as required by § 13-1105(3) of the Act, the proposed Project is within the
Creighton University Redevelopment Plan Area as identified in the Creighton University Master
Plan approved by the City Council by Resolution No. 177, adopted on March 2, 2004, such
approval is hereby ratified and confirmed, and the proposed Project is hereby determined to be
within and in compliance with the Master Plan of the City of Omaha.
